2. Direct this order to state registration in the Ministry of Justice of the Russian Federation.
3. To impose control of execution of this order on the deputy director of the Federal Migration Service S. P. Kalyuzhny.

Name of the state service and state function
1. Administrative regulations of the Federal Migration Service on provision of the state service in issue, replacement and on execution of the state function on accounting of the passports of the citizen of the Russian Federation proving the identity of the citizen of the Russian Federation in the territory of the Russian Federation * (1), determines terms and the sequence of actions (ministerial procedures) of the Federal Migration Service * (2), territorial authorities of FMS of Russia and their structural divisions, and also order of interaction of FMS of Russia, territorial authorities and their structural divisions with federal executive bodies, executive bodies of subjects of the Russian Federation, local government bodies in case of issue and replacement of the passports of the citizen of the Russian Federation proving the identity of the citizen of the Russian Federation in the territory of the Russian Federation - passports of the citizen of the Russian Federation * (3), and to their accounting.
Organa, participating in provision of the state service and execution of the state function
2. Issue, replacement and accounting of passports are performed by FMS of Russia, territorial authorities of FMS of Russia * (4) and their structural divisions * (5).
In territorial authorities and divisions the authorized officers involved in provision of the state service and execution of the state function are their heads, deputy managers, inspection structure (the staff of law-enforcement bodies of the Russian Federation, federal government civil servants and workers) * (6).
3. Territorial authorities and divisions in case of issue, replacement and accounting of passports interact with:
law-enforcement bodies of the Russian Federation;
the bodies performing state registration of acts of civil status in the territory of the Russian Federation;
the organizations and bodies performing punishment;
diplomatic representations and consular establishments of the Russian Federation;
housing and operational organizations of the state, municipal and private housing stocks;
stationary organizations of social servicing of the population;
medical institutions;
military units;
military commissariats;
tax authorities of the Russian Federation;
local government bodies.
Procedures of interaction with the specified bodies and the organizations are determined by Administrative regulations, and also regulatory legal acts of the Russian Federation and the relevant agreements.
Normative legal regulation of provision of the state service and execution of the state function
4. Provision of the state service in issue, replacement and execution of the state function on accounting of passports are performed according to Presidential decrees of the Russian Federation of March 13, 1997 N 232 "About the main identity document of the citizen of the Russian Federation in the territory of the Russian Federation" * (7), of July 19, 2004 N 928 "Questions of the Federal Migration Service" * (8), the order of the Government of the Russian Federation of July 8, 1997 N 828 "About approval of the Regulations on the passport of the citizen of the Russian Federation, sample of the form and the description of the passport of the citizen of the Russian Federation" * (9).
The FMS of Russia, territorial authorities and divisions in case of issue, replacement and accounting of passports are also guided by articles 85 and 333.33 of the Tax Code of the Russian Federation * (10), the Federal Laws of May 31, 2002 N 62-FZ "About citizenship of the Russian Federation" * (11), of November 15, 1997 N 143-FZ "About acts of civil status" * (12) and of June 12, 2002 N 67-FZ "About basic guarantees of the voting rights and the participation rights in referendum of citizens of the Russian Federation" * (13), the Regulations on procedure for consideration of questions of citizenship of the Russian Federation approved by the Presidential decree of the Russian Federation of November 14, 2002 N 1325 * (14), and other regulatory legal acts of the Russian Federation.
Description of result of provision of the state service and execution of the state function
5. Timely issue or replacement of the passport is result of provision of the state service.
Execution of the state function entering of the data into documentary and electronic databases issued is result, of the lost (stolen) passports (forms of the passport) and passports which are subject to delivery (withdrawal).
Description of applicants
6. Receivers of the state service in issue of passports are citizens of the Russian Federation in case:
achievements of 14-year age;
losses (plunder) of the passport.
Receivers of the state service in issue of passports are also the citizens of the Russian Federation who reached 14-year age and acquired citizenship of the Russian Federation just before receipt of the passport.
Receivers of the state service in replacement of passports are citizens of the Russian Federation in case:
achievements of 20-year age;
achievements of 45-year age;
changes by the citizen in accordance with the established procedure surnames, name, middle name, data on date (number, month, year) and (or) birthplace;
sex change;
unfitness of the passport for further use owing to depreciation, damage or other reasons;
detection of inaccuracy or inaccuracy of the records made in the passport;
appearance changes.
Procedure for informing on rules of provision of the state service
7. The main requirements to informing applicants are:
reliability of the provided information;
clearness in information statement;
completeness of informing;
visualization of forms of the provided information;
convenience and availability of receipt of information;
efficiency of provision of information.
