About approval of the technical regulation about safety of objects of sea transport

According to the Federal Law "About Technical Regulation" Government of the Russian Federation decides:

1. Approve enclosed:

 the technical regulation about safety of objects of sea transport;

changes which are made to acts of the Government of the Russian Federation.

2. To Federal Agency for Technical Regulation and Metrology not later than 30 days about day of entry into force of paragraph two of Item 1 of this resolution to approve the list of documents on standardization as a result of which application on voluntary basis observance of requirements of the technical regulation approved by this resolution is provided.

3. Recognize invalid:

the order of the Government of the Russian Federation of August 12, 2010 No. 620 "About approval of the technical regulation about safety of objects of sea transport" (The Russian Federation Code, 2010, No. 34, the Art. 4475);

the order of the Government of the Russian Federation of May 28, 2011 No. 930-r (The Russian Federation Code, 2011, No. 23, the Art. 3342);

Item of 120 changes which are made to acts of the Government of the Russian Federation concerning activities of the Ministry of Health of the Russian Federation, approved by the order of the Government of the Russian Federation of September 4, 2012 No. 882 "About introduction of amendments to some acts of the Government of the Russian Federation concerning activities of the Ministry of Health of the Russian Federation" (The Russian Federation Code, 2012, No. 37, the Art. 5002);

the order of the Government of the Russian Federation of October 7, 2019 No. 1288 "About modification of the technical regulation about safety of objects of sea transport" (The Russian Federation Code, 2019, No. 41, the Art. 5719).

4. This resolution becomes effective from the date of its official publication, except for:

the paragraph two of Item 1 and Item 3 of this resolution which are becoming effective after 6 months from the date of official publication of this resolution;

Item of 1 changes approved by this resolution which becomes effective since September 1, 2025.

5. The technical regulation approved by this resolution is effective 6 years from the date of entry into force of paragraph two of Item 1 of this resolution.

The technical regulation about safety of objects of sea transport

I. General provisions

1. This technical regulation establishes minimum necessary requirements to safety of objects of technical regulation, obligatory for application and execution, directed to achievement of the purposes provided by this technical regulation, requirements to marking of objects of technical regulation and the rule of its drawing, and also the rule of identification and assessment of conformity of objects of technical regulation.

2. According to the Federal Law "About Technical Regulation" this technical regulation is applied for the purpose of protection of life and health of citizens, property of physical persons or legal entities, the state-owned or municipal property against danger which source can be activities of sea transport and the related infrastructure, environmental protections, life and health of animals and plants, the prevention of the actions misleading acquirers of objects of technical regulation, ensuring energy efficiency and resource-saving of objects of technical regulation.

3. Fulfillment of requirements of this technical regulation shall provide:

a) biological safety of objects of technical regulation;

b) explosion safety and fire safety of objects of technical regulation;

c) mechanical safety of objects of technical regulation;

d) thermal safety of objects of technical regulation;

e) electric safety of objects of technical regulation;

e) electromagnetic compatibility of objects of technical regulation regarding ensuring operation of devices and the equipment which belong to objects of technical regulation;

g) radiation safety of the population;

h) ecological safety of objects of technical regulation;

i) other types of safety of the objects of technical regulation for the purpose of specified in Item 2 of this technical regulation.

4. Action of this technical regulation extends to objects of technical regulation which treat:

a) objects of sea transport according to the list according to appendix No. 1;

b) infrastructure facilities of sea transport for the list according to appendix No. 2;

c) design processes, productions, construction or production, installation, operation, conclusion from operation and the utilizations connected with the objects of sea transport specified in the subitem "an" of this Item;

d) design processes (including engineering researches), constructions, reconstruction, installation, adjustment, operation, conclusion from operation and liquidation (utilization) connected with the infrastructure facilities of sea transport specified in the subitem "b" of this Item.

5. Action of this technical regulation does not extend:

a) on the warships, military auxiliary vessels, vessels used for the purpose of transport servicing and (or) safety of objects of the state protection, the ships, motor boats and vessels of troops of national guard of the Russian Federation and other vessels which are in state-owned property or operated and used only for government non-commercial service, court and other watercrafts with nuclear power stations, vessels of atomic technological servicing on the infrastructure facilities of sea transport connected with the specified ships, motor boats and vessels and on design processes, constructions, operation and utilization of such ships, motor boats and courts;

b) on the stationary or floating platforms (including constructions for accommodation of people and sea mobile drilling rigs) performing investigation and development of mineral and other lifeless resources of seabed and its subsoil;

c) on sports sailing ships, pleasure crafts and small size vessels;

d) on the equipment containing explosion-fire-hazardous components as part of picking of such equipment (explosives, pyrotechnic substances for reduction of the equipment in the action and objects carried to dangerous goods of class 1 according to the International maritime dangerous goods code (with amendments);

e) on vessels which construction is complete before entry into force of this technical regulation or the project documentation of which is coordinated and (or) construction contracts of which or examination of the project documentation for which are concluded before entry into force of this technical regulation, or laying of Kiel of which is made before entry into force of this technical regulation, and also on the materials and (or) products for courts made before entry into force of this technical regulation, or the documentation on production of which is coordinated, or the contract for examination of documentation for which is signed before entry into force of this technical regulation;

e) on infrastructure facilities of sea transport, the project documentation on construction or reconstruction of which received the positive decisions of state examination according to the legislation on town-planning activities and examinations of industrial safety according to the Federal Law "About Industrial Safety of Hazardous Production Facilities" before entry into force of this technical regulation.

