About technical regulation of chemical products

According to the Federal Law "About Technical Regulation" Government of the Russian Federation decides:

1. Approve the enclosed technical regulation about safety of chemical products.

2. Determine that:

the technical regulation approved by this resolution becomes effective after 6 months from the date of official publication of this resolution, but not earlier than September 1, 2027;

requirements to state registration of the chemical products representing chemical, released in the territory of the Russian Federation by one legal entity or physical person registered as the individual entrepreneur, the being manufacturers (authorized by foreign manufacturers persons), importers of chemical products (further - the applicant), in quantity from 1000 tons per year, become effective since September 1, 2028;

requirements to state registration of the chemical products representing chemical, released in the territory of the Russian Federation by one applicant in number from 100 to 1000 tons per year become effective since September 1, 2029;

requirements to state registration of the chemical products representing chemical, released in the territory of the Russian Federation by one applicant in number from 1 to 100 tons per year become effective since September 1, 2030;

requirements to state registration of the chemical products representing chemical, released in the territory of the Russian Federation by one applicant in number of less than one ton per year become effective since September 1, 2031;

requirements to state registration of the chemical products representing mix of chemicals, released in the territory of the Russian Federation by one applicant in number of more than 1000 tons per year become effective since September 1, 2032;

requirements to state registration of the chemical products representing mix of chemicals, released in the territory of the Russian Federation by one applicant in number of 1000 tons per year and less become effective since March 1, 2033;

within 3 years from the date of entry into force of the technical regulation approved by this resolution carrying out researches (testing) in test laboratories (centers) accredited according to the Federal Law "About Accreditation in National Accreditation System" without observance of requirements, stipulated in Item the 105th the technical regulation approved by this resolution is allowed;

the requirements about availability of marking of chemical products established by the Section VIII of the technical regulation approved by this resolution for the chemical products which are subject to state registration become effective from the date of entry into force of requirements to state registration of chemical products, the specified in paragraphs three - the eighth this Item;

requirements about availability of precautionary marking of chemical products, stipulated in Item the 5th the technical regulation approved by this resolution, and the requirements to the material safety data sheet of chemical products established by the Section X of the technical regulation approved by this resolution become effective since September 1, 2028;

requirements to classification of danger of chemical products according to subitems "l" - "N" of Item 22 and subitems "g" - "е" Item 23 of the technical regulation approved by this resolution become effective from the date of inclusion of the relevant documents on standardization in the list of documents on standardization as a result of which application on voluntary basis observance of requirements of the technical regulation approved by this resolution is provided.

3. To the Ministry of Industry and Trade of the Russian Federation in coordination with the interested federal executive bodies till February 1, 2027 to develop and provide to the Government of the Russian Federation the draft of the list of the documents on standardization containing rules and methods of researches (testing) and measurements, including the rules of sampling necessary for application and execution of the technical regulation approved by this resolution and implementation of assessment of conformity.

4. The technical regulation approved by this resolution is effective 6 years from the date of its entry into force.

5. The realization of this resolution is enabled within the number of workers of the federal executive bodies and budgetary appropriations provided to the specified bodies in the federal budget on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

The technical regulation about safety of chemical products

I. General provisions

1. This technical regulation establishes obligatory for application and execution of the requirement to chemical products and ensuring its free movement in case of release into the stream of commerce in the territory of the Russian Federation.

2. This technical regulation is developed taking into account the classification system of danger and marking of chemical products (SGS) Approved at the global level regarding establishment:

a) criteria of classification of danger of chemical products to health of the person and the environment, and also the dangers caused by its physical and chemical properties;

b) the elements of system of informing including requirements to marking of chemical products and the material safety data sheet of chemical products.

3. This technical regulation is accepted for the purpose of protection of life or health of citizens, property of physical persons or legal entities, the state-owned or municipal property, environmental protection, life or health of animals and plants, the prevention of the actions misleading acquirers, including consumers.

