According to the subitem 1) article 10 of the Law of the Republic of Kazakhstan "About the state services" PRIKAZYVAYU:

1. Approve:

1) Rules of rendering the state service "Registration of the Citizens Who Were Injured owing to Nuclear Testing on the Semipalatinsk Test Nuclear Test Site, Payment of Immediate State Monetary Compensation, Certification" according to appendix 1 to this order;

2) Rules of rendering the state service "Purpose of the Public Assistance to Separate Categories of the Needing Citizens according to Decisions of Local Representative Bodies" according to appendix 2 to this order;

3) Rules of rendering the state service "Cost Recovery on Training at Home Children with Disability" according to appendix 3 to this order;

4) No. 473 Is excluded according to the Order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of 24.11.2022

5) Rules of rendering the state service "Purpose of the Public Assistance in Type of Monthly Payments to Citizens of the Republic of Kazakhstan after Completion of the Period of Capitalization of Payments on Indemnification Caused to Life and Health of Workers by the Legal Entities Liquidated owing to Bankruptcy" according to appendix 5 to this order;

6) Rules of rendering the state service "Payment of Difference between the Amount of Actually Brought Compulsory Pension Contributions, Compulsory Professional Pension Contributions taking into account the Rate of Inflation and the Amount of Pension Accruals" according to appendix 6 to this order;

7) Rules of rendering the state service "Implementation of Retirement Benefits from the Pension Accruals Created at the expense of Compulsory Pension Contributions, Compulsory Professional Pension Contributions from the Single Accumulation Pension Fund" according to appendix 7 to this order;

8) Rules of rendering the state service "Issue of Information on Receipt and Movement of Means of the Investor of the Single Accumulation Pension Fund" according to appendix 8 to this order;

9) Rules of rendering the state service "Issue of the Directions on Participation in Active Measures of Assistance of Employment" according to appendix 8-1 to this order;

10) Rules of rendering the state service "Return of Mistakenly Listed Compulsory Pension Contributions and (or) Penalty Fee" according to appendix 8-2 to this order.

2. Recognize invalid some orders of the Minister of health and social development of the Republic of Kazakhstan, the acting minister of health care and social development of the Republic of Kazakhstan and the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan according to appendix 9 to this order.

3. To provide to department of the analysis and development of the state services of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the Republic of Kazakhstan after its official publication;

2-1) In case of modification and (or) amendments in this order the direction to the operator of information and communication infrastructure of "the electronic government", in Single contact center information on such changes and (or) amendments within ten working days after state registration in the Ministry of Justice of the Republic of Kazakhstan of the corresponding regulatory legal act;

3) within ten working days after state registration of this order submission to Department of legal service of the Ministry of Labour and Social Protection of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan Ospanov E. D.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of rendering the state service "Registration of the Citizens Who Were Injured owing to Nuclear Testing on the Semipalatinsk Test Nuclear Test Site, Payment of Immediate State Monetary Compensation, Certification"

Chapter 1. General provisions

1. These rules of rendering the state service "Registration of the Citizens Who Were Injured owing to Nuclear Testing on the Semipalatinsk Test Nuclear Test Site, Payment of Immediate State Monetary Compensation, Certification" (further – Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" and determine procedure for rendering the state service "Registration of the Citizens Who Were Injured owing to Nuclear Testing on the Semipalatinsk Test Nuclear Test Site, Payment of Immediate State Monetary Compensation, Certification" (further – the state service).

2. The state service appears local executive bodies of the cities of republican value, the capital, areas, cities of regional value (further – the service provider) to physical persons (further – uslugopoluchatel) according to these rules.

Reception of an application and issue of result of rendering the state service are performed through:

1) service provider;

2) non-commercial joint-stock company "The Government for Citizens state corporation (further – the State corporation);

3) the web portal of "the electronic government" (further – the portal).

Chapter 2. Procedure for rendering the state service

3. For receipt of the state service the uslugopoluchatel (or his representative on notarially certified by the notary or the official making notarial actions, powers of attorney) addresses to the service provider or to the State corporation, or on the portal by filing of application in form according to appendix(appendices) 1 and (or) 2 to these rules with application of documents, the main requirements to rendering the state service "Registration of the Citizens Who Were Injured owing to Nuclear Testing on the Semipalatinsk Test Nuclear Test Site, Payment of Immediate State Monetary Compensation, Certification" specified in the list (further – the list) according to appendix 3 to these rules.

In case of the address of the applicant by means of the portal the request in information systems of state bodies and (or) organizations for confirmation of the provided data and receipt of the necessary data provided in forms of statements according to appendices 1 and 2 to these rules is performed by the applicant.

4. The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service is provided in the list according to appendix 3 to these rules.

5. When giving complete document package, provided by the list, to uslugopoluchatel it is issued:

the service provider has coupon with indication of registration date and obtaining by uslugopoluchatel of the state service, surname and initials of the responsible person who accepted documents;

in the State corporation – the receipt on acceptance of the relevant documents;

through the portal – in "private office" of uslugopoluchatel the status about acceptance of request for rendering the state service is displayed.

6. The result of rendering the state service is issued according to the list according to appendix 3 to these rules.

7. By provision uslugopoluchately the incomplete document package provided by the list according to appendix 3 to these rules and (or) documents with the expired effective period, the employee of the State corporation issues the receipt on refusal in documents acceptance in form according to appendix 4 to these rules.

