RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

Some questions of activities of the Ministry of Defence

The Cabinet of Ministers of Ukraine decides:

1. Liquidate the Ministry of questions of strategic industries, having assigned its functions to the Ministry of Defence.

2. Determine that:

legal successor of property, the rights and obligations of the Ministry of questions of strategic industries liquidated according to Item 1 of this resolution is the Ministry of Defence;

statement term creditors of the requirements to the Ministry of questions of strategic industries constitutes two months from the date of entry into force of this resolution.

3. Create the commission on liquidation of the Ministry of questions of strategic industries (further - liquidation commission).

Approve as the chairman of liquidation commission of the State secretary of the Ministry of questions of strategic industries - Pavlov Vitaly Igorevich.

To the chairman of liquidation commission:

approve staff of liquidation commission;

provide implementation of the actions connected with liquidation of the Ministry of questions of strategic industries;

inform in six-months time the Cabinet of Ministers of Ukraine on results of the carried-out work.

4. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

5. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

6. Develop and submit to the Ministry of Defence in accordance with the established procedure for consideration of the Cabinet of Ministers of Ukraine offers on entering into acts of the legislation of the changes following from this resolution.

7. To the Ministry of Defence together with the Ministry of Finance by preparation of offers on introduction of amendments to the Law of Ukraine "About the Government budget of Ukraine for 2025" to provide the expenses necessary for ensuring accomplishment of this resolution.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine

1. In appendix 1 to the resolution of the Cabinet of Ministers of Ukraine of December 26, 2011 No. 1399 "About establishment of limit of the cars serving executive bodies" (The Official Bulletin of Ukraine, 2012, No. 7, Art. 246; 2014, No. 28, Art. 793; 2020, No. 77, Art. 2471):

Figure "3" to replace 1) in line item of "Ministry of Defence" with figure "6";

Line item "Minstrategprom 3" to exclude 2).

2. In appendix 1 to the resolution of the Cabinet of Ministers of Ukraine of April 5, 2014 No. 85 "Some questions of limiting approval of number of workers of the device and territorial authorities of the central executive bodies, other state bodies" (The Official Bulletin of Ukraine, 2014, No. 29, Art. 814; 2024, No. 11, Art. 703):

Line item "Minstrategprom 217" to exclude 1);

To replace 2) in line item of "Ministry of Defence" of figure "829" with figures "1046".

3. In the scheme of the direction and coordination of activities of the central executive bodies by the Cabinet of Ministers of Ukraine through the corresponding cabinet ministers of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of September 10, 2014 No. 442 "About optimization of system of the central executive bodies" (The Official Bulletin of Ukraine, 2014, No. 74, Art. 2105; 2019, No. 86, Art. 2898; 2020, No. 75, Art. 2381; 2022, No. 54, Art. 3174):

Line item "The ministry of questions of strategic industries of Ukraine" to exclude 1) in the Section I;

2) in Item 15 of the Section III of the word of "The minister of strategic industries" shall be replaced with words "Minister of Defence".

4. Make changes to the Regulations on the Ministry of Defence of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of November 26, 2014 No. 671 (The Official Bulletin of Ukraine, 2014, No. 97, Art. 51; 2016, No. 85, to Art. 2781 with the following changes), having stated it in the following edition:

Regulations on the Ministry of Defence of Ukraine

1. The Ministry of Defence of Ukraine (Ministry of Defence) is the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine.

The Ministry of Defence is principal organ in system of the central executive bodies which provides forming and implements:

state policy on national security issues in the military sphere, the sphere of defense and military construction in peace time and the special period;

the state industrial policy, the state military-industrial policy, state policy in the sphere oboronno - industrial complex, in aircraft manufacturing industry also provides forming and realization of state policy in the sphere of space activities (further - strategic industries).

The Ministry of Defence is the central executive body and military management under which supervision armed forces and State special transservice are.

The Ministry of Defence is authorized central executive body in the field of the state aircraft.

The Ministry of Defence is authorized body in the sphere of the state guaranteeing quality, principal organ in the sphere of implementation of defensive purchases and the state customer in the sphere of defense.

2. The Ministry of Defence in the activities is guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, international treaties of Ukraine, this Provision and other acts of the legislation.

3. The main objectives of the Ministry of Defence are:

1) ensuring forming and realization of state policy on national security issues in the military sphere, spheres of defense and military construction in peace time and the special period in the relation:

the organizations in forces of defense of measures of defensive planning;

military policy;

military personnel policy;

military and technical policy in the sphere of defense;

2) forming of state policy in the sphere of defense on digital development, digital innovations, technologies in the sphere of defense;

3) ensuring forming and realization of state policy in the sphere:

the state industrial policy, state policy on development of strategic industries, in particular military-industrial policy in defense industry complex;

innovative activities in strategic industries;

foreign economic activity concerning ensuring functioning and development of strategic industries of Ukraine, the State investment policy in strategic industries, scientific and technical activities in strategic industries, policy on import substitution and price policy in strategic industries;

implementation of management of the objects of state-owned property relating to the sphere of management of the Ministry of Defence in the procedure established by the legislation;

4) implementation of military-political and administrative management by Armed Forces;

5) coordination of activities of State special transservice for ensuring steady functioning of transport in peace time and during the special period;

6) ensuring forming and realization of state policy concerning national resistance;

7) implementation in accordance with the established procedure coordination of activities of state bodies and local government bodies for preparation of the state for defense;

8) providing within the powers provided by the law, realization of state policy on the defensive questions connected with use of airspace of Ukraine and protection of sovereignty of the state;

9) ensuring forming and realization of state policy in the sphere of space activities;

10) participation within powers in ensuring forming and realization of state policy in the sphere of the European integration during accomplishment of obligations by Ukraine according to international treaties of Ukraine in the negotiations aimed at providing development of contractual relations from the EU;

11) providing in strategic industries:

participations in forming of state policy on implementation of research, developmental, productive, financial and other activity of the companies, organizations and organizations relating to the sphere of management of the Ministry of Defence, support of innovations in defense industry complex and in other industries;

investment attraction in defense industry complex, in particular for implementation of the latest technologies, creation of competitive samples of high-technology industrial output, in particular military products, the conclusion of agreements within public-private partnership according to the legislation;
