About approval of the Procedure for forming and maintaining the open list of the software prohibited to use and the communication (network) equipment

According to the paragraph the second "About the basic principles of ensuring cyber security of Ukraine" the Cabinet of Ministers of Ukraine decides parts four of article 4 of the Law of Ukraine:

Approve the Procedure for forming and maintaining the open list of the software prohibited to use and the enclosed communication (network) equipment.

Procedure for forming and maintaining the open list of the software prohibited to use and the communication (network) equipment

1. This Procedure determines the procedure of forming and maintaining the open list of the software prohibited to use and the communication (network) equipment (further - the list).

2. In this Procedure the term "communication (network) equipment" means the equipment, including with installed software, the devices intended for the organization of electronic communication networks, the hardware providing data exchange within communication infrastructure (including switches, routers, fire-walls, etc.).

The term "software" is used in this Procedure in the value of the term "software product" given in the Law of Ukraine "About the National program of informatization". Other terms are used in the value given in the Laws of Ukraine "About electronic communications", "About public service of special communication and information protection of Ukraine", "About the basic principles of ensuring cyber security of Ukraine", "About electronic identification and electronic confidential services", "About information protection in information communications systems", "About sanctions".

3. Forming and maintaining the list is performed by Administration of Gosspetssvyaz electronically by means of technical and software which provide processing, systematization and entering of data into the list, their storage and recovery.

4. The list is kept in state language. Software name and the communication (network) equipment, the name of legal entities, including foreign, own names and surnames of physical persons - nonresidents, foreigners, stateless persons, physical persons, physical persons - the entrepreneurs who are owners and/or vendors of such software or the communication (network) equipment are also duplicated by language of country of source.

5. The software and the communication (network) equipment on the following bases is included in the list:

1) the owner, the final beneficial owner of the subject of managing, the founder, the member, the member (shareholder) of the legal entity, the author of the software who owns property rights on the software, person having property rights at least on one of elements of the software or the communication (network) equipment is the physical person or legal entity to which special economic and other rationing measures according to the Law of Ukraine "About sanctions" are applied;

2) the owner, the final beneficial owner of the subject of managing, the founder, the member, the member (shareholder) of the legal entity, the author of the software who owns property rights on the software, person having property rights at least on one of elements of the software or the communication (network) equipment is the physical person or legal entity to which the international sanctions recognized by Ukraine according to international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine, or solutions of interstate associations, the international, intergovernmental organizations, part in which is taken by Ukraine, according to the corresponding message from the MFA sent to Administration of Gosspetssvyaz, are applied;

3) by a court decision.

6. The list contains the following data on the software and/or the communication (network) equipment:

1) name;

2) the name (own name and surname of the physical person - the entrepreneur) the vendor;

3) other additional data for identification (the version, serial numbers etc.);

4) basis of inclusion in the list;

5) date of inclusion in the list.

In case of change of data on the software and/or the communication (network) equipment or its exception of the list date of exception of the list or date of change of data in it is specified.

7. The bases for exception of the software and the communication (network) equipment from the list and/or changes of data concerning such software and the equipment are:

1) canceling, modification of special economic and other rationing measures according to the Law of Ukraine "About sanctions";

2) canceling, modification of the international sanctions recognized by Ukraine according to international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine, or solutions of interstate associations, the international, intergovernmental organizations, part in which is taken by Ukraine, according to the corresponding message from the MFA sent to Administration of Gosspetssvyaz;

3) elimination of technical errors when entering data into the list;

4) judgment.

8. Inclusion of the software and the communication (network) equipment in the list, exception of it, change of data concerning such software and the communication (network) equipment happens within five working days from the moment of emergence of the bases provided by Items 5 and 7 of this Procedure.

9. The list is the open, public and public information in the form of open data provided free of charge and which is subject to promulgation on the official website of Gosspetssvyaz, the Single state web portal of open data.