II. Scope

4. This technical regulation establishes:

requirements to the chemical products released in the territory of the Russian Federation including requirements to the material safety data sheet of chemical products, and also the requirement for restriction of release into the stream of commerce of the separate chemicals causing concern;

rules and forms of assessment of conformity of chemical products;

rules of identification of chemical products;

requirements to terminology;

requirements to packaging, marking and rules of its drawing;

the list of the chemical products which are object of technical regulation of this technical regulation with indication of codes of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union according to appendix No. 1.

Action of this technical regulation does not extend to chemical products according to appendix No. 2.

If the scope of chemical products includes scopes in addition to the scopes specified in Items 1 - the 10th appendices No. 2 to this technical regulation, such chemical products are object of technical regulation of this technical regulation.

5. Action of this technical regulation extends to the chemical products which are subject to state registration according to the decision of the Commission of the Customs union of May 28, 2010 No. 299 "About application of sanitary measures in the Eurasian Economic Union" only regarding the requirements to precautionary marking of chemical products and the material safety data sheet of chemical products established by Items 37 - 51 present of the technical regulation.

III. Basic concepts

6. For the purposes of application of this technical regulation the following concepts and their determinations are used:

"bio-accumulation" - net result of accumulating, transformation and elimination of substance by means of all ways of receipt to organism (air, water, sediment or the soil and food);

"additive" - the chemical or mix of chemicals which are purposely added in production process of chemical products with the technological purpose;

"the single portal" - the federal state information system "Single Portal of the State and Municipal Services (Functions)";

"the closed information source" - information source which is absent in public access or access to which it is provided only after registration of the user and (or) on paid basis;

"applicant" - the legal entity or physical person registered as the individual entrepreneur, who are the manufacturers (authorized by foreign manufacturers persons), importers of chemical products;

"the selective toxicity" - type of the impact causing violations of functions of separate bodies (target organs) and (or) systems of live organism in case of single and short-term or in case of repeated and long impact;

"manufacturer" - the legal entity or physical person registered as the individual entrepreneur who make chemical products or on specifying of which is performed designing or production of chemical products and which sell chemical products under the name or the trademark and bear responsibility for its compliance to requirements of this technical regulation;

"importer" - the legal entity or physical person registered as the individual entrepreneur who concluded with the foreign manufacturer (seller) the agreement in foreign trade on transfer of chemical products perform release of these products in the address and (or) its realization in the territory of the Russian Federation and bear responsibility for its compliance to requirements of this technical regulation;

"information system" - the state information system of the industry;

"carcinogen" - chemical products which impact causes or accelerate development of malignant new growths (tumors);

"classification of danger of chemical products" - determination of compliance of chemical products to specific type and (or) class (subclass, type) of danger by the criteria representing quantitative and (or) high-quality values of condition of chemical products from the point of view of safety for the person, animals, the environment, and also property based on which assessment of type and level of dangerous impact is created;

"component" - component of chemical products;

"analog method" (English read-across) - forecasting method of properties of the considered chemical (target substance) by use of data on properties of other chemical (substances) (initial substance (substances);

"SARs method (Q)" - mathematical model by means of which biological activity of chemical on the basis of its structure is predicted;

"mutagen" - chemical products which impact leads to increase in number of cases of mutation in population of living cells and (or) live organisms;

"new chemical" - chemical, data on which are not included in the register of chemicals and mixes;

"nomenclature IUPAC" - the nomenclature of International Union of Pure and Applied Chemistry;

"CAS number" - number of the identifier of the chemical entered in the register of Chemical abstract service of American Chemical Society (Chemical Abstracts Service);

"number of the EU" - number of the identifier of the chemical entered in the register of the European community;

"notification" - assessment of danger of new chemical to health of the person and the environment taking into account physical and chemical, toxicological and ecotoxicological properties based on the report on chemical safety with the subsequent entering of such chemical into the register of chemicals and mixes;

"organic peroxides" - chemical products which part organic substances in liquid or strong aggregate state which contain bivalent structure - O-O-are and can be considered as derivative product of hydrogen peroxide in which one or both hydrogen atoms are replaced by organic radicals (organic peroxides and their mixes are thermally unstable that can lead to their self-accelerating exothermic decomposition);
