According to the subitem 4) article 15-1 of the Law of the Republic of Kazakhstan of April 17, 2014 "About traffic" and subitem 157-1) of Item 15 of the Regulations on the Industry ministry and the construction of the Republic of Kazakhstan approved by the Order of the Government of the Republic of Kazakhstan of October 4, 2023 No. 864 "Some questions of the Industry ministry and construction of the Republic of Kazakhstan", PRIKAZYVAYU:

1. Approve:

1) Rules and conditions of issue of the conclusion about provision to the organizations of powers or about refusal in provision of powers on execution of passports of vehicles (passports of the landing gear of vehicles) and passports of self-propelled machines and other types of the equipment, including to execution of electronic passports of vehicles (passports of the landing gear of vehicles) and electronic passports of self-propelled machines and other types of the equipment according to appendix 1 to this order;

2) Rules of maintaining electronic passports of vehicles (passports of the landing gear of vehicles) and electronic passports of self-propelled machines and other types of the equipment according to appendix 2 to this order.

2. Recognize invalid some orders according to the list according to appendix 3 to this order.

3. To provide to department of industrial policy of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules and conditions of issue of the conclusion about provision to the organizations of powers or about refusal in provision of powers on execution of passports of vehicles (passports of the landing gear of vehicles) and passports of self-propelled machines and other types of the equipment, including to execution of electronic passports of vehicles (passports of the landing gear of vehicles) and electronic passports of self-propelled machines and other types of the equipment (further – Rules) are developed according to the subitem 4) of article 15-1 of the Law of the Republic of Kazakhstan "About traffic" and determine procedure and conditions of issue of the conclusion about provision to the organizations of powers or about refusal in provision of powers by execution of passports of vehicles (passports of the landing gear of vehicles) and passports of self-propelled machines and other types of the equipment, including to execution of electronic passports of vehicles (passports of the landing gear of vehicles) and electronic passports of self-propelled machines and other types of the equipment (further – electronic passports).

2. Data on authorized bodies (organizations) and the organizations manufacturers of vehicles (the landing gear of vehicles), self-propelled machines and other types of the equipment join in national part of the unified register of authorized bodies (organizations) and organizations manufacturers of vehicles (landing gear of vehicles), the self-propelled machines and other types of the equipment performing execution of passports of vehicles (passports of the landing gear of vehicles) and passports of self-propelled machines and other types of the equipment including execution of electronic passports of vehicles (passports of the landing gear of vehicles) and electronic passports of self-propelled machines and other types of the equipment (further respectively – national part of the Unified register, The unified register) according to the procedure according to the Decision of Board of the Eurasian economic commission of September 1, 2015 No. 112 "About approval of the Procedure for forming and maintaining the unified register of authorized bodies (organizations) state members of the Eurasian Economic Union and the organizations manufacturers of vehicles (the landing gear of vehicles), the self-propelled machines and other types of the equipment performing execution of passports (electronic passports) of vehicles (the landing gear of vehicles), self-propelled machines and other types of the equipment" (further – the Procedure for forming and maintaining the Unified register).

3. The organization manufacturer – manufacturer of vehicles (the landing gear of vehicles (further – the landing gear)) and (or) self-propelled machines and other types of the equipment (further – machines), being the legal entity of the Republic of Kazakhstan and acting on its own behalf (further – the Kazakhstan manufacturer).

Treat authorized bodies (organizations):

the legal entity whose official status is determined by state registration in judicial authorities and passing of accounting registration, authorized according to these rules on execution of electronic passports of vehicles (electronic passports of the landing gear) and electronic passports of machines (further – authorized organizations);

the official representative of the foreign manufacturer of vehicles (chassis) and (or) machines registered in foreign state, except for state members of the Eurasian Economic Union (further respectively – the foreign manufacturer, the Union), authorized on release into the stream of commerce and realization in the territory of the Republic of Kazakhstan of products made by the foreign manufacturer and specified in approval like the vehicle and (or) approval like the landing gear (further – the official representative of foreign manufacturer).

Systems of electronic passports of vehicles (passports of the landing gear of vehicles) and electronic passports of self-propelled machines and other types of the equipment (further – systems of electronic passports) – the structured complexes which are turning on the computing and communication equipment, the software, linguistic means, information resources, system personnel and interacting by the rules of participants and users established in this system, and also realizing information technology of accomplishment of the established functions of this system.

