Some questions of production, purchase and supply of explosives and ammunition

The Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for production, purchase and supply of explosives and ammunition which is applied.

2. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

3. Determine that:

subjects of managing which acquired the status of the producer and the right to production, delivery of ammunition and military units, on production, purchase and supply of the explosives, means of their initiation, products and devices containing explosives and/or elements for their production, according to Procedure for implementation of the pilot project on production, purchase and delivery of ammunition approved by the resolution of the Cabinet of Ministers of Ukraine of July 21, 2023 No. 763 "About implementation of the pilot project on production, purchase and delivery of ammunition" (The Official Bulletin of Ukraine, 2023, No. 75, of Art. 4239; 2024, No. 18, Art. 1167), continue to perform the activities based on orders of the Ministry of questions of strategic industries on entering of the subject of managing into the electronic register of participants of selection and contractors of public contracts (agreements) as participant of the pilot project on production, purchase and delivery of ammunition;

effective period of certificates on storage (operation of the storage location) of military explosive materials (ammunition and military units) issued according to Procedure for implementation of the pilot project on production, purchase and delivery of ammunition approved by the resolution of the Cabinet of Ministers of Ukraine of July 21, 2023 No. 763, is prolonged for effective period of the Procedure approved by this resolution;

the explosive materials of industrial function, hunting gunpowder and capsules used in case of production of ammunition, explosives and components for them for the benefit of security forces and forces of defense of Ukraine are military explosive materials.

4. This resolution becomes effective from the date of publication and is effective during the period of action of legal regime of warlike situation and within 12 months from the date of its termination or cancellation.

Procedure for production, purchase and supply of explosives and ammunition

General provisions

1. This Procedure determines the mechanism of development, production, purchase and delivery of ammunition, explosives and materials to them for the benefit of security forces and forces of defense of Ukraine regarding establishment of organizational, production and other requirements to implementation of economic activity in the respective sphere and is effective during martial law imposed by the Presidential decree of Ukraine of February 24, 2022 No. 64 "About introduction of warlike situation in Ukraine", the approved Law of Ukraine of February 24, 2022 No. 2102-IX "About approval of the Presidential decree of Ukraine "About introduction of warlike situation in Ukraine" and within 12 months from the date of its termination or cancellation.

Provisions of Items 1-33 and 52-63 of this Procedure do not extend to development, production, testing and delivery of means of initiation (blasting) which do not contain explosives, other elements of ammunition which do not contain explosives.

2. The terms used in this Procedure have the following value:

Ammunition - technical devices of single application (their components and elements) intended for defeat of manpower of the opponent, destruction of its arms, the military and special equipment, destruction of strengthenings, constructions and other objects, fire preparation or implementation of testing, accomplishment of other tasks (lighting of the area, smoke, scattering of propaganda literature, etc.). Rockets (tactical, aviation, antiaircraft managed, anti-tank and others), aviation and depth charges, rockets, artillery, tank, mortar, antiaircraft and grenade shots, manual and reactive garnets, cartridges, pyrotechnic means, torpedoes, sea mines, reactive infantry flame throwers, engineering ammunition, starting (starting) rocket engines on solid fuel, the products and devices containing explosives, means of initiation (blasting), and elements of all specified types of ammunition belong to ammunition;

ammunition to pilotless systems ammunition, specially developed, made, modified (modernized) or adapted for application with pilotless systems;

the military unit of pilotless system (further - military unit) - ammunition which is component of pilotless system and directly performs defeat of the purpose. Depending on appointment the military unit can be of this kind: detrital, demolition, detrital and demolition, cumulative, cumulative and detrital, the thermobaric, volume detonating, incendiary, shock kernel, etc.;

explosive materials - explosives, the means of initiation (blasting) and other products and devices containing explosives;

explosive materials of military appointment - the explosive materials which are not explosive materials of industrial function according to the Law of Ukraine "About the treatment of explosive materials of industrial function" and also the explosive materials of industrial function which are military explosives according to Item 18 of this Procedure;

explosive - the chemical or mix of chemicals capable as a result of external action (initial impulse) to the bystry self-extending exothermic decomposition with allocation of large amount of heat and formation of the gases capable to cause destruction; the initiating and brisant substances, gunpowder, nitrocellulose and solid rocket fuel and pyrotechnic mixes, in particular, belong to explosives;

explosive of military appointment - the explosive which is not explosive of industrial function according to the Law of Ukraine "About the treatment of explosive materials of industrial function" and also the explosive of industrial function which is military explosive according to Item 18 of this Procedure;

the producer - the subject of managing performing production of ammunition or explosives and the data about which according to this Procedure are entered in the electronic register of participants of selection and contractors of public contracts (agreements) (further - the register); the subject of managing can be the producer of ammunition and explosives at the same time;

the producer of ammunition - the subject of managing performing or intending to perform development, production, delivery of ammunition for the purpose of transfer, sales or assignments of rights on them by any other method to security forces and forces of defense of Ukraine;

producer of explosives - the subject of managing performing or intending to perform development, production, supply of explosives for the purpose of their use in production of the ammunition which is subject to transfer, sale or it is right on which are subject to transfer by any other method to security forces and forces of defense of Ukraine;

the declaration on the beginning of production (further - the declaration) - the document which is filed by the subject of managing for entering of information about such subject of managing into the register;

demonstration testing of ammunition - testing of sample of ammunition which are carried out according to the program and technique developed by the producer, for the purpose of check of compliance of such sample to requirements of the tactical specification and/or to the declared tactical technical characteristics;

demonstration testing of explosive - testing of sample of explosive which are carried out by the producer with participation of representatives of the Ministry of Defence for the purpose of confirmation of conformity of such sample to the declared characteristics of safety and efficiency;

the ammunition prototype - sample of ammunition which is developed by the producer and passed the preliminary tests on polygon or other place allocated for implementation of such testing organized according to requirements of this Procedure for the program of such testing;

means of initiation (blasting) - means (detonators, the capsule - detonators, electrodetonators, the detonating cords, safety fuses, electrofire raisers, pyrotechnic decelerators (detonation relays), etc.) by means of which the initial impulse of charge to explosive is transferred owing to what there is its explosion (detonation);

the initiating explosives - substances or mixes of substances which are intended only for initiation of explosive transformations or reactions of burning in charges of other explosives.

3. The right to implementation of activities for production, purchase and supply of explosives and ammunition, and also to purchase and production of explosive materials and/or other components for their production according to this Procedure is provided to subjects of managing which answer one of the following requirements:

within the last 12 months were contractors of public contracts (agreements) on production and supply of explosives, ammunition and/or other components for their production;