6. On the objects of sea transport specified in the subitem "d" of Item 5 of this technical regulation and which are in operation, requirements of this technical regulation extend in case of repair, conclusion from operation, utilization of the specified objects of sea transport, and also in case of safety of processes of operation of the specified objects of sea transport provided by requirements of Sections II and III of this technical regulation.

On the infrastructure facilities of sea transport specified in the subitem "e" of Item 5 of this technical regulation and which are in operation, requirements of this technical regulation extend in case of reconstruction, repair, re-equipment, conclusion from operation, utilization of the specified infrastructure facilities of sea transport, and also in case of safety of processes of operation of the specified infrastructure facilities of sea transport provided by requirements of Items 75, of 76, 78 - 83, 88, 89 and 92 presents of the technical regulation.

7. For the purposes of this technical regulation the concepts established by the Protocol on technical regulation within the Eurasian Economic Union (appendix No. 9 to the Agreement on the Eurasian Economic Union of May 29, 2014), and also concepts which mean the following are used:

"accredited person" - the legal entity or the individual entrepreneur who obtained accreditation for the right of conducting non-state examination of the project documentation concerning especially dangerous, technically difficult capital construction projects and (or) for the right of conducting non-state examination of results of engineering researches according to the procedure, provided by part 2 of article 2 of the Federal law "About Accreditation in National Accreditation System";

"alternative project decisions and means" - the designs, measures or structures of the courts differing from provided by the Section II of this technical regulation and (or) international conventions or codes of requirements which cannot be executed owing to design features of the vessel, need of implementation of new materials and (or) products for courts, means, technologies or methods, and used by the designer, the builder of the vessel or the manufacturer of materials and (or) products to courts with accomplishment of reverse engineering and risks assessment, confirmatory that such designs, measures or structures of courts are at least effective, than designs, measures or structures of courts meeting the purposes and the requirements to safety provided by this technical regulation, and equivalent it;

"gross tonnage" - gross tonnage in the value determined by the International convention by measurement of courts of 1969 (with amendments);

"explosion-proof execution" - production of the electric equipment using the measures providing its explosion safety for work in explosive environments;

"explosive zone" - the closed and half-closed rooms and open spaces in which under normal conditions operation explosive mix will be formed or can be formed;

"explosive mix" - mix of air or oxidizer with combustible gases, vapors of flammable liquids, combustible pylyam or fibers which in case of certain concentration and emergence of source of initiation of explosion is capable to blow up;

"hazardous liquid substance" - hazardous liquid substance in the value determined by the International code of construction and the equipment of the vessels transporting dangerous chemical goods in bulk (with amendments);

"for the first time released in the territory of the Russian Federation":

concerning courts - the vessels specified in the Section I of the list provided by appendix No. 1 to this technical regulation which are granted the swimming right under National flag of the Russian Federation or which were released in the territory of the Russian Federation before entry into force of this technical regulation and their appointment and (or) technical characteristics were changed in case of repair subsequently;

concerning materials and (or) products for courts - the materials and (or) products for courts specified in the Section II of the list provided by appendix No. 1 to this technical regulation which were not released in the territory of the Russian Federation earlier or were released in the territory of the Russian Federation before entry into force of this technical regulation and property or the characteristic of which subsequently changed;

"the high-speed vessel" - the vessel (except for the vessel which case is supported completely out of water in not water-displacing mode due to the aerodynamic forces caused by "effect of the screen"), capable to gather maximum speed in meters per second, the equal or exceeding 3,7 0,1667, where - the volume displacement corresponding to settlement waterline in cubic meters;

"cargo zone of the vessel" - cargo holds, cargo tanks, sludge tanks and cargo pumping compartments of the vessel, including pumping departments, cofferdams, rooms for ballast and the empty spaces adjoining cargo tanks and also sites of the deck on all length and width of the vessel over these rooms;

"the diametrical plane of the vessel" - the vertical longitudinal plane representing the plane of symmetry of the vessel;

"durability" - the property of infrastructure facility of sea transport consisting in its capability to keep the strength, physical and other properties established in case of its designing and providing its normal operation during the settlement term of its service;

"survivability of the vessel" - capability of the vessel to resist to consequences of emergency damages, origin and distribution of the fires, impact of explosions, to keep and recover seaworthy qualities (buoyancy, stability, floodability, smoothness of rolling, controllability) and to ensure safety of the people who are on its board, safety of freight and the vessel;

