According to Item 30 of the Protocol on information and communication technologies and information exchange within the Eurasian Economic Union (appendix № 3 to the Agreement on the Eurasian Economic Union of May 29, 2014) and being guided by the Decision of Board of the Eurasian economic commission of November 6, 2014 № 200, the Board of the Eurasian economic commission decided:

Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming, maintaining and use of the general register of owners of customs warehouses";

Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming, maintaining and use of the general register of owners of customs warehouses";

The description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming, maintaining and use of the general register of owners of customs warehouses";

Procedure for accession to general process "Forming, maintaining and use of the general register of owners of customs warehouses".

2. Recognize invalid:

The decision of Board of the Eurasian economic commission of November 1, 2016 No. 135 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general process "Forming, maintaining and use of the general register of owners of customs warehouses";

item 4 of appendix to the Decision of Board of the Eurasian economic commission of March 26, 2019 No. 44.

3. This Decision becomes effective since August 1, 2025.

Rules of information exchange in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming, maintaining and use of the general register of owners of customs warehouses"

I. General provisions

1. These rules are developed according to the following international treaties and acts constituting the right of the Eurasian Economic Union (further - the Union):

The agreement on the Eurasian Economic Union of May 29, 2014;

The agreement on the Customs code of the Eurasian Economic Union of April 11, 2017;

The decision of Board of the Euroasian economic commission of November 6, 2014 No. 200 "About the technological documents regulating information exchange in case of realization by means of the integrated information system of foreign and mutual trade of general processes";

The decision of Board of the Eurasian economic commission of January 27, 2015 No. 5 "About approval of Rules of electronic data exchange in the integrated information system of foreign and mutual trade";

The decision of Board of the Euroasian economic commission of April 14, 2015 № 29 "About the list of general processes within the Eurasian Economic Union and modification of the Decision of Board of the Euroasian economic commission of August 19, 2014 № 132";

The decision of Board of the Euroasian economic commission of June 9, 2015 №63 "About the Analysis technique, optimization, harmonizations and descriptions of general processes within the Eurasian Economic Union";

The decision of Board of the Eurasian economic commission of April 23, 2024 No. 41 "About procedures for forming and maintaining general registers of persons performing activities in the field of customs affairs".

II. Scope

2. These rules "Forming, maintaining and use of the general register of owners of customs warehouses" (further - general process), including the description of the procedures performed within this general process are developed for the purpose of determination of procedure and conditions of information exchange between participants of general process.

3. These rules are applied by participants of general process in case of control of execution order of procedures and transactions within general process, and also during the designing, development and completion of components of the information systems providing realization of general process.

III. Basic concepts

4. For the purposes of these rules concepts which mean the following are used:

"authorization" - provision to certain participant of general process of the rights to accomplishment of certain actions;

"historical data" - information which is stored in the general register of owners of customs warehouses from the moment of its forming and modification in which is not provided;

"the national register" - the register of owners of customs warehouses which forming and maintaining are performed by customs authority of state member of the Union.

The concepts "group of procedures of general process", "information object of general process", "contractor", "transaction of general process", "procedure of general process" and "participant of general process" used in these rules are applied in the values determined by the Analysis technique, optimizations, the harmonization and the description of general processes within the Eurasian Economic Union approved by the Decision of Board of the Eurasian economic commission of June 9, 2015 No. 63.

IV. Main data on general process

5. Full name of general process: "Forming, maintaining and use of the general register of owners of customs warehouses".

1. Purpose and tasks of general process

7. The purpose of general process is forming of the general register of owners of customs warehouses and representation to participants of general process of information about legal entities of the general register of owners of customs warehouses.

8. For goal achievement of general process it is necessary to solve the following problems:

a) provide the Eurasian economic commission (further - the Commission) from authorized bodies of state members of the Union (further - state members) information on inclusion and exception of legal entities of the national register, suspension (renewal) of activities as the owner of customs warehouse, and also about change of information about legal entities in the national register;

b) provide the automated forming of the general register of owners of customs warehouses on the basis of information which arrived in the Commission and its publication on information portal of the Union;

c) provide submission of information about the legal entities included in the general register of owners of customs warehouses through the integrated information system of the Eurasian Economic Union (further - the integrated system) for the purpose of use in information systems of authorized bodies of state members;

d) provide representation at the request of information systems of authorized bodies of state members with use of the services placed on information portal of the Union, the information about the legal entities included in the general register of owners of customs warehouses.

2. Participants of general process

9. The list of participants of general process is provided in table 1.

3. Structure of general process

10. General process represents set of the procedures grouped according to the destination:

a) procedures of forming and maintaining the general register of owners of customs warehouses;

b) procedures of representation to authorized bodies of state members of information about the legal entities containing in the general register of owners of customs warehouses;

c) procedures of representation to interested persons of information about the legal entities containing in the general register of owners of customs warehouses.

11. In case of performing procedures of general process forming of the general register of owners of customs warehouses based on the information about legal entities from the national registers received from authorized bodies of state members and also submission of information about the legal entities included in the general register of owners of customs warehouses, to authorized bodies of state members and interested persons is performed.

When forming the general register of owners of customs warehouses procedures of inclusion and exception of information about legal entities of the general register of owners of customs warehouses, and also changes of information about the legal entities containing in the general register of owners of customs warehouses, the forming included in group of procedures and maintaining the general register of owners of customs warehouses are performed.

In case of representation to authorized bodies of state member of information about legal entities the following procedures of general process included in group of procedures of representation to authorized bodies of state members of information about the legal entities containing in the general register of owners of customs warehouses are performed:

receipt of information on date and time of updating of the general register of owners of customs warehouses;

receipt of information about legal entities from the general register of owners of customs warehouses;

receipt of information on the changes entered in the general register of owners of customs warehouses.

In case of representation to interested persons of information about the legal entities containing in the general register of owners of customs warehouses the "Receipt of Information about Legal Entities from the General Register of Owners of Customs Warehouses through Information Portal of the Union" procedure included in group of procedures of representation to interested persons of information about the legal entities containing in the general register of owners of customs warehouses is performed.

12. The provided structure declaration of general process is provided in the figure 1.

13. The execution order of the procedures of general process grouped according to the destination including the disaggregated activity description, is given in the Section VIII of these rules.

14. For each group of procedures the general scheme showing communications between procedures of general process and procedure for their accomplishment is provided. The general scheme of procedures is constructed with use of the graphical notation of UML (unified modeling language - Unified Modeling Language) and supplied with the text description.

4. Group of procedures of forming and maintaining the general register of owners of customs warehouses

15. Performing procedures of forming and maintaining the general register of owners of customs warehouses begins when obtaining by authorized body of state member of information on change (adding, exception) of the information about the legal entities containing in the national register.

When maintaining the national register in authorized body of state member uniqueness of registration numbers of documents on inclusion of information about legal entities in the national register according to requirements of the legislation of this state is provided.

In case of inclusion of information about legal entities in the national register the "Inclusion of Information about Legal Entities in the General Register of Owners of Customs Warehouses" procedure is performed (P.CC.09.PRC.001).

In case of change of information about the legal entities in the national register declared in case of inclusion of legal entities in the general register of owners of customs warehouses, including in case of suspension (renewal) of activities of the legal entity as the owner of customs warehouse the "Change of Information about the Legal Entities Containing in the General Register of Owners of Customs Warehouses" procedure is performed (P.CC.09.PRC.002).

In case of exception of information about legal entities of the national register the "Exception of Information about Legal Entities of the General Register of Owners of Customs Warehouses" procedure is performed (P.CC.09.PRC.003).

When canceling the decision on exception of the legal entity of the national register the "Cancelling of the Decision on Exception of the Legal Entity of the General Register of Owners of Customs Warehouses" procedure is performed (P.CC.09.PRC.008)

If in the course of modification of the national register the registration number of the document confirming inclusion of information about legal entities in the national register changes, that submission of information about legal entities is performed with use of 2 procedures: "Exception of information about legal entities of the general register of owners of customs warehouses" (P.CC.09.PRC.003) and "Inclusion of information about legal entities in the general register of owners of customs warehouses" (P.CC.09.PRC.001).

