About introduction of amendments to the order of the Minister of health and social development of the Republic of Kazakhstan of April 28, 2015 No. 279 "About approval of standards of the state services in the social and labor sphere"

According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:

1. Bring in the order of the Minister of health and social development of the Republic of Kazakhstan of April 28, 2015 No. 279 "About approval of standards of the state services in the social and labor sphere" (registered in the Register of state registration of regulatory legal acts for No. 11342, published in information system of law of Ad_let on July 10, 2015) the following changes:

Item 1 to state 1) in the following edition:

"1. Approve standards of the state services:

1) "Purpose of retirement benefits on age" according to appendix 1 to this order;

2) "Purpose of lump sum payment to burial" according to appendix 2 to this order;

3) "Establishment of disability and/or extent of disability and/or determination of necessary measures of social protection" according to appendix 3 to this order;

4) "Issue of information on receipt and movement of means of the investor of the single accumulation pension fund" according to appendix 4 to this order;

5) "Purpose of the state base retirement benefit" according to appendix 5 to this order;

6) "Purpose of the public social benefits on disability, on the occasion of loss of the supporter and on age" according to appendix 6 to this order;

7) "Purpose of the public special welfare payments" according to appendix 7 to this order;

8) "Purpose of social payment to cases of social risks: disabilities; losses of the supporter; work losses; losses of the income in connection with pregnancy and childbirth; losses of the income in connection with adoption (adoption) of newborn child(children); losses of the income in connection with child care of age of one year on reaching it" according to appendix 8 to this order;

9) "Purpose of benefits for the birth of the child and on child care" according to appendix 9 to this order;

10) "Purpose of special public welfare payment" according to appendix 10 to this order;

12) "Registration and registration of jobless citizens" according to appendix 12 to this order;

13) "Registration of the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site, payment of immediate state monetary compensation, certification" according to appendix 13 to this order;

14) "Issue of references to jobless citizens" according to appendix 14 to this order;

15) "Document creation on disabled people for provision of the prosthetic and orthopedic help by it" according to appendix 15 to this order;

16) "Providing disabled people with surdo-typhlo-technical and obligatory hygienic means" according to appendix 16 to this order;

17) "Purpose of public welfare payment for children till eighteen years" according to appendix 17 to this order;

18) "Purpose of the government address public assistance" according to appendix 18 to this order;

19) "Document creation on disabled people for provision of service of the individual assistant by it for the disabled people of the first group having difficulty in movement and the specialist of sign language for hard of hearing persons" according to appendix 19 to this order;

20) "Provision to disabled people of chair carriages" according to appendix 20 to this order;

21) "Providing disabled people with sanatorium treatment" according to appendix 21 to this order;

22) "Document creation on rendering special social services in medico-social organizations (organizations)" according to appendix 22 to this order;

23) "Document creation on rendering special social services in the conditions of home care" according to appendix 23 to this order;

24) "Purpose of the public assistance to separate categories of the needing citizens according to decisions of local representative bodies" according to appendix 24 to this order;

25) "Cost recovery on training at home handicapped children" according to appendix 25 to this order;

26) "Purpose of the public assistance to the specialists of the social sphere living and working in rural settlements on fuel acquisition" according to appendix 26 to this order;

27) "Issue of the reference confirming belonging of the applicant (family) to receivers of the address public assistance" according to appendix 27 to this order;

28) "Issue of the directions to persons on participation in active forms of assistance of employment" according to appendix 28 to this order;

29) "Assignment of the status of the oralman" according to appendix 29 to this order;

30) "Issue and prolongation of permission to the foreign worker to employment and to employers on attraction of foreign labor power for implementation of labor activity in the territory of the corresponding administrative and territorial unit" according to appendix 30 to this order;

31) "Certification to the rehabilitee" according to appendix 31 to this order;

32) "Purpose of the public assistance in type of monthly payments to citizens of the Republic of Kazakhstan after completion of the period of capitalization of payments on indemnification caused to life and health of workers by the legal entities liquidated owing to bankruptcy" according to appendix 32 to this order.";

2. To provide to strategic development department of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy in printing and electronic type on official publication in periodic printing editions and information system of law"? d_lt", and also in the Republican center of legal information for entering into reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the responsible secretary of the Ministry of health and social development of the Republic of Kazakhstan Kurmangaliyeva A. D.

4. This order becomes effective after ten calendar days after day of its first official publication, but not earlier than March 1, 2016.