The national operator (the national administrator) of system of electronic passports of vehicles (passports of the landing gear of vehicles) and electronic passports of self-propelled machines and other types of the equipment (further – the national operator) – the legal entity performing the organization of work with the administrator of systems of electronic passports with safety control and interactions with participants of system of electronic passports.

The national operator is determined according to the legislation of the Republic of Kazakhstan to whom function of coordination of actions for designing of national system of electronic passports, including commissioning, operation, performance optimization, providing and access control, safety control, tracking of questions of technical supply of this system, interaction with participants of system of electronic passports, inclusion in this system of new participants, and also initiation of the measures necessary for change of the legislation of the Republic of Kazakhstan in the field of functions of these systems is assigned.

For the purposes of application of these rules the Kazakhstan manufacturers, official representatives of foreign manufacturers, authorized organizations and the national operator treat the organizations.

According to the Decision of Board of the Eurasian economic commission of September 22, 2015 No. 122 is allowed registration by the organizations only of electronic passports of vehicles, electronic passports of the landing gear of vehicles, electronic passports of self-propelled machines and other types of the equipment.

Chapter 2. Procedure for issue of the conclusion about provision to the organizations of powers or about refusal in provision of powers on execution of passports of vehicles (passports of the landing gear of vehicles) and passports of self-propelled machines and other types of the equipment, including to execution of electronic passports of vehicles (passports of the landing gear of vehicles) and electronic passports of self-propelled machines and other types of the equipment

4. Powers on execution of electronic passports of vehicles and (or) electronic passports of the landing gear and (or) electronic passports of machines of the vehicles and (or) the chassis and (or) machines made by it respectively are conferred to the Kazakhstan manufacturer included in the Unified register.

Powers on execution of electronic passports of vehicles and (or) electronic passports of the landing gear and (or) electronic passports of machines of the vehicles and (or) the chassis and (or) machines made by such foreign manufacturer respectively are conferred to the official representative of foreign manufacturer included in the Unified register.

The national operator provides automatic execution of electronic passports of vehicles, without document confirming compliance to requirements of the Technical regulation of the Customs union "About safety of wheel vehicles" (TR CU 018/2011) accepted by the Decision of the Commission of custom union of December 9, 2011 No. 877 (further – TR CU 018/2011), on the vehicles registered before start date of application of electronic passports by the body performing registration of vehicles in the territory of the Republic of Kazakhstan by means of information exchange of system of electronic passports and information system of the body performing registration of vehicles in the territory of the Republic of Kazakhstan.

Modification of electronic passports is performed by the national operator in the cases provided by the Rules of maintaining electronic passports of vehicles (passports of the landing gear of vehicles) and electronic passports of self-propelled machines and other types of the equipment approved according to subitem 157-1) of Item 15 of the Regulations on the Industry ministry and the construction of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 4, 2023 No. 864 "Some questions of the Industry ministry and construction of the Republic of Kazakhstan" (further – Rules of maintaining electronic passports).

5. According to these rules the following powers according to accreditation as certification body and (or) test laboratory (center) are conferred to the authorized organizations included in the Unified register:

1) on execution of electronic passports of vehicles and (or) electronic passports of the landing gear and (or) electronic passports of machines on the made Kazakhstan manufacturer vehicles and (or) the chassis and (or) machines respectively who is not included in the Unified register;

2) on execution of electronic passports of vehicles of the vehicles imported on the territory of the Republic of Kazakhstan from other state members of the Union, released without execution of electronic passports in the Russian Federation till November 2, 2020 and in the Republic of Armenia, the Republic of Belarus and the Kyrgyz Republic till March 31, 2021 according to Item 22 of the Procedure for functioning of systems of electronic passports of vehicles (electronic passports of the chassis of vehicles) and electronic passports of self-propelled machines and other types of the equipment approved by the Decision of Board of the Eurasian economic commission of September 22, 2015 No. 122 (further – the Procedure) and Rules of maintaining electronic passports;