8. Information on the state service is provided:
with use of means of telephone communication, electronic informing and the electronic equipment;
by means of placement in information and telecommunication networks including the Internet, including the Single portal of the state and municipal services * (1), publications in mass media, editions of information materials (brochures, booklets). The website of FMS of Russia is www.fms.qov.ru, contact telephone number: (495) 698-00-78;
directly in premises of the divisions participating in provision of the state service.
9. At stands of the divisions participating in provision of the state service and also on the Websites of FMS of Russia, territorial authorities and divisions the following information is placed:
working hours of the relevant division;
addresses of other organizations participating in process of provision of the state service including addresses of finding of the nearest bank institutions in which it is possible to make payment of the state fee;
bank details for payment of the state fee;
addresses of the official Websites of FMS of Russia, territorial authorities and divisions;
phone number and e-mail addresses of service desks of FMS of Russia, territorial authorities and divisions;
phone numbers on which it is possible to perform preliminary record;
about the list of the documents necessary for receipt (replacement) of the passport;
about procedure for provision of the state service;
about the sizes and payment procedure of the state fee;
extraction from the legislative and other regulatory legal acts of the Russian Federation containing the regulations regulating activities for provision of the state service;
text of Administrative regulations;
short description of procedure for provision of the state service;
procedure for receipt of consultations;
procedure for appeal of decisions, actions or failure to act of the officials providing the state service.
The following document forms are placed:
the application form about issue (replacement) of the passport;
form of the form of payment of the state fee;
format of request for receipt of information.
10. By means of answerphone which works round the clock the applicant is informed about:
working hours of the relevant division, and also the organizations participating in process of provision of the state service;
the address of the location of other organizations participating in process of provision of the state service including addresses of finding of the nearest bank institutions in which it is possible to make payment of the state fee;
bank details for payment of the state fee;
addresses of the official Websites of FMS of Russia, territorial authorities and divisions;
phone numbers and e-mail addresses of service desks of FMS of Russia, territorial authorities and divisions;
phone numbers on which it is possible to perform preliminary record.
11. The citizens who submitted to divisions documents for receipt of the passport are informed by employees on terms of consideration, registration and return of the submitted documents to them, and in necessary cases '-by phone specified in documents and/or by e-mail. From the moment of submission of documents the applicant has the right in reception hours of the population to address for receipt of information on stage of execution of the passport.
In case of filing of application about issue (replacement) of the passport with use of the Single portal citizens are informed on the course of consideration of the application through the Single portal.
12. Information on e-mail or via the Website is provided in the mode of questions-answers to each applicant who asked question no later than 5 working days following behind day of receipt of question.
13. Consultation of receivers of the state service about procedure for its provision is carried out to working hours.
Consultations are provided on the following questions:
about the list of the documents necessary for receipt of this state service, completeness (sufficiency) of the submitted (submitted) documents;
about addresses of other organizations participating in process of provision of the state service;
about time of receiving and delivery of documents;
about procedure for appeal of actions or failure to act of officials during provision of the state service.
Personal consultations, written consultations and consultations by phone are provided.
All consultations, and also provided by employees during consultations of the document form are non-paid.
The applicant can choose two options of receipt of personal consultation: in the mode of general queue or on record (by phone).
The employee performing individual oral consultation shall take all necessary measures for giving complete and prompt response on the questions posed, including with involvement of other employees. Waiting time of the interested person in case of individual oral consultation cannot exceed 30 minutes.
The employee of division performs individual oral consultation of each interested person no more than 10 minutes.
If preparation of the answer requires long time, the employee performing individual oral consultation can suggest interested persons to apply for necessary information in writing or to fix other time, convenient for interested persons, for oral consultation.
For ensuring individual oral consultation in divisions certain employees are allocated.
In case of the oral address of interested persons (by phone or personally) the employees performing acceptance and consultation give the answer independently. If the employee whom the applicant addressed cannot answer question independently, then he can suggest the applicant to address in writing or to fix other time, convenient for the interested person, for receipt of information.
Calls of citizens are received according to the working schedule of employees and officials who directly interact with applicants. The applicant has the right to choose call time, convenient for it. Waiting time of conversation cannot exceed 5 sound signals.
In case of the response to phone calls the employee performing acceptance and informing, having picked up the phone, shall tell surname, the name, middle name, post and the name of division. During the conversation it is necessary to pronounce words accurately, to avoid "parallel talk" with surrounding people and not to interrupt conversation because of receipt of call on other device. At the end of consultation the employee performing acceptance and consultation shall sum up briefly the results and list measures which should be accepted (who exactly, when and that shall make). The maximum time of conversation taking into account the age which addressed and perception of the obtained information by it - 5 minutes.
