About approval of the Regulations on selection hunting

Based on part (6) article 4 of the Law No. 55/2024 on hunting and protection of hunting fund (The official monitor of the Republic of Moldova, 2024, Art. No. 148-150, 213) DECIDES: the Government

1. Approve Regulations on selection hunting it (is applied).

2. Declare invalid the Order of the Government No. 1132/2016 about approval of the Regulations on procedure for the organization and carrying out selection hunting (The official monitor of the Republic of Moldova, 2016, No. 360, the Art. 1234), with subsequent changes.

3. To impose control over the implementation of this resolution on the Ministry of the surrounding circle.

Regulations on selection hunting

Chapter I. General provisions

1. The regulations on selection hunting (further - the Provision) establish methods, criteria of classification of selection individuals and procedure for the organization of selection hunting in hunting funds, including:

1.1. in the national parks, biospheric reserves and scientific reserves provided in appendices No. 1, 2 and 8 to the Law No. 1538/1998 on fund of the natural territories protected by the state;

1.2. in the natural territories protected by the state - nature sanctuaries, in natural reserves, landscape reserves, resource reserves, in the territories of multipurpose use, in the territories of monuments of landscape gardening art and wetlands of the international value provided in appendices No. 3-7, 11 and 13 to the Law No. 1538/1998 on fund of the natural territories protected by the state which are included in hunting funds and are delimited, proceeding from circumstances as rest zones.

2. Selection hunting will be organized:

2.1. in all hunting funds - to the managing director of hunting fund;

2.2. in the national parks, biospheric reserves and scientific reserves specified in appendix No. 1, 2 and 8 to the Law No. 1538/1998 on fund of the natural territories protected by the state - to the managing director of the natural territory protected by the state;

2.3. in the natural territories protected by the state - nature sanctuaries, in natural reserves, landscape reserves, resource reserves, in the territories of multipurpose use, in the territories of monuments of landscape gardening art and wetlands of the international value provided in appendices No. 3-7, 11 and 13 to the Law No. 1538/1998 on fund of the natural territories protected by the state which are included in hunting funds and are delimited, proceeding from circumstances as rest zones - to the managing director of hunting fund.

3. Types, method and quantity of the samples which are subject to production affirm the Ministry of the environment.

4. The concepts used for the purposes of this provision have the following values:

4.1. selection hunting - hunting actions for production from populations of settled hunting animals (hoofed mammals) of degenerate, sick, wounded individuals and individuals with explicit variations in behavior of both floors and all age groupes;

4.2. selection individual - individual of type of hunting fauna (hoofed mammals) who does not correspond according to quantity and quality genotypic characteristics to the age and shall be instantly got in order to avoid transfer to posterity of undesirable signs.

Chapter II. Organization of selection hunting

5. The request for carrying out selection hunting is sent in the Ministry of the surrounding circle in writing in 15 working days prior to the planned actions:

5.1. in the national parks, biospheric reserves and scientific reserves specified in appendices No. 1, 2 and 8 to the Law No. 1538/1998 on fund of the natural territories protected by the state - to the managing director of the natural protected territory, in case of approval of scientific council, in case of the natural territory protected by the state and with scientific and technical council - in case of national parks;

5.2. in the natural territories protected by the state - nature sanctuaries, in natural reserves, landscape reserves, resource reserves, in the territories of multipurpose use, in the territories of monuments of landscape gardening art and wetlands of the international value provided in appendices No. 3-7, 11 and 13 to the Law No. 1538/1998 on fund of the natural territories protected by the state which are included in hunting funds and are delimited, proceeding from circumstances as rest zones - to the managing director of hunting fund.

6. The request shall contain without fail:

6.1. the name of the type which is subject to production (in the Romanian and Latin languages);

6.2. data on the location, type density in hunting fund and/or in the natural territory protected by the state at the time of the address;

6.3. data on the number of copies of each type, offered to production;

6.4. the proofs and arguments proving need of carrying out selection hunting including photo / video records which will be analyzed for determination of need of intervention;

6.5. terms of carrying out selection hunting;

6.6. other information and convincing data (risks, obstacles, offers etc.).

7. The ministry of the surrounding circle within 5 working days from registration date of request convokes the applicant of selection hunting and, proceeding from circumstances, the Moldsilva Agency also reviews request regarding need of production by shooting of selection individuals.

8. The ministry of the surrounding circle within 10 working days from the date of completion of consideration of the application about selection hunting claims or does not approve fully or partially method, procedure for application and quantity of the samples offered for production, separately by each type and in writing informs the applicant and, proceeding circumstances, the Moldsilva Agency.

9. After completion of selection hunting the managing director of the natural territory protected by the state and/or the managing director of hunting fund, proceeding from circumstances, within 10 working days in writing informs the Ministry of the surrounding circle on the received results and without fail specifies:

9.1. the applied production method by shooting;

9.2. quantity of the got individuals, with appendix of photographic materials of the shot individuals;

9.3. other convincing information (risks, obstacles, offers etc.).

Chapter III. Methods of production and methods of application

10. The following methods of production by shooting permitted in selection hunting are established:
