About some questions of import of raw sugar reed on the territory of the Republic of Kazakhstan

According to Item 3 of article 16 of the Law of the Republic of Kazakhstan "On regulation of trading activity", the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" and subitem 7.1.83 of Item 7 of the Decision of the Commission of the Customs union of November 27, 2009 "On single customs and tariff regulation of the Eurasian Economic Union" I ORDER to No. 130:

1. Approve the enclosed Rules of confirmation of purpose of goods.

2. Declare invalid the order of the acting minister of agricultural industry of the Republic of Kazakhstan of May 14, 2024 No. 158 "About some questions of import of white sugar and raw sugar reed on the territory of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts at No. 34371).

3. And conversions of agricultural products of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation to provide to department of the agrofood markets:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

4. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. This order becomes effective after day of its official publication and extends to the legal relationship which arose since January 1, 2026 and is effective till December 31, 2026 inclusive.

Rules of confirmation of purpose of goods

Chapter 1. General provisions

1. These rules of confirmation of purpose of goods (further – Rules) are developed according to Item 3 of article 16 of the Law of the Republic of Kazakhstan "On regulation of trading activity" and subitem 7.1.83 of Item 7 of the Decision of the Commission of the Customs union of November 27, 2009 No. 130 "On single customs and tariff regulation of the Eurasian Economic Union" (further – the Decision) and determine procedure for confirmation of purpose of goods.

2. The authorized body in the field of development of agro-industrial complex (further – authorized body) performs confirmation of purpose of the imported raw sugar reed (code of the Commodity nomenclature of foreign economic activity of the Eurasian Economic Union: subline items 1701 13; 1701 14), intended for industrial conversion in the Republic of Kazakhstan, in the amount of no more than 100 000 (hundred thousand) tons.

Chapter 2. Procedure for confirmation of purpose of goods

3. For receipt of confirmation of purpose of raw sugar reed, intended for industrial conversion in the Republic of Kazakhstan, the applicant submits the application for receipt of confirmation of purpose of goods in form according to appendix 1 to these rules (further – the request).

Are applied to the request:

copies of contracts (agreements) based on which it is planned to perform import of raw sugar reed;

copies of the payment documents confirming payment of the declared goods;

the copy of contracts (contracts) between the organization performing import of raw sugar reed and the organization performing its industrial conversion (it is not provided in case of import of raw sugar reed the organization performing its industrial conversion).

4. The documents constituted in foreign language are provided with transfer on Kazakh or Russian. Fidelity of transfer from one language into another or authenticity of the signature of the translator needs to be certified notarially according to article 80 of the Law of the Republic of Kazakhstan "About notariate".

5. The request signed by the first head of the applicant, or the authorized person based on the relevant document confirming powers, and the documents attached to the request are provided purposely through office of authorized body or in electronic form on the e-mail address of office of authorized body.

The request and documents attached to the request are accepted and registered in office of authorized body in day of their receipt with assignment of registration number and date, and go to the structural division of authorized body which is directly performing consideration of documents (further – structural division).

In case of the address of the applicant after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, order taking are performed in the next working day following it.

6. The structural division within 2 (two) working days from the date of receipt of the request considers and checks the request regarding completeness and compliance to requirements of these rules.

In case of establishment of incompleteness of the provided data and (or) discrepancy of the request to requirements of these rules, the authorized body in time specified in part one of this Item sends to the applicant the notification in which specifies what requirements are not conformed by the submitted request. The notification goes to the e-mail address specified by the applicant in the request.

Term for reduction of the request in compliance to requirements of these rules constitutes 2 (two) working days.

If within 2 (two) working days the applicant did not bring the request into accord with requirements of these rules, the authorized body directs to the e-mail address of the applicant specified in the request, motivated refusal in any form with indication of specific causes of failure to the applicant.

7. In case of positive consideration of the request the structural division within 3 (three) working days prepares the project of confirmation of purpose of goods in form according to appendix 2 to these rules signed by the head of the authorized body or person fulfilling its duties.

Confirmation of purpose of goods goes to the applicant by mail the registered mail with the assurance of receipt or it is represented purposely through office of authorized body.

8. Use of raw sugar of the reed, placed under customs procedure release for internal consumption using the tariff privilege according to subitem 7.1.83 of Item 7 of the Decision, is allowed only according to its purpose. The white sugar received as a result of industrial conversion of raw sugar imported using the tariff privilege reed provided by subitem 7.1.83 of Item 7 of the Decision can be used and implemented only in the territory of the Republic of Kazakhstan and is not subject to export in other state members of the Eurasian Economic Union.

Restrictions on use and (or) the order with raw sugar reed, placed under customs procedure of release for internal consumption using the tariff privilege provided by subitem 7.1.83 of Item 7 of the Decision are effective until its revenues to warehouse of the organization performing industrial conversion of raw sugar reed, but no more than 1 year from the date of release of such goods according to customs procedure of release for internal consumption. The document confirming goods receipt on warehouse of the organization is the copy of the acceptance report or the delivery-acceptance certificate of such goods.

9. The organization performing import of raw sugar reed and the organization performing industrial conversion of raw sugar reed annually till December 31 of accounting year provide in authorized body the report on target use of raw sugar reed in form according to appendix 3 to these rules.

10. In case of disagreement with result of consideration of the request, the applicant appeals the decision of authorized body according to Item 91 of the Administrative procedural Procedure Code of the Republic of Kazakhstan.
