About the organization and functioning of the Agency of public property

No. 90-93, 401), with subsequent changes and amendments, and article 17 of the Law on the central branch public management No. 98 of May 4, 2012 (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537), with subsequent changes and amendments, DECIDES: the Government

1. Approve:

1) Regulations on the organization and functioning of the Agency of public property according to appendix No. 1;

2) Structure of the Agency of public property according to appendix No. 2;

3) to Organigramm Agentstva of public property according to appendix No. 3;

4) the List of the state companies founded by the Agency of public property according to appendix No. 4;

4-1) The list of commercial societies from shares of the state in the authorized capital in which the Agency of public property performs function of the shareholder (share in the authorized capital), according to appendix No. 4-1;

5) Changes which are made to some orders of the Government, according to appendix No. 5;

6) the List of the orders of the Government which are recognized invalid, according to appendix No. 6.

2. Establish the extreme number of staff of the Agency of public property in number of 99 units with the annual salary fund according to the existing regulatory base.

3. In the Agency of public property one CEO and three deputy directors general act.

4. To transfer to the ministries, other central administrative authorities subordinated to the Government, and also administrative authorities subordinated to them within six months from the date of entry into force of this resolution the state companies in which they perform functions of the founder, to the Agency of public property according to the Regulations on procedure for transfer of objects of public property approved by the Order of the Government No. 901 of December 31, 2015.

5. To the agency of public property within one month from the date of entry into force of this resolution to dissolve contracts of assignment (transfers) of implementation of shareholder rights and management of public property in commercial societies concluded with the ministries and other central administrative authorities.

6. To the Ministry of Economy and Infrastructure and the Ministry of Finance together with the Agency of public property:

1) to develop and provide to the Government for approval Regulations on determination of criteria of establishment of the amount of monthly payment of work of members of administrative board of the state companies, the representative of the state, members of council and audit committee of commercial societies with completely or mainly the public capital;

2) ceased to be valid.

Regulations on the organization and functioning of the Agency of public property

I. General provisions

1. The regulations on the organization and functioning of the Agency of public property (further – the Provision) regulate mission, spheres of activity, functions and the rights of the Agency of public property (further – the Agency), and also the organization of its activities.

2. The agency is the central administrative authority subordinated to the Government which provides realization of policy of the state in the spheres of activity entrusted to it.

3. The agency is legal entity of the public law with the location in municipium of Chisinau, has seal with the image of the State Emblem of the Republic of Moldova, treasurer accounts, and also other specific attributes of bodies of public management established by the legislation.
