No. 90-93, 401), with subsequent changes, DECIDES: the Government

1. Reorganize the Apele Moldovei Agency subordinated to the Ministry of the environment, by transformation to public organization "National Administration of "Apele Moldovei"".

2. To the ministry of the environment to perform function of the founder of public organization "National Administration of "Apele Moldovei"" on behalf of the state.

3. Reorganize public organization "National Administration of "Apele Moldovei"" (the attaching legal entity) by merging (accession) with the State company "Basin Management on Water Economy", the State company "Sistemul de Gospodarire an Apelor "Nistru-Centru"" and the State company "Directia Nodul Hidrotehnic Costesti-Stanca" (the attached legal entities) whose founder is the Agency of public property.

4. To the founder within six months from the effective date of this resolution to appoint the director of public organization "National Administration of "Apele Moldovei"". The director of the Apele Moldovei Agency will temporarily perform this function and to take all stipulated by the legislation measures for reorganization process implementation.

5. Approve:

5.1. Regulations on public organization "National Administration of "Apele Moldovei"", according to appendix No. 1;

5.2. Organizational structure of public organization "National Administration of "Apele Moldovei"", according to appendix No. 2;

5.3. To Organigramm of public organization "National Administration of "Apele Moldovei"", according to appendix No. 3.

6. Establish the extreme number of staff of public organization "National Administration of "Apele Moldovei"" in the amount of 84 established posts.

7. Make transfer of 21 units of personnel of the Apele Moldovei Agency in the Agency of the environment. In case of impossibility of the translation of government employees of the Apele Moldovei Agency to perform release of personnel in connection with reorganization of the Apele Moldovei Agency according to the labor law.

8. To make transfer of regular personnel of the attached state companies in the attaching public organization according to provisions of the labor law, providing its integration into the relevant organization. In case of impossibility of the translation of certain workers to perform their release according to the labor law. To cover expenses on release of personnel of the attached legal entities for the account and within their financial resources.

9. In appendix No. 4 to the Order of the Government No. 902/2017 about the organization and functioning of the Agency of public property (Official monitor of the Republic of Moldova, 2017, Art. No. 390-395, 1011), with subsequent changes, to exclude the following line items:

9.1. GP "Basin Management on Water Economy";

9.2. GP "Directia Nodul Hidrotehnic Costesti-Stfnca";

9.3. GP "Sistemul de Gospodarire an Apelor "Nistru-Centru"".

10. Item 3 of the Order of the Government No. 549/2018 on organization, organization and functioning of the Agency of the environment (2018, 603), with subsequent changes, to state the official monitor of the Republic of Moldova to Art. No. 210-223, in the following edition:

"3. Establish the extreme number of staff of the Agency of the environment in number of 145 units, with the annual salary fund according to the existing regulatory base.".

To the agency of public property within three months from the effective date of this resolution to create the commission on transfer and to provide transfer of lands of water fund, hydraulic engineering constructions and other property (immovable / integral parts of real / personal estate) to management of the Ministry of the environment (maintaining public organization "National Administration of "Apele Moldovei"") according to the Regulations on procedure for transfer of objects of public property approved by the Order of the Government No. 901/2015.

12. To the ministry of the environment within six months from the effective date this resolution:

12.1. develop specialized regulations for accomplishment of this resolution;

12.2. make changes to the regulations according to this resolution;

12.3. develop and provide to the Government for approval method of calculation of rates, the nomenclature of services and the size of rates for the services provided by public organization "National Administration of "Apele Moldovei"".

13. Declare invalid the Order of the Government No. 882/2014 about approval of the Regulations on the organization and functioning of the Apele Moldovei Agency, structure and its extreme number of staff (The official monitor of the Republic of Moldova, 2014, Art. No. 325-332, 950), with subsequent changes.

14. This resolution becomes effective on January 1, 2025.