Standard of the state service "Purpose of Retirement Benefits on Age"

1. General provisions

1. The state service "Purpose of Retirement Benefits on Age" (further – the state service).

2. The standard of the state service is developed by the Ministry of health and social development of the Republic of Kazakhstan (further – the Ministry).

3. The state service appears territorial subdivisions of Committee of work, social protection and migration of the Ministry (further – the service provider).

Reception of an application and issue of result of rendering the state service are performed through:

1) non-commercial joint-stock company "The Government for Citizens state corporation (further – the State corporation);

2) the web portal of "the electronic government" www.egov.kz (further – the portal) in case of receipt of information on purpose of retirement benefit on age.

2. Procedure for rendering the state service

4. Term of rendering the state service:

1) from the moment of registration of document package in the State corporation – 10 (ten) working days.

The term of rendering the state service is prolonged in cases of need of dooformleniye of case papers:

as required for check of reliability of the provided document(s) or reclamation of the additional document(s) – for the term of 30 (thirty) working days, at the same time, if documents are completed, the state service is rendered – 10 (ten) working days from the date of provision of the additional document(s) in the State corporation. The state corporation notifies the applicant on need of submission of additional documents – 5 (five) working days;

2) on the portal – 30 minutes from the moment of receipt of electronic request in information system;

3) the most allowed time of expectation for delivery of document package – 15 minutes;

4) the most allowed time of servicing in the State corporation – 20 minutes.

5. Form of rendering the state service: electronic (partially automated) and (or) paper.

6. Result of rendering the state service: the notification on purpose of retirement benefit on age in the form approved by the order of the Minister of health and social development of the Republic of Kazakhstan of April 14, 2015 No. 223 "About approval of Rules of provision of the state base retirement benefit at the expense of budgetary funds and also appointment and implementation of retirement benefits on age, the public basic social benefits on disability, on the occasion of loss of the supporter and on age, the public special welfare payments" (it is registered in the Register of state registration of regulatory legal acts No. 11110).

Form of provision of result of rendering the state service: electronic and (or) paper.

On the portal information on purpose of retirement benefit on age goes to "personal account" of the uslugopoluchatel in electronic form certified by the digital signature (further – the EDS) the authorized person of the service provider.

7. The state service is rendered to free of charge physical persons (further – uslugopoluchatel).

8. Working schedule:

1) the State corporation – Monday through Saturday inclusive, according to the working schedule from 9:00 to 20:00 o'clock without interruption for lunch, except Sunday and holidays, according to the Labor code of the Republic of Kazakhstan.

Acceptance is performed according to the procedure of "electronic queue", in place of registration of uslugopoluchatel, without the accelerated servicing, booking of electronic queue by means of the portal is possible;

2) the portal – round the clock, except for the technical breaks connected with carrying out repair work.

9. Uslugopoluchatel (or his representative under the notarized power of attorney) in case of the address for rendering the state service provides the statement on form according to appendix 1 to this standard of the state service and the following documents:

in the State corporation:

1) the identity document (the passport of the citizen of the Republic of Kazakhstan, the identity certificate of the citizen of the Republic of Kazakhstan, the certificate of the stateless person, the residence permit of the foreigner, the certificate of the oralman before receipt of nationality of the Republic of Kazakhstan) (it is required for identification of the personality);

2) the document confirming registration on the permanent residence (the address reference or the reference of rural akims, for residents Baikonur - the reference of department of accounting and registration of citizens of housing of the city of Baikonur of the Russian Federation);

3) the document on bank account number in banks of the second level, the organization having the license of authorized body on regulation and supervision of the financial market and the financial organizations on the corresponding types of banking activities, territorial subdivision of Kazpochta joint-stock company or about the control account of cash of organization of criminal executive system;

4) the certificate of the income amounts paid to physical person and performed from the income of compulsory pension contributions in form according to appendix 2 to this standard of the state service or the document on the income of individual entrepreneurs, lawyers, private notaries, private legal executives and professional mediators issued by body of state revenues.

In case of liquidation of the organization (company) the archive reference with indication of data on the income is submitted.

Persons working in the Russian organizations of the Baikonur complex the certificate of the employer of the income paid in currency of the Russian Federation is submitted.

5) the documents confirming working life of the applicant:

service record;

references of archive organizations or from place of employment if records about labor activity are not made in the service record or are available corrections;

education document;

the military ID or the reference of management (department) for defense;

certificates of birth of children (the statement from the birth record, or the certificate of registration of the act of civil status, issued by bodies of civil registration).

