Some questions of operation of installations of burning of waste and installations of compatible burning of waste

According to item 4 of part one of article 20 of the Law of Ukraine "About waste management", article 33 of the Law of Ukraine "About protection of the surrounding environment" and Item 8 of the Regulations on the Ministry of environment protection and natural resources of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of June 25, 2020 No. 614, I ORDER:

1. Approve Rules of technical operation of installations on burning of waste and installations on compatible burning of the added waste.

2. Approve Changes in Standard rates of maximum permissible emissions of pollutants from the stationary sources approved by the order of the Ministry of protection of the surrounding environment of Ukraine of June 27, 2006 No. 309, of the registered in the Ministry of Justice of Ukraine on August 01, 2006 at No. 912/12786, and technological standard rates of admissible emissions of pollutants from the equipment (installation) for production of cement clinker in the rotating roasted furnaces which production capacity exceeds 500 tons a day approved by the order of the Ministry of protection of the surrounding environment of Ukraine of January 20, 2009 No. 23, registered in the Ministry of Justice of Ukraine on February 09, 2009 at No. 120/16136, which are applied.

3. To provide to department of waste management and ecological effects of military operations (Anastasius Stetsenko) submission of this order in accordance with the established procedure on state registration in the Ministry of Justice of Ukraine.

4. This order becomes effective at the same time with entry into force of the Law of Ukraine of July 16, 2024 No. 3855-IX "About the integrated prevention and control of industrial pollution", but not earlier than day of its official publication.

For installations of burning of waste and installations of joint burning of the waste put into operation or concerning which the construction is begun or the equipment on the basis of the project documentation before entry into force of this order, provision is ordered and paid for installation:

surveillance cameras it is applied in 1 year from the date of entry into force of this order;

the equipment of the automated control system of emissions which provides monitoring of standard rates of maximum permissible emissions (dumpings) of pollutants into atmospheric air and in waters is used in 4 years from the date of entry into force of this order on condition of representation of installations by operators through management information system by waste of investing programs of carrying out technical retrofitting of installations during 1 year from the date of entry into force of this order.

In case of non-presentation in the specified time the Ministry of the environment of investing programs of carrying out technical retrofitting of installations, such installations are subject to closing in 1 year from the date of entry into force of this order.

5. To impose control over the implementation of this order on the deputy minister Alexander Sements.

Rules of technical operation of installations on burning of waste and installations on joint burning of waste

I. General provisions

1. These rules determine conditions and requirements to operation of installations of burning of waste and installations of joint burning of waste (further - installations) for the purpose of prevention, reduction and/or restriction to the greatest possible extent of pollution of the surrounding environment and health hazard of people, including owing to hit of the pollutants arriving as a result of burning in atmospheric air, the soil, surface and underground water.

2. These rules are obligatory for accomplishment by all subjects of managing performing designing, construction, equipping and operation of installations (further - the operator of installation).

3. Action of these rules does not extend on:

1) the installations determined by parts three, the fourth article 38 of the Law of Ukraine "About waste management";

2) the experimental installations used for researches, developments or testing for improvement of processes of burning and processing less than 50 tons of waste a year.

4. The operator of installation who received can perform operation of installation:

1) the integrated ecological permission, the stipulated in Article 3 Laws of Ukraine "About the integrated prevention and control of industrial pollution", or

2) permission to implementation of transactions on processing of waste, the stipulated in Article 42 Laws of Ukraine "About waste management";

permission to emissions of pollutants in atmospheric air by stationary sources, the stipulated in Article 11 Laws of Ukraine "About protection of atmospheric air";

permission to special water use, stipulated in Article 49 Water codes of Ukraine (in case of need).

If in installation it is supposed to burn dangerous wastes, the operator of installation also shall have the license for implementation of economic activity on management of dangerous wastes, the stipulated in Article 44 Laws of Ukraine "About waste management".

5. The list of waste which are accepted for burning on the corresponding installation is established in permission to implementation of transactions on processing of waste or the integrated ecological permission issued to the operator of installation.

This list of waste is created by the operator of installation depending on engineering procedures, temperature, system of purification of flue gases.

Waste which have explosive properties is forbidden to be accepted.

6. The operator of installation during operation of installation develops and approves the documents provided by the Technical requirements to operation of installations on burning of waste and installations on joint burning of waste approved by the resolution of the Cabinet of Ministers of Ukraine of March 01, 2024 No. 229.

7. In these rules terms are used in the following values:

dioxine and furans - the polychlorinated dipetrol-p-dioxine and dicoumarones, according to the list specified in the table 1 of appendix 1 to these rules;

allowing body - public authority which according to the legislation issues permission to special water use, permission to emissions of pollutants in atmospheric air by stationary sources, permission to implementation of transactions on processing of waste or the integrated ecological permission;

the mixed household waste - the household waste referred to subgroup 20 03 01 "The mixed household waste" of the National list of waste approved by the resolution of the Cabinet of Ministers of Ukraine of October 20, 2023 No. 1102 (further - the National list of waste) which do not include separately assembled waste from households or from other sources if this waste is similar on the structure to waste of the households given in subgroup of 20 01 and garden and park waste, provided in subgroup 20 02 National lists of waste;

rated power - the maximum project amount (weight) of waste and fuel which can be burned for unit of time on installation;

the standard rate of maximum permissible emission (dumping) of pollutants - is applied in value of the standard rate of maximum permissible emission of pollutant and maximum permissible dumping of pollutant;

the furnace camera - one of combustion chamber types having limited space in which fuel or waste is burned and burning products are formed.

The terms "waste disposal", "recovery of waste", "waste", "dangerous wastes", "installation of burning of waste", "installation of joint burning of waste" in these rules are used in the value given in the Law of Ukraine "About waste management".

The term "maximum permissible dumping of substances" in these rules is used in the value given in the Water code of Ukraine.

The term "object of the increased danger "in these rules is used in the value given in the Law of Ukraine "About objects of the increased danger".

The terms "remaining balance from burning of waste", "operator of installation on burning of waste or installations on compatible burning of waste" in these rules are used in the value given in Technical requirements to operation of installations on burning of waste and installations on compatible burning of the waste approved by the resolution of the Cabinet of Ministers of Ukraine of March 01, 2024 No. 229.

The terms "waste gases", "fuel" in these rules are used in the value given in the National plan of emission reduction from large szhigatelny installations approved by the order of the Cabinet of Ministers of Ukraine of November 08, 2017 No. 796-r.