3) on execution of electronic passports of vehicles of the vehicles for private use imported by physical persons on the territory of the Republic of Kazakhstan from the state which is not state member of the Union based on the safety construction certificate of the vehicle which is drawn up in the Republic of Kazakhstan according to requirements of TR CU 018/2011;

4) on execution of electronic passports of vehicles of the vehicles which were earlier participating in traffic in the states which are not state member of the Union provided that from the moment of production of the vehicle there passed more than three years, and imported by legal entities and individual entrepreneurs on the territory of the Republic of Kazakhstan from the state which is not state member of the Union based on the safety construction certificate of the vehicle which is drawn up in the Republic of Kazakhstan according to requirements of TR CU 018/2011;

5) on execution of electronic passports of vehicles of the vehicles for private use imported on the territory of the Republic of Kazakhstan from the state which is not state member of the Union without document confirming compliance to requirements of TR CU 018/2011, of vehicles of categories L and M1 (according to appendix No. 1 to TR CU 018/2011) from which delivery date there passed 30 years and more, and also categories M 2, M3 and N (according to appendix No. 1 to TR CU 018/2011), not intended for commercial transportations of passengers and loads from which delivery date there passed 50 years and more, with the original engine, body and frame (in the presence) kept or restored to original condition;

6) on execution of electronic passports of vehicles according to the subitem in) Procedure Item 20 without document confirming compliance to requirements of TR CU 018/2011, of the vehicles imported on the territory of the Republic of Kazakhstan and belonging:

to the physical persons who are participants of national state programs on rendering assistance to voluntary resettlement of persons living abroad, or recognized as refugees according to article 11 of the Law of the Republic of Kazakhstan "About refugees" and also members of their families;

to the diplomatic representations and consular establishments, the international (interstate) organizations using privileges and immunities according to the conventional principles and rules of international law, to the staff of these representations (organizations, the organizations), and also members of their families;

7) on execution of electronic passports of machines of the machines imported on the territory of the Republic of Kazakhstan from other state members of the Union, released without execution of electronic passports in the Republic of Belarus and the Russian Federation till June 30, 2023, the Republic of Armenia and the Kyrgyz Republic till August 31, 2023;

8) on execution of electronic passports of machines of the machines which are earlier registered by the body performing registration of machines in the territory of the Republic of Kazakhstan;

9) on execution of electronic passports of machines of the machines imported on the territory of the Republic of Kazakhstan from the state which is not state member of the Union from among the machines which were earlier in operation;

10) on execution of electronic passports of vehicles or machines on vehicles (chassis) or machines turned into property of the state;

11) on execution of electronic passports of machines of the machines imported (imported) by physical person on the territory of the Union from the state which is not state member of the Union for private use;

12) on execution of electronic passports of machines of the machines imported (imported) on the territory of the Republic of Kazakhstan from the state which is not state member of the Union, and belonging to the diplomatic representations and consular establishments, the international (interstate) organizations using privileges and immunities according to the conventional principles and rules of international law, the staff of these representations (organizations, the organizations), and also members of their families.

6. For receipt of powers, stipulated in Item 5 these rules, and inclusion in national part of the Unified register authorized organizations send to Committee of the industry of the Industry ministry and construction of the Republic of Kazakhstan (further – Committee) the transmittal letter (in a free form) with appendix of the following documents (on the electronic medium in the PDF format):

1) the statement for provision of powers on execution of electronic passports of vehicles (electronic passports of the landing gear) and (or) electronic passports of machines (further – the statement) in form according to appendix 1 to these rules;

2) the reference from the State database "Legal entities" on the registered legal entity, branch or representation received not earlier than 10 (ten) working days before date of filing of application;

3) the reference signed by the head (or his representative by proxy), confirmatory that the authorized organization for date of filing of application is not in process of reorganization, liquidation, bankruptcies, and also there are no restrictions for implementation of economic activity;

4) certified by the head (or his representative by proxy) the reference containing data on full name of authorized organization, the location (the address of the legal entity), the actual address, phone number, the e-mail address, surname, name, middle name (in the presence) of the head;

5) certified by the signature of the head (or his representative by proxy) copies of the certificate of accreditation of authorized organization as certification body and (or) test laboratory (center) and area of accreditation;

6) certified by the head (or his representative by proxy) the reference confirming the obligation of authorized organization in case of execution of electronic passports:
