About hunting and protection of hunting fund

Chapter I. General provisions

Article 1. Field of regulation and purpose of the law

(1) This law establishes the legal basis of sustainable development, protection, preserving and rational use of hunting fauna, and also the right of physical persons to conducting hunting.

(2) the Purpose of this law is regulation of the relations in the field of management and administration of national hunting fund and providing:

a) protection, reproduction and preserving hunting fauna, and also its habitats;

b) implementations of the principles of sustainable development of national hunting fund;

c) rational use of hunting fauna for the purpose of preserving biodiversity and environmental protection;

d) protection of the rights and interests of hunters, owners/managing directors of the parcels of land and managing directors of hunting funds.

(3) the Individuals of types of wild fauna containing in zoos, the individuals used in the art purposes and also the individuals containing in nurseries for hunting animals whose products are intended for consumption do not fall under action of provisions of this law.

Article 2. Basic concepts

For the purposes of this law the following concepts mean:

the administrator – the body of the central public management given authority on environmental protection and providing administration of national hunting fund. The Ministry of the environment acts as the administrator;

administration of national hunting fund – activities for development of the public program documents concerning the organization, planning and realization of the purposes in area of game management and also for ensuring monitoring and control of activities in the field regarding observance of provisions of agreements of use;

site class of hunting fund – capability of hunting fund to reproduce population of types of hunting fauna depending on conditions of feeding, the shelter and rest;

the agreement of use – the legal act by which the administrator reports separate hunting fund to use;

hunting dog – guard dog whose use in national hunting fund only by hunters is regulated by the administrator;

production quota – the quantity of individuals of each type of hunting fauna approved by the administrator for production within separate hunting fund for one season of hunting;

nurseries for hunting animals – specially equipped place for rashcheniye and cultivation of hunting animals for the purpose of settling, and also for other purposes;

label – the tag/seal which is put down on the game got according to this law;

birkovaniye – putting down of label on animal;

the number of game – quantity of the individuals of certain type of hunting fauna living in the territory of separate hunting fund in certain population structure at the moment;

the optimum number of game – quantity of individuals of certain type of hunting fauna of certain gender and age structure who can occupy separate hunting fund according to the supporting capability of the habitats providing preserving and stability of biodiversity;

hunting fauna – set of individuals from populations of the types of wild fauna provided in appendix 1;

hunting fund – the okhotkhozyaystvenny unit consisting of hunting fauna and its habitats, differentiated so that to provide steady structural integrity of populations of individuals of types of hunting fauna;

national hunting fund – set of hunting funds of the Republic of Moldova;

the managing director of hunting fund – the legal entity registered in the Republic of Moldova to whom one or several hunting funds are transferred to use;

management of hunting fund – the activities for steady managing within hunting fund for the purpose of development and protection of hunting fauna performed by managing hunting fund based on the agreement of use;

the beater – the participant of collective hunting action by persecution method which role consists in hyping up and tiring out game from certain site, towards the line of shooters;