Depending on availability the following documents are submitted:

the certificate of rehabilitation issued by bodies of prosecutor's office according to article 10 of the Law of the Republic of Kazakhstan of April 14, 1993 "About recovery of victims of mass political repressions";

certificate of military commissariat of participation in fighting;

the judgment confirming the fact of implementation and the period of care of the disabled person of the first group, the lonely disabled person of the second group and the retirement pensioner needing assistance, aged, reached eighty-year age, the disabled person aged up to sixteen years;

the document confirming accommodation abroad of the spouse (spouse) employee of the former Soviet organizations, organizations of the Republic of Kazakhstan, the international organization;

the document confirming accommodation of the spouse (spouse) of the serviceman, employee of special state body in areas where there was no employment opportunity;

6) the marriage certficate (the certificate of civil registration) either the certificate on annulment of marriage or the statement from assembly record about marriage (in case of change of surname of the parent/guardian).

In case of purpose of retirement benefits on age to the women who gave rise (adopted, adopted) 5 and more children and brought up them to eight-year age, are in addition represented: certificates of birth of children (either the birth record, or the certificate of registration of the act of civil status issued by bodies of civil registration) and the documents confirming the fact of education of children up to eight years.

To the documents confirming the fact of education of children up to eight years (depending on their availability), belong:

1) identity documents of children;

2) the marriage certficate (the certificate of civil registration) either the certificate on annulment of marriage or the statement from assembly record about marriage (in case of change of surname) children;

3) the document on training in educational institution of children;

4) the document confirming place of registration in the permanent place to residence of children;

5) the death certificate of children (the statement from assembly record about death, or the certificate of registration of the act of civil status issued by body of civil registration);

6) military ID;

7) the judgment about factual determination of education, adoption (adoption) of child(children).

In case of purpose of retirement benefits on age to person living in zones of extreme and maximum radiation risk the document confirming the accommodation fact in zones of extreme and maximum radiation risk from August 29, 1949 to July 5, 1963 within 5 years is in addition submitted.

In case of establishment of guardianship (guardianship), the document confirming establishment of guardianship (guardianship) is submitted.

In case of provision the uslugopoluchatel of incomplete document package according to the list, stipulated in Item 9 these standards of the state service, the employee of the State corporation issues the receipt on refusal in reception of an application on appointment in form according to appendix 3 to this standard of the state service.

In case of receipt of the data from information system confirming the fact of purpose of the corresponding payment or filing of application to award of pension and benefits, the employee of the State corporation instantly hands to the applicant the receipt on refusal in reception of an application in form according to appendix 4 to this standard of the state service.

3. Procedure for appeal of decisions, actions (failure to act) of the central state bodies, and also service providers and (or) his officials, the State corporation and (or) its workers concerning rendering the state services

11. Appeal of decisions, actions (bezdeystviye) of the service provider and (or) his officials, and (or) its workers concerning rendering the state services the claim is submitted to the State corporation addressed to the head of the service provider or addressed to the head of the Ministry, the State corporation to the address specified in Item 14 of this standard of the state service.

The claim is submitted in writing by mail or purposely through office of the service provider, the State corporation or the Ministry.

Confirmation of adoption of the claim is its registration (stamp, the entering number and date) in office of the service provider or the Ministry, with indication of surname and initials of person which accepted the claim, term and the place of receipt of the answer to the made complaint.

In case of incorrect servicing by the worker, the claim is submitted addressed to the head of the State corporation. 12. In disagreement cases with results of the rendered state service the uslugopoluchatel takes a legal action in the procedure established by the legislation of the Republic of Kazakhstan.

4. Other requirements taking into account features of rendering the state service including rendered electronically and through the State corporations

Uslugopoluchatelyam, having complete or partial loss of capability or opportunity to perform self-service in the procedure established by the legislation, independently to move, be guided, documents acceptance is made by the employee of the State corporation with departure at the place of residence by means of the address through Single contact center for rendering the state service 1414, 8 800 080 7777.

14. Addresses of places of rendering the state service are placed on Internet resources:

1) the Ministries – www.mzsr.gov.kz, the Section "State Services";

2) the State corporation – www.con.gov.kz.

15. Uslugopoluchatel has possibility of receipt of information on purpose of retirement benefits on age electronically through the portal on condition of EDS availability.

16. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of "personal account" of the portal, service desks of the service provider, and also Single contact center concerning rendering the state services "1414".
