DECISION OF THE COMMISSION OF CUSTOM UNION

of May 28, 2010 No. 299

About application of sanitary measures in the Eurasian Economic Union

(as amended on 08-09-2020)

The commission of the Eurasian Economic Union solved:

1. Approve:

- The single list of products (goods) which are subject to the state sanitary and epidemiological surveillance (control) on customs border and customs area of the Eurasian Economic Union (further – the Single list, Appendix No. 1);

- Single sanitary and epidemiologic and hygienic requirements to products (goods) which are subject to sanitary and epidemiological surveillance (control) (further – Single health requirements, Appendix No. 2);

- Ceased to be valid according to the Decision of Board of the Eurasian economic commission of 30.06.2017 No. 80

- Procedure for carrying out the state sanitary and epidemiological surveillance (control) on customs border of the Eurasian Economic Union and on customs area of the Eurasian Economic Union (Appendix No. 4).

2. To the governments of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation since July 1, 2010 to apply the Single list and Single health requirements.

2-1. Determine that Single health requirements are applied to products to which action of technical regulations of the Customs union extends, made and released based on the documents on compliance to products to the specified requirements (further - Products) issued or accepted:

- till June 1, 2012 - according to Section 14. "Requirements to individual protection equipment" in connection with entry into force of the technical regulation of the Customs union "About safety of individual protection equipment" (TR CU 019/2011);

- till July 1, 2012:

according to Section 2. "Safety requirements to goods of children's assortment" and according to Section 8. "Safety requirements to the printing books and other products of the printing industry intended for children and teenagers" in connection with entry into force of the technical regulation of the Customs union "About safety of toys" (TR CU 008/2011) and the technical regulation of the Customs union "About safety of products intended for children and teenagers" (TR CU 007/2011);

according to Section 4. "Requirements to perfumery and cosmetic products and means of hygiene of oral cavity" in connection with entry into force of the technical regulation of the Customs union "About safety of perfumery and cosmetic products" (TR CU 009/2011);

according to Section 10. Requirements to the materials for products (products) contacting to skin of the person, clothes, footwear" in connection with entry into force of the technical regulation of the Customs union "About safety of products of light industry" (TR CU 017/2011);

according to Section 16. "Requirements to the materials and products made of the polymeric and other materials intended for contact with foodstuff and environments" in connection with entry into force of the technical regulation of the Customs union "About safety of packaging" (TR CU 005/2011).

- till July 1, 2013:

according to Section 1. "The safety requirement and nutrition value of foodstuff" regarding requirements to marking of the food products which are object of technical regulation of the technical regulation of the Customs union "Food products regarding its marking" (TR CU 022/2011), regarding requirements to products which are object of technical regulation of technical regulations of the Customs union "About safety of grain" (TR CU 015/2011), "The technical regulation on fat-and-oil products" (TR CU 024/2011) and "The technical regulation on juice products from fruit and vegetables" (TR CU 023/2011), in connection with entry into force of the specified technical regulations;);

according to Sections 22. "Safety requirements of nutritional supplements and fragrances" and 23. "Safety requirements of technological supportive applications" regarding requirements to products which are object of technical regulation of the technical regulation of the Customs union "Safety requirement of nutritional supplements, fragrances and technological supportive applications" (TR CU 029/2012), in connection with entry into force of the specified technical regulation;".

- till May 1, 2014 – according to Section 1. "The safety requirement and nutrition value of foodstuff" regarding requirements to products which are object of technical regulation of technical regulations of the Customs union "About safety of milk and dairy products" (TR CU 033/2013) and "About safety of meat and meat products" (TR CU 034/2013), in connection with entry into force of the specified technical regulations;

- till July 1, 2014 – according to Section 6. "Requirements to polymeric and polimersoderzhashchy construction materials and furniture" regarding requirements to products which are object of technical regulation of the technical regulation of the Customs union "About safety of furniture products" (TR CU 025/2012), in connection with entry into force of the specified technical regulation;

- till March 1, 2014 – according to Section 19. "Requirements to chemical and petrochemical products of production appointment" regarding requirements to the cooling liquids (code from 3820 00 000 0 CN FEA EEU) which are object of technical regulation of the technical regulation of the Customs union "About requirements to lubricants, oils and special liquids" (TR CU 030/2012);

- till September 1, 2019 – according to Section 1. "The safety requirement and nutrition value of foodstuff" regarding requirements to products which are object of technical regulation of the technical regulation of the Eurasian Economic Union "About safety of fish and fish products"

(TR EEU 040/2016), in connection with entry into force of the specified technical regulation.