"lifecycle" - the period during which are performed designing, construction (production), operation (including conclusion from operation, repair) and utilization of object of sea transport, infrastructure facility of sea transport. For infrastructure facility of sea transport this period includes also time during which carrying out engineering researches for construction is performed;

"laying of Kiel" - installation on building berth of mortgage section in case of section construction of the vessel or the mortgage block (island) in case of block (island) construction of the vessel or the beginning of construction and assembly relating to this vessel which mass of collected part of the case constitutes at least 50 tons or at least one percent of settlement mass of material of all case designs, depending on what of these values less. For courts from the plastic reinforced by fibers laying of Kiel is stacking in matrix or on matrix of the first constructive reinforced layer from general system of layered material;

"vessel floatage" - the impervious amount of surface part of the vessel considered in calculations of stability and floodability of the vessel necessary for ensuring survivability of the vessel;

"manufacturer" - the legal entity or the individual entrepreneur who make and spread materials and (or) products for courts or on specifying of which designing or production of materials and (or) products for courts and which sell the specified products under the name or the trademark is performed and bear responsibility for its compliance to requirements of this technical regulation;

"products for courts", "materials for courts", "materials and (or) products for courts" - the products of industrial production applied as the compound, removable or belonging to the case of the vessel or its equipment part of design or the equipment of the vessel;

"serviceable condition" - condition of object of sea transport or infrastructure facility of sea transport in case of which quantitative and high-quality criteria for evaluation of its technical condition conform to all requirements of its project documentation;

"major repair" - the repair which is carried out for recovery of resource of infrastructure facility of sea transport with replacement or recovery of any its parts;

"classification society" - the organization authorized on classification and survey of courts according to Item 2 of Article 22 of the Maritime Code of the Russian Federation;

"classification" - form of the assessment of conformity of objects of sea transport performed by classification society to requirements of this technical regulation;

"company" - the company in the value determined by the International code by management of safe operation of courts and prevention of pollution (with amendments);

"preservation of the vessel" - complex of the actions performed by the company or the operating organization in case of long conclusion of the vessel from operation for the purpose of ensuring safety of ship technical means and the vessel in general;

"constructive fire-proof protection of the vessel" - complex of the constructive decisions applied on the vessel directed to prevention of the fire, restriction of distribution of dangerous factors of the fire and providing conditions of safe evacuation of people from ship rooms and from the vessel;

"the vessel case" - the box-shaped design consisting of beams of set, covering, partitions, floorings of decks and platforms of the vessel, providing creation of force of buoyancy, durability of the vessel and possibility of accommodation of people, freights and the equipment according to purpose of the vessel;

"volatile organic compounds" - organic chemicals which have pressure of 0,01 saturated steam of kilopascal or more at temperature of 20 degrees Celsius;

"machine rooms" - rooms and mines conducting in them in which the internal combustion engines used as the main mechanisms, or the internal combustion engines used for other purposes are located if their total power constitutes at least 375 kilowatts, or any coppers using liquid fuel or installations of liquid fuel or gaseous fuel, or the equipment using liquid fuel (generators of inert gases, devices for combustion of ship production wastes and consumption (incinerators) and other aggregates) (further - machine rooms of category A), and also rooms in which the main mechanisms, coppers, installations of liquid fuel are located, steam-engines, internal combustion engines, electric generators and electric mechanisms of responsible appointment (mechanisms which operability ensures safety of navigation of the vessel, safety of the people who are on the vessel and safety of freight), stations of acceptance of fuel, mechanisms of refrigeration units, uspokoitely rolling, systems of ventilation and air conditioning and leaders of the mine in them;

"the place of shelter" - naturally or artificially protected water area which can be used for the shelter of the vessel in case of the circumstances menacing to its safety;

"floodability of the vessel" - capability of the vessel to maintain the emergency damages leading to flooding of one or several compartments, keeping at the same time floatage of the vessel and stability of the vessel;

"oil-containing waters" - water mix with any content of oil;

"oil" - liquid natural fossil mix of hydrocarbons of wide physical and chemical structure in any kind, including the liquid fuel, oil residues and the purified oil products (which are not petrochemical substances);

"oil residues" - the residual waste oils which are formed under normal conditions operation of the vessel (for example, oil products which are formed as a result of purification of fuel or lubricant oil for the main or auxiliary mechanisms, the separated fulfilled oil of the equipment for cleaning and filtering oil, the fulfilled oils and oil products collected in oil collectors, and also the fulfilled hydraulic oil and lubricant oil);

"normal conditions of habitability" - the condition of systems of artificial ventilation, heating and (or) air conditioning, lighting, the equipment for cooking, household refrigerators, and also systems of supply of the vessel with water for sanitary needs and fresh water established by designer under whom smooth operation of the specified systems and the equipment is ensured;

"normal operating conditions" - the condition of object of sea transport established by the designer during designing of object of sea transport and which is characterized by lack of any factors interfering accomplishment by object of sea transport of the functions;
