About approval of Rules of trade servicing

According to part seven of article 14 of the Law of Ukraine "About consumer protection" the Cabinet of Ministers of Ukraine decides:

1. Approve Rules of trade servicing which are attached.

2. Make changes to resolutions of the Cabinet of Ministers of Ukraine.

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

4. This resolution becomes effective at the same time with entry into force of the Law of Ukraine of June 10, 2023 No. 3153-IX "About consumer protection".

Rules of trade servicing

General provisions

1. These rules determine general requirements to trade servicing and establish conditions of implementation by subjects of managing trade and production trading activity, and also the main requirements to trade rooms.

2. The terms used in these rules have the following value:

1) the made food product - foodstuff which is made in specially equipped place of the trade room (culinary products, bakery and confectionery, drinks, including cocktails);

2) production and trade activities activities of the subject of managing which are performed in the trade room and include production stages, sales of foodstuff and provision of services on public catering;

3) network trade - retail trade out of trade or office rooms which is performed through multi-level network of commercial agents and provides transfer of goods for realization according to the agreement signed between the subject of managing performing network trade and the commercial agent of network trade without transition to the commercial agent of network trade of the property right to goods;

4) wholesale trade sale in the subject of managing of goods, foodstuff to other subjects of managing for their further resale or for use in production or to consumers for private consumption;

5) obstacles for persons with disability and other handicapped national groups - the barriers disturbing availability to the trade room. Obstacles can be the interim, eliminated workers of the subject of managing during insignificant period, or technical (constructional) which are connected with fitness of the trade room to needs of persons with disability and other handicapped national groups;

6) retail trade sale in the company of goods, foodstuff and/or the made foodstuff to consumers for private consumption;

7) trade activities activities of the subject of managing for sales of goods, foodstuff, the made foodstuff or intermediary activities, including for provision of agency, commission and other services in promotion of goods, foodstuff from producers (suppliers) to consumers;

8) the commercial agent of network trade - the physical person (including physical person entrepreneur) acting according to the civil agreement;

9) trade servicing - complex of actions of the subject of managing for consumer service to, in time and after sales of goods, foodstuff, the made foodstuff.

The terms "institution of public catering", "turnover", "production stage and turnover of foodstuff" and "foodstuff" are used in the value given in the Law of Ukraine "About the basic principles and requirements to safety and quality of foodstuff", the terms "handicapped national groups", "shoddy constructions for implementation of business activity" - in the value given in the Law of Ukraine "On regulation of town-planning activities", the term "person with disability" - in the value given in the Law of Ukraine "About rehabilitation of persons with disability in Ukraine", terms "online store", "service of electronic service of placement of announcements (service of classified)", "service of electronic service of comparison of products (service price aggregator)", "service of electronic trading platform (service of marketpleys)" - in the value given in the Law of Ukraine "About electronic commerce", the terms "consumer" "the trade room", "goods" - in the value given in the Law of Ukraine "About consumer protection", the term "subject of managing" - in the value given in the Economic code of Ukraine.

3. Trade and the production trading activity of subjects of managing is regulated by the Economic code of Ukraine, the Tax code of Ukraine, the Civil code of Ukraine, the Laws of Ukraine "About consumer protection", "About electronic commerce", "About application of registrars of settlement transactions in the field of trade, public catering and services", "About the basic principles and requirements to safety and quality of foodstuff", other acts of the legislation, and also these rules.

4. On facade of the stationary trade room the sign with indication of its name is placed.

At entrance to the trade room information on operating mode in a visible place is placed.

The operating mode of trade rooms is set by the subject of managing independently, except the trade rooms relating to utility property of the corresponding territorial communities which operating mode is set by executive bodies of village, settlement, city councils.

The operating mode of institution of the public catering servicing consumers in the territory of the subject of managing is established by agreement between such subject and the subject of managing performing trade productive activity.

The subject of managing shall observe the set operating mode.

In case of temporary termination of work of the trade room for holding planned sanitary actions, repair, technical re-equipment or other works the subject of managing shall inform the consumer at least three days before temporary termination of work, on date and term during which activities will not be performed.

In case of emergency situation in the trade room the subject of managing shall inform the consumer on the term of temporary termination of work of the trade room instantly.