In case of impossibility of the employee who received call to answer independently the questions posed the phone call is readdressed transferred) to other official or the addressed citizen is told telephone number according to which it can obtain information necessary for it.
14. In case of receipt of request for written consultation of the applicant division shall answer it till 30 days.
Answers to written addresses go in writing and shall contain: answers to the questions posed, surname, initials and phone number of the contractor. The answer is signed by the division manager, and in case of its absence - the deputy or person fulfilling its duties * (15).
Terms of provision of the state service
15. Issue and replacement of passports are made by divisions at the place of residence, the place of stay or in the place of the address of the citizen.
16. Passports are issued to citizens:
in 10-day time from the date of adoption of all necessary documents by divisions (or statements for issue (replacement) of the passport and the personal photo in the form of electronic documents) in case of execution of the passport at the place of residence, and also in connection with loss (stealing) of the passport if the lost (stolen) passport was issued earlier by the same division;
in 2-month time from the date of adoption of all necessary documents by divisions (or statements for issue (replacement) of the passport and the personal photo in the form of electronic documents) in case of execution of the passport not at the place of residence or in connection with loss (stealing) of the passport if the lost (stolen) passport was issued earlier by other division.
17. Applicants, as a rule, perform no more than two interactions with the corresponding officials and employees concerning obtaining or replacement of the passport except as specified when submission of the documents, necessary for execution of the passport, identifying the citizen's personality is required.
In case of submission by the citizen of the statement for issue (replacement) of the passport and personal photo in the form of electronic documents with use of the Single portal issue of the passport is provided in case of single visit of division by the applicant.
18. Reception of citizens by the staff of divisions participating in provision of the state service is made in day and evening, and also 1st and 3rd Saturday of month (except for holidays). Monday after working Saturday - the day off. The working schedule on reception of citizens:

Lunch break from 13:00 to 13.45, on Tuesdays and Thursdays from 14:00 till 14:45.

19. Working hours of other employees participating in provision of this state service are established according to regulations of division.
The division manager depending on situation has the right to redistribute during the working day of the employees performing acceptance of applicants if it does not lead to increase in waiting time of acceptance by citizens.
20. Reception of citizens is conducted by means of electronic management system by queue or by appointment by phone. In case of determination of time of acceptance by phone the employee fixes time on the basis of the schedule of already planned time of acceptance of applicants and time convenient to the citizen.
21. Citizens are given opportunity of preliminary making an appointment. Preliminary record is performed in case of the personal address of citizens, and if technically possible - with use of e-mail. In case of preliminary record the citizen reports the data, subject of the address and desirable time of submission of documents. Preliminary record is performed by entering of information into books of record of citizens which are kept on paper or electronic media. The applicant is told time of documents acceptance and number of office in which it is necessary to address. In case of the personal address the coupon confirmation is issued to the applicant.
22. The maximum waiting time is established:
in queue in case of primary submission of documents on obtaining pasporta20 minutes;
in case of submission of documents on receipt of the passport by appointment - 5 minutes since on which record was performed;
in case of submission of additional (missing) documents for receipt of the passport, request for receipt of information - 10 minutes;
in case of receipt of the passport - 5 minutes;
in case of expectation in queue on acceptance to the official for receipt of consultation - 30 minutes.
The bases for refusal in provision of the state service
23. The basis for refusal in issue of the passport is:
absence at person of citizenship of the Russian Federation;
not achievement of 14 years by the citizen of age;
non-presentation of the documents specified in Items 34, of 35, 36 Administrative regulations, except for the documents necessary for putting down of obligatory marks in the passport (the military ID, certificates of birth of children aged up to 14 years, the documents confirming registration at the place of residence, the certificate on marriage, the certificate on annulment of marriage);
discrepancy of the size and number of personal photos to requirements, stipulated in Item 34.3 Administrative regulations;
lack of the receipt confirming payment of the state fee.
Requirements to places of provision of the state service
24. Rooms for provision of the state service shall be placed on lower, it is more preferable on the first floors of buildings of the divisions participating in its provision. For receivers of the state service the separate entrance will be organized.
In case of opportunity about rooms parking spaces for motor transport will be organized.
25. The central entrance to buildings (rooms) of divisions is equipped with the information plate (sign) containing the following information:
the name of the division performing provision of the state service;
location;
operating mode;
address of the official website;
telephone numbers and e-mail address of service desk.
26. Reception of citizens is performed in the rooms and halls of servicing including places of expectation, informing and acceptance of applicants intended for these purposes.