Submission of the specified data is performed according to Regulations of information exchange between authorized bodies of state members of the Eurasian Economic Union and the Eurasian economic commission in case of realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming, maintaining and use of the general register of owners of customs warehouses", the approved Decision of Board of the Eurasian economic commission of February 18, 2025 No. 15 (further - Regulations of information exchange). The format and structure of the represented data shall match the Description of formats and structures of the electronic documents and data used for realization by means of the integrated information system of the Eurasian Economic Union of general process "Forming, maintaining and use of the general register of owners of customs warehouses", to No. 15 approved by the Decision of Board of the Eurasian economic commission of February 18, 2025 (further - the Description of formats and structures of electronic documents and data).

16. The provided description of group of procedures of forming and maintaining the general register of owners of customs warehouses is provided in the figure 2.

5. Group of procedures of representation to authorized bodies of state members of information about the legal entities containing in the general register of owners of customs warehouses

18. Procedures of representation to authorized bodies of state members of information about the legal entities containing in the general register of owners of customs warehouses are carried out in case of receipt of the corresponding request from information systems of authorized bodies of state members.

Within performing procedures of representation to authorized bodies of state members of information about the legal entities containing in the general register of owners of customs warehouses the following types of the requests arriving from information systems of authorized bodies of state members are processed:

request for information representation about date and time of updating of the general register of owners of customs warehouses;

request for submission of information about legal entities from the general register of owners of customs warehouses;

request for information representation about the changes entered in the general register of owners of customs warehouses.

The request for information representation about date and time of updating of the general register of owners of customs warehouses is carried out by authorized body of state member for the purpose of assessment of need of synchronization of the information about the legal entities included in the general register of owners of customs warehouses which is stored in information system of authorized body of state member with the information about legal entities which is containing in the general register of owners of customs warehouses, stored in the Commission. When implementing request for information representation about date and time of updating of the general register of owners of customs warehouses the "Receipt of Information on Date and Time of Updating of the General Register of Owners of Customs Warehouses" procedure is performed (P.CC.09.PRC.004).

The request for submission of information about legal entities from the general register of owners of customs warehouses, is carried out for the purpose of obtaining by authorized body of state member of information about all legal entities included in the general register of owners of the customs warehouses which are stored in the Commission. The information about legal entities containing in the general register of owners of customs warehouses is requested or in full, taking into account historical data, or as of certain date and time. The request for submission of information about legal entities from the general register of owners of customs warehouses is used in case of initial loading of information about legal entities in information system of upolnomomchenny body of state member. When implementing request for submission of information about legal entities from the general register of owners of customs warehouses the "Receipt of Information about Legal Entities from the General Register of Owners of Customs Warehouses" procedure is performed (P.CC.09.PRC.005).

In case of information request about the changes entered in the general register of owners of customs warehouses the information about legal entities which was added to the general register of owners of customs warehouses or to which changes since the moment specified in request until accomplishment of this request were made is represented. When implementing request for information representation about the changes entered in the general register of owners of customs warehouses the "Receipt of Information on the Changes Entered in the General Register of Owners of Customs Warehouses" procedure is performed (P.CC.09.PRC.006).

19. The provided description of group of procedures of representation to authorized bodies of state members of information about the legal entities containing in the general register of owners of customs warehouses is provided in the figure 3.

6. Group of procedures of representation to interested persons of information about the legal entities containing in the general register of owners of customs warehouses

21. Procedures of representation to interested persons of information about the legal entities containing in the general register of owners of customs warehouses are carried out by means of use of information portal of the Union.

In case of submission of information about legal entities through information portal of the Union the web interface of this portal or services placed on this portal are used. When using the web interface the user in window of the browser sets search options and (or) unloadings of information about the legal entities containing in the general register of owners of customs warehouses carries out work with information from the general register of owners of customs warehouses provided in browser window.

When using the services placed on information portal of the Union, interaction is performed between information system of the interested person and information portal of the Union.