8. The created prototypes of cases of citizens go to the special commissions created by decisions of akims of the cities of republican value, the capital, areas, cities of regional value for registration and accounting of the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site and issue of certificates to them (further – the special commissions).

9. The special commissions within five working days from the date of decision making about registration (refusal in registration) the citizens of the Republic of Kazakhstan who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site (further – the decision) in form according to appendix 5 to these rules constitute the lists certified by the commission chairman which together with prototypes of personal records and Decisions of the special commissions go to district (city) departments of the State corporation.

The special commission according to the list certified by the commission chairman within five working days from the date of decision making issues to the citizen the certificate in form according to appendix 6-1 to Rules of registration of the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site, payments to them of the immediate state monetary compensation and certification confirming the right to privileges and compensations, approved by the order of the Government of the Republic of Kazakhstan of February 20, 2006 No. 110 "About some questions of payment of immediate state monetary compensation to the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site and issues of certificates to them".

10. District (city) departments of the State corporation register the arrived prototypes of cases in the relevant magazine and prepare drafts of decisions on purpose of compensation for the citizens who were injured owing to nuclear testing on the Semipalatinsk test nuclear test site.

For purpose of compensation employees of district (city) departments of the State corporation send prototypes of cases with appendix of drafts of decisions on purpose of compensation to territorial authorities of Committee of work and social protection of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan (further – body to destination to compensation) within five calendar days from the date of their obtaining through branches of areas, cities of republican value and the capital of the State corporation.

11. Bodies to destination of compensation within ten calendar days make decisions on purpose of compensation according to appendix 6 to these rules and transfer them with cases to district (city) departments of the State corporation through branches of areas, cities of republican value, the capital of the State corporation for forming of requirement of funds for compensation payment.

12. The citizens who were earlier not receiving the certificate receive it by filing of application in form according to appendix 2 to these rules in the State corporation, to the service provider or on the portal with application of documents, confirming the fact and the period of accommodation in the corresponding zones of radiation risk.

In case of confirmation of the fact and the period of accommodation of citizens in the corresponding zones of radiation risk the special commission within five working days issues to the citizen the certificate with mark of realization of the right to compensation.

13. Aggregate term of consideration of documents and issue of results of rendering the state service from the date of acceptance and registration of document package by the service provider constitutes twenty working days.

If necessary carrying out additional requests, checks, terms of consideration by the special commissions of prototypes of cases are prolonged by its chairman, but no more than for one month.

On the portal the notification on result of the state service, and also information on result of the state service goes to "private office" of the uslugopoluchatel in electronic form certified by the digital signature of the authorized person of the service provider.

14. In case of identification of the bases for refusal in rendering the state service specified in the list according to appendix 3 to these rules, the service provider in advance, but not later than three working days before decision making, according to Article 73 of the Administrative procedural Procedure Code of the Republic of Kazakhstan (further – APPK RK) notifies uslugopoluchatel on the provisional solution about refusal in rendering the state service, and also about carrying out hearing for opportunity to express line item according to the provisional solution.

According to Item 3 of article 73 APPK RK the uslugopoluchatel has the right to provide or state objection to the provisional solution on administrative case no later than two working days from the date of its obtaining in time.

By results of hearing the service provider makes the decision on rendering the state service or refusal in rendering the state service with indication of the reasons.

15. In case of elimination uslugopoluchately causes of failure in rendering the state service, the uslugopoluchatel addresses repeatedly for receipt of the state service according to the procedure, established by these rules.

16. The service provider provides entering of data on stage of rendering the state service into information system of monitoring of rendering the state services.

17. In case of technical malfunctions in the information systems containing necessary data for rendering the state service, the service provider without delay from the moment of failure, sends inquiry to support service by e-mail e-maket@enbek.kz with obligatory provision of information on the name of the state service, to registration number of the statement for receipt of the state service, to individual identification number (further – IIN), to the description of the sequence of the actions leading to mistake, the screenshots explaining the arisen problem.

18. In case of loss of the certificate its owner addresses to the State corporation, to the service provider or on the portal with the statement for loss and provision of the duplicate in form according to appendix 2 to these rules. The documents confirming the fact and the period of accommodation in the corresponding zones of radiation risk are enclosed to the application. The special commission no later than five working days from the date of filing of application issues to the citizen the duplicate of the certificate in which the stamp "Duplicate" is put.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of the service provider and (or) his officials, the State corporation and (or) its workers concerning rendering the state service

19. Uslugopoluchatel has the right to appeal the decision, action (failure to act) of the service provider, official according to Item 1 of article 91 APPK RK.

The claim is submitted to the service provider, the official whose decision, action (failure to act) is appealed.

The service provider, the official, whose decision, action (failure to act) is appealed, no later than three working days from the date of receipt of the claim send it and administrative case to higher administrative authority (further – the body considering the claim).

At the same time the service provider, the official whose decision, action (failure to act) is appealed, has the right not to send the claim to the body considering the claim if he within three working days makes the decision, will make action, completely meeting requirements specified in the claim.

In case of disagreement with results of the rendered state service the uslugopoluchatel has the right to address with the claim to authorized body by assessment and control of quality of rendering the state services according to Item 2 of article 25 of the Law of the Republic of Kazakhstan "About the state services".

The claim of uslugopoluchatel which arrived to the service provider who is directly rendering the state services is subject to consideration within five working days from the date of its registration.

The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within fifteen working days from the date of its registration.

If other is not provided by the laws of the Republic of Kazakhstan, appeal to the court is allowed after appeal in pre-judicial procedure according to Item 5 of article 91 APPK RK.
