About defense of Ukraine

Section I. Bases of defense of Ukraine and preparation of the state for defense

Article 1. Determination of the main terms

In this Law terms are used in the following value:

defense of Ukraine - system of political, economic, social, military, scientific, scientific and technical, information, legal, organizational, other measures of the state on preparation for the armed protection and its protection in case of the armed aggression or armed conflict;

fighting immunity - release of military command, military personnel, police officers of police of special function of National police of Ukraine, volunteers and Sil of territorial defense of the Armed Forces of Ukraine, law enforcement officers who according to the powers take part in defense of Ukraine, persons determined by the Law of Ukraine "About ensuring participation of civilians in protection of Ukraine" from responsibility, including criminal, for losses of staff, military equipment or other military property, effect of use of the armed and other force during repulse of the armed aggression against Ukraine or liquidation (neutralization) of armed conflict, accomplishment of other tasks on defense of Ukraine using any kinds of weapon (arms) which approach taking into account reasonable discretion could not be expected during the planning and accomplishment of such actions (tasks) or which are covered by justified risk, except cases of violation of the laws and customs of war or use of the armed force defined by international treaties which consent to be bound is provided by the Verkhovna Rada of Ukraine;

the plan of defense of Ukraine - the component of defense planning containing set of documents which determine content, amounts, contractors, procedure and terms of implementation of political, economic, social, military, scientific, scientific and technical, information, legal, organizational, other actions of the state for preparation for the armed protection and its protection in case of the armed aggression or armed conflict;

defense capability of the state - capability of the state to protection in case of the armed aggression or armed conflict. It consists of material and spiritual elements and is set of military, economic, social and moral and political potential in the field of defense and proper conditions for its realization;

the armed aggression - application by other state or group of the states of the armed force against Ukraine. The armed aggression against Ukraine is considered any of the following actions:

invasion or attack of armed forces of other state or group of the states on the territory of Ukraine, and also occupation or annexation of part of the territory of Ukraine;

blockade of ports, coast or airspace, violation of communications of Ukraine by armed forces of other state or group of the states;

attack of armed forces of other state or group of the states on military ground, sea or air forces or civil sea or air fleet of Ukraine;

zasylka other state or from his name of armed groups of regular or irregular forces which make the acts of use of the armed force against Ukraine having so serious nature that it is equivalent to the actions listed in paragraphs the fifth or seventh this Article, including considerable participation of the third state in such actions;

actions of other state (states) allowing that its territory which it made available to the third state was used by this third state (states) for making of the actions specified in paragraphs the fifth or eighth this Article;

application of divisions of armed forces of other state or group of the states staying in the territory of Ukraine according to the international treaties signed with Ukraine against the third state or group of the states, other violation of the conditions provided by such agreements, or prolongation of stay of these divisions in the territory of Ukraine after cancellation of the specified agreements;

the special period - the period coming from the moment of the announcement of the decision on mobilization (except target) or finishing it to contractors of rather hidden mobilization or from the moment of input of warlike situation in Ukraine or in its certain areas and covering mobilization time, wartime and partially recovery period after the end of military operations;

the warlike situation is particular legal regime which is introduced in Ukraine or in its certain areas in case of the armed aggression or threat of attack, danger of the state independence of Ukraine, its territorial integrity and restriction of constitutional rights and freedoms of man and citizen and rights and legitimate interests of legal entities with indication of effective period of these restrictions provides to relevant organs of the government, military command and local government bodies of the powers necessary for prevention of threat and ensuring national security, and also temporary, caused by threat;

military forming - the set of army connections and parts and governing bodies created according to the legislation of Ukraine and are intended by them which are completed with the military personnel for defense of Ukraine, protection of its sovereignty, the state independence and national interests, territorial integrity and immunity in case of the armed aggression, armed conflict or threat of attack by direct conducting military (fighting) operations;
