About objects of the increased danger

This Law determines legal, economic, social and organizational basis of the activities connected with objects of the increased danger and is directed to protection of life and human health and the environment against harmful effects of accidents on these objects by the prevention of their origin, restriction (localization) of development and mitigation of consequences.

Article 1. Determination of terms

In this Law terms are used in such value:

accident on object of the increased danger - the dangerous event of technogenic nature which arose during operation of source of danger and on the effects brought (can lead) to death, threat of life or health of workers of object of the increased danger and the population or environmental pollution;

recovery of indicators of safety of source of danger - reduction of source of danger in case of which operation there was accident on object of the increased danger, in the working condition;

the danger source - installations, storages (reservoirs, vessels), pipelines, machines, aggregates, processing equipment (equipment), constructions or complex of constructions located within object of the increased danger on the Earth's surface or under it in which it is temporarily or constantly used, processed, made is transported, stored one or several dangerous substances or categories of substances or their mix;

effect of "dominoes" - probability of origin or consecutive emergence of accidents on the objects located near object of the increased danger on which there was accident connected with use of dangerous substances;

identification of object of the increased danger - the procedure by results of which accomplishment object of the increased danger is considered object of the increased danger of the corresponding class;

dangerous substance - substance or mix of substances which has chemical, toxic, explosive, oxidizing, combustible properties which direct or mediated action can lead to death, sharp or chronic diseases or poisoning of people or pollution of the surrounding environment;

object of the increased danger - the single property complex of the company including buildings, productions (workshops, departments, production sites), the equipment and the sources of danger located within the territory of such object which by results of identification of objects of the increased danger is considered object of the increased danger of the corresponding class;

the operator - the legal entity or physical person entrepreneur who operates (is going to operate) at least one object of the increased danger;

policy of accident prevention on object of the increased danger - the internal document in which the operator taking into account requirements of the laws states the operations procedure aimed at safety in the field of the activities connected with object of the increased danger;

the threshold mass of dangerous substances - normative established or calculated mass of separate dangerous substance or category of dangerous substances or total mass of dangerous substances of different categories depending on which number the corresponding class of object of the increased danger is determined;

acceptable risk level - risk level of emergence of accident, in borders of object or the sanitary protection zone around it is less or equal to maximum permissible level;

risk - probability of emergence of dangerous event during the certain period or under certain circumstances;

mix - mechanical compound or solution of two or more substances;

cross-border influence of accident - influence on the territory and the surrounding environment of one or several states as a result of the accident which happened in the territory of other state.

Article 2. The legislation in the field of the activities connected with objects of the increased danger

The relations connected with activities of objects of the increased danger are regulated by the Constitution of Ukraine, this Law, the laws of Ukraine and other regulatory legal acts.

The relations connected with activities of objects of the increased danger within the territory of exclusive (sea) economic zone of Ukraine and on the continental shelf which is performed on the terms of agreements on distribution of products are regulated by this Law taking into account the features provided by the Law of Ukraine "About agreements on distribution of products".

Article 2-1. Coverage of this Law

Operation of this Law extends to the relations in the field of the activities connected with objects of the increased danger.

Operation of this Law does not extend on:

the equipment, installations, productions with availability of sources of ionizing radiation on them;

aviation, automobile, water, the rail vehicles transporting dangerous substances outside object of the increased danger;

the subjects to investigation, production and development of minerals which are not brought to the surface.

Article 3. The state supervision and control in the field of the activities connected with objects of the increased danger

The state supervision and control in the field of the activities connected with objects of the increased danger perform the authorities authorized by the laws, including the central executive bodies and their territorial authorities (in case of education) to which maintaining according to the law questions are carried:

labor protections;

providing ecological safety and protection of the surrounding environment; protection of the population and territories against emergency situations of technogenic and natural nature;

the state supervision (control) in spheres of fire and technogenic safety;

town planning.

The state supervision and control of the activities connected with objects of the increased danger which is performed in accordance with the terms of the agreement on distribution of products within the territory of exclusive (sea) economic zone of Ukraine and on the continental shelf are performed taking into account the features provided by the Law of Ukraine "About agreements on distribution of products" and conditions of the relevant agreement on distribution of products".

State supervision bodies (control) exercise the state supervision (control) in the field of the activities connected with objects of the increased danger by carrying out scheduled and unscheduled inspections according to the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" taking into account the features determined by this Law.

Planned actions of the state supervision (control) in the field of the activities connected with objects of the increased danger of 1 class are performed by state supervision bodies (control) at least once a year.

Planned actions of the state supervision (control) in the field of the activities connected with objects of the increased danger of 2 and 3 classes are performed at least once in two years.