At entrance to each of rooms the plate with its name and the internal scheme is placed.
27. In premises of divisions of the bodies participating in provision of the state service systems of sound informing applicants are equipped. Duration of one sound message shall not exceed 5 minutes.
28. In the hall of servicing the computer with legal-reference systems and software products shall be established. Rules of work with it, and also surname, name, middle name, phone, number of office of the employee who is responsible for operation of the computer are placed at the information stand.
29. The room for work with applicants is equipped with electronic management system queue, indicating information display. The indicating information display shall be placed near entrance to the hall of servicing where acceptance of applicants is performed, at height meter 2,2 from floor suffices so that to provide possible visibility of information to the maximum number of citizens. Information on indicating information display is provided in the form of running line.
30. For the purpose of informing citizens on surname, name, middle name and position of employees who service them employees are provided with personal identification cards and (or) desktop plates.
31. In premises of divisions for expectation of acceptance places (room) having chairs are equipped, tables (are resistant) for possibility of document creation, and also toilet and clothes. The number of places of expectation is determined proceeding from the actual loading and opportunities for their placement in the building.
Rooms are equipped:
air conditioning system;
fire-proof system and fire extinguishing means;
system of protection.
32. For servicing of disabled people of the room are equipped with ramps, special barriers and handrail, free movement and turn of wheelchairs is provided. Tables for servicing of disabled people are placed away from entrance taking into account free entrance and turn of carriages. Deaf-mutes, visually impaired persons and other citizens physically challenged if necessary are given appropriate assistance.
33. Issue of passports is performed in specially equipped rooms having the State Emblem of the Russian Federation, flags of the Russian Federation and the subject of the Russian Federation.
Requirements to set of documents
34. For receipt of the passport the citizen personally or through officials of the multipurpose centers of provision of the state and municipal services with whom agreements on interaction are signed represents:
34.1. The statement for issue (replacement) of the passport in the N 1P form (the appendix N 1 to Administrative regulations) filled by hand or typewritten method with the citizen who addressed for receipt of the passport. The application blank can be received in division, and also at officials of houses nursing homes for disabled people, veterans, lonely and aged, hotels shelters, other organizations of social servicing * (3) and the multipurpose centers.
The application form is also posted on the official Websites of FMS of Russia, territorial authorities and divisions.
The personal signature of the citizen is certified of the statement by the employee of division authorized on it.
In case of filing of application with appendix of necessary documents and personal photos for receipt (replacement) of the passport through officials of organizations of social servicing, and also the multipurpose centers the personal signature of the citizen is certified of the statement by officials of the specified organizations.
If the citizen has no opportunity to independently fill in the application form, it is filled in with the employee of division or officials specified in paragraph four of this subitem.
Rekvizitny structure of the application for issue (replacement) of the passport submitted in electronic form with use of the single portal on content correspond to application blank details about issue (replacement) of the passport in the N 1P form and address leaf of arrival in the N 2 form * (4).

In case of filing of application about issue (replacement) of the passport with use of the single portal the documents specified in Items 34.2 - 34.6, are represented by the applicant personally in case of visit of division for receipt of the passport.
34.2. Certificate of birth. In case of absence at the citizen of the certificate of birth he is recommended to address to the body performing state registration of acts of civil status in the territory of the Russian Federation for place of registration of the birth or at the place of residence for receipt of the repeated certificate of birth.
In case of impossibility of submission of the certificate of birth (the repeated certificate of birth) in case of registration of the birth by competent authorities of foreign state, and also in case of confirmation by the body performing state registration of acts of civil status in the territory of the Russian Federation, impossibility of issue of the certificate of birth (the repeated certificate of birth), the passport can be issued based on other documents confirming the data necessary for its obtaining.

34.4. The documents testimonial of belonging to citizenship of the Russian Federation (in the presence of circumstances, stipulated in Item 51 Regulations on procedure for consideration of questions of the citizenship of the Russian Federation approved by the Presidential decree of the Russian Federation of November 14, 2002 N 1325).
34.5. The documents necessary for putting down of obligatory marks in the passport (the military ID, certificates of birth of children aged up to 14 years, the documents confirming registration at the place of residence, the registration certificate of scrap, the certificate on annulment of marriage).
34.6. The receipt on payment of the state fee for issue and replacement of the passport which sizes and procedure for collection are established by the Tax Code of the Russian Federation.
The form of the receipt can be received in division, and also at officials of organizations of social servicing and the multipurpose centers.
The form of the receipt is also placed on the Single portal and on the official sites of FMS of Russia, territorial authorities and divisions on the information telecommunication Internet.