- till November 15, 2017 – according to Section 13. "Requirements to cigarettes and tobacco raw materials" regarding requirements to products which are object of technical regulation of the technical regulation of the Customs union "The technical regulation on tobacco products" (TR CU 035/2014), in connection with entry into force of the specified technical regulation.

- till October 15, 2020 - according to paragraphs to the second, third, the fifth, twelfth, thirteenth subsection 3 and to paragraphs to the first - the tenth, eighteenth subsection 5 of Section 7. "Requirements to products of mechanical engineering, instrument making and electrical equipment" regarding requirements to products which are object of technical regulation of technical regulations of the Customs union "About safety of the low-voltage equipment" (TR CU 004/2011), "About safety of machines and the equipment" (TR CU 010/2011) and "Electromagnetic compatibility of technical means" (TR CU 020/2011), in connection with entry into force of the specified technical regulations.

3. To authorized bodies of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation since July 1, 2010 to perform:

issue of certificates on state registration according to Appendix No. 3 to this Decision;

sanitary and epidemiological surveillance (control) on customs border and customs area of the Customs union according to Appendix No. 4 to this Decision.

4. To provide to the parties till June 1, 2010 to the Secretariat of the Commission of the Customs union of the data:

4.1. about authorized bodies in the field of application of sanitary measures;

4.2. lists of sanitary and quarantine Items at check points on customs border of the Customs union;

4.3. lists and samples of the documents confirming safety of products (goods) since July 1, 2010.

5. To the secretariat of the Commission of the Customs union till June 10, 2010 to send to the Parties of the data, arrived according to item 4 of this Decision.

6. Items 1, 2 and 3 presents of the Decision become effective since July 1, 2010.

The single list of products (goods) which are subject to the state sanitary and epidemiological surveillance (control) on customs border and customs area of the Eurasian Economic Union

Section I. The list of products (goods) which are subject to the state sanitary and epidemiological surveillance (control)

1. Foodstuff (the products in the natural or processed type eaten by the person) including received with use of the gene engineering modified (transgene) organisms (from the following groups of the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union (CN FEA EEU): 007-25, 27-29, 32-34, 35).

2. Products (goods) for children: games and toys, bed linen, clothes, footwear, education guidances, furniture, carriages, bags (satchels, backpacks, portfolios, etc.), diaries and similar products, notebooks, other clerical products (goods) from paper and cardboard, accessories clerical or school artificial polymeric and synthetic materials for production of products (goods) of children's assortment (from the following groups of the CN FEA EEU: 32, 34, 39, 40, 42-44, 46, 48-56, 60-65, 87, 94, 95).

3. Materials, the equipment, substances, devices used in the field of economic and drinking water supply and in case of sewage treatment in swimming pools (from the following groups of the CN FEA EEU: 25, 38-40, 48, 84, 85).

4. Perfumery cosmetics, means of hygiene of oral cavity (from group of the CN FEA EEU 33).

5. Chemical and petrochemical products of production appointment, products (goods) of household chemicals, paints and varnishes (from the following groups of the CN FEA EEU: 32-34, 38).

7. Products of mechanical engineering and instrument making of production, medical and household purpose, except spare parts to vehicles and household appliances (except for contacting to drinking water and foodstuff) (from the following groups of the CN FEA EEU: 38, 84, 85, 90, 94).

8. Publishing products: educational editions and benefits for general education averages and higher educational institutions, book and journal editions for children and teenagers (from the following groups of the CN FEA EEU: 48, 49).

9. Products from the natural raw materials which are exposed in production process to processing (coloring, impregnation, etc.) (from the following groups of the CN FEA EEU: 25, 43, 44, 46, 50-53).
