Some questions of realization of assets on which the judgment on application of the sanction is made

According to part three of article 5-1 of the Law of Ukraine "About sanctions" and for the purpose of enhancement of the procedure of realization of assets on which the judgment on application of the sanction, stipulated in Item 1-1 part one of article 4 of the specified law is made the Cabinet of Ministers of Ukraine decides:

1. Determine that:

assets on which the judgment on application of the sanction, stipulated in Item 1-1 part one of article 4 of the Law of Ukraine "On sanctions" is made and which were included in lists of objects privatizeable, are subject to exception of such lists in case of implementation of their realization according to the Procedure for realization of assets on which the judgment on application of the sanction, stipulated in Item 1-1 part one of article 4 of the Law of Ukraine "On sanctions" is made the approved resolution of the Cabinet of Ministers of Ukraine of November 21, 2023 No. 1233 "Some questions of asset management, collected in the income of the state" (The Official Bulletin of Ukraine, 2024, No. 2, of the Art. 34, No. 67, of the Art. 4031), - with the changes made by this resolution (further - the Procedure).

Privatization of such assets stops according to the decision of the Cabinet of Ministers of Ukraine;

in case the electronic auction was already held by the Fund of state-owned property according to the Procedure for holding electronic auctions for sale of subjects to small privatization and determination of additional terms of sale approved by the resolution of the Cabinet of Ministers of Ukraine of May 10, 2018 No. 432 (The Official Bulletin of Ukraine, 2018, No. 47, the Art. 1641, No. 62, the Art. 2136), the Procedure for holding electronic auctions for sale of subjects to big privatization approved by the resolution of the Cabinet of Ministers of Ukraine of February 21, 2023 No. 183 (The Official Bulletin of Ukraine, 2023, No. 27, the Art. 1513), or the Procedure for alienation of objects of state-owned property approved by the resolution of the Cabinet of Ministers of Ukraine of June 6, 2007 No. 803 (The Official Bulletin of Ukraine, 2007, No. 43, Art. 1714; 2019, No. 86, of the Art. 2903), and it is acknowledged cancelled the organizer of auction for realization of such asset announces repeated tender for advance in price method with decrease in the starting price for 50 percent according to procedure for alienation;

by day of entry into force of Items 70 and 71 of the Procedure according to the automatic announcement of auctions electronic trading system the organizer of auction independently performs the announcement of repeated auction for advance in price method with decrease in the starting price for 50 percent and auction for method of step-by-step decrease in the starting price and the subsequent submission of price offers.

2. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

3. This resolution becomes effective since February 1, 2026 and loses force in one year from the date of the termination or cancellation of martial law in Ukraine imposed by the Presidential decree of Ukraine of February 24, 2022 No. 64 "About introduction of warlike situation in Ukraine", the approved Law of Ukraine of February 24, 2022 No. 2102-IX "About approval of the Presidential decree of Ukraine "About introduction of warlike situation in Ukraine" except Items 70 and 71 of the Procedure for rather automatic announcement of auctions electronic trading system which become effective from the date of emergence of the corresponding technical capability in electronic trading system what the administrator of electronic trading system reports on the own website about, but no later than four months from the date of entry into force of this resolution.

Changes which are made to Resolutions of the Cabinet of Ministers of Ukraine

1. In Item 3 of the Procedure for the alienation of objects of state-owned property approved by the resolution of the Cabinet of Ministers of Ukraine of June 6, 2007 No. 803 (The Official Bulletin of Ukraine, 2007, No. 43, Art. 1714; 2019, No. 86, Art. 2903; 2025, No. 78, the Art. 5370), words", and also the assets collected in the income of the state according to the Law of Ukraine "About sanctions" to exclude.

According to the procedure of holding electronic auctions for sale of subjects to small privatization and determination of additional terms of sale, No. 432 approved by the resolution of the Cabinet of Ministers of Ukraine of May 10, 2018 (The Official Bulletin of Ukraine, 2018, No. 47, the Art. 1641, No. 62, Art. 2136; 2024, No. 67, Art. 4031):

Paragraph two of Item 1 to state 1) in the following edition:

"Action of this Procedure in the cases determined by Item 19 of the Procedure for asset management on which the judgment on application of the sanction, stipulated in Item 1-1 part one of article 4 of the Law of Ukraine "On sanctions" is made the Cabinet of Ministers of Ukraine approved by the resolution of November 21, 2023 No. 1233 (The Official Bulletin of Ukraine, 2024, No. 2, of the Art. 34, No. 67, the Art. 4031), extends, except sale of subjects to small privatization, also to realization of the assets collected in the income of the state on which the judgment on application of the sanction, stipulated in Item 1-1 part one of article 4 of the Law of Ukraine "On sanctions" is made (further - subject to privatization), taking into account the features established by the paragraph third parts three of article 5-1 of the Law of Ukraine "About sanctions" concerning transfer of the money received as a result of realization of assets in the government budget and the directions in Fund of mitigation of consequences of the armed aggression.";

2) in Item 20 of the word "and/or the list of the assets collected in the income of the state according to the Law of Ukraine " about sanctions ", which are subject to realization" to exclude, and shall be replaced with words words of "such lists" "such list";

3) in the paragraph the second Item 21 of the word", and/or the list of the assets collected in the income of the state according to the Law of Ukraine "About sanctions", which are subject to realization" to exclude.

3. According to the procedure of holding electronic auctions for sale of subjects to big privatization, No. 183 approved by the resolution of the Cabinet of Ministers of Ukraine of February 21, 2023 (The Official Bulletin of Ukraine, 2023, No. 27, Art. 1513; 2024, No. 67, Art. 4031):

Paragraph two of Item 1 to state 1) in following editions:
