Some questions of calculation of insurance years of service

According to part two of Article 24-1 and part one of article 26-1 of the Law of Ukraine "About obligatory national pension insurance" the Cabinet of Ministers of Ukraine decides:

1. Approve enclosed:

Procedure for confirmation of impracticability by other state of retirement benefits to persons living in Ukraine for the periods of labor activity till January 1, 1992 outside Ukraine in the republics of the former USSR for their transfer in insurance years of service;

Procedure for confirmation and transfer of the periods of work of person in other state in insurance years of service (length of service) for determination of the right to award of pension on age.

2. Item 22 of the Procedure for confirmation of the available length of service for the purpose of pensions in the absence of the service record or the corresponding records in it approved by the resolution of the Cabinet of Ministers of Ukraine of August 12, 1993 No. 637 (ZP of Ukraine, 1993, No. 12, Art. 273; The Official Bulletin of Ukraine, 2010, No. 16, of the Art. 744) to exclude.

3. To provide to the pension fund of Ukraine review of the decisions made by territorial authorities of the Pension fund of Ukraine for the period from the date of entry into force of the Law of Ukraine of April 25, 2024 No. 3674-IX "On introduction of amendments to some laws of Ukraine concerning settlement of calculation of insurance years of service and provision of pensions" about day of entry into force of this resolution concerning persons working till January 1, 1992 outside Ukraine in the republics of the former USSR concerning award of pension regarding accounting of insurance years of service for the periods of labor activity till January 1, 1992 outside Ukraine in the republics of the former USSR taking into account provisions of the procedures approved by this resolution.

Procedure for confirmation of impracticability by other state of retirement benefits to persons living in Ukraine for the periods of labor activity till January 1, 1992 outside Ukraine in the republics of the former USSR for their transfer in insurance years of service

1. This Procedure determines the mechanism of confirmation of impracticability by other state of retirement benefits to persons living in Ukraine for the periods of labor activity till January 1, 1992 outside Ukraine in the republics of the former USSR for transfer of such periods of labor activity in insurance years of service, in particular on favorable terms.

In case of the conclusion of the international treaty which consent to be bound is provided by the Verkhovna Rada of Ukraine the periods of labor activity of person in any republic of the former USSR (except the Ukrainian SSR) are set off in insurance years of service on the terms of the international treaty.

2. In this Procedure the term "other states" means the states from among the republics of the former USSR to which the Azerbaijani SSR, the Armenian Soviet Socialist Republic, the Belarusian SSR, the Georgian SSR, the Kazakh SSR, the Kyrgyz SSR, the Latvian SSR, the Lithuanian SSR, the Moldavian SSR, the Russian SSR, the Tajik SSR, the Turkmen SSR, the Uzbek SSR, the Estonian SSR belong.

3. In case when in the documents submitted by person to territorial authority of the Pension fund of Ukraine for award of pension the periods of labor activity till January 1, 1992 outside Ukraine in the republics of the former USSR are specified, such person notes information that it receives in the statement for award of pension or does not receive retirement benefits in other states.

4. In case when person specified information that it does not receive retirement benefits in other state in the statement for award of pension, person adds to the statement for award of pension the documents issued by the bodies performing provision of pensions in other state which confirm the fact of non receipt of such payments.

In case of lack of documents on non receipt in other state of retirement benefits person notes the reasons of impossibility of their obtaining and can ask in territorial authority of the Pension fund of Ukraine for the help in submission to other state of request of rather relevant documents.

Before receipt of the relevant documents in territorial authority of the Pension fund of Ukraine pension to person is estimated without the periods of labor activity till January 1, 1992 outside Ukraine in the republics of the former USSR, except cases of lack of possibility of implementation of exchange of information between bodies of provision of pensions of Ukraine and bodies of provision of pensions of other state and documentary confirmation of impracticability by other state of retirement benefits for the specified periods.

In case of the conclusion of the international treaty which consent to be bound is provided by the Verkhovna Rada of Ukraine the territorial authority of the Pension fund of Ukraine within five working days from the date of giving by person directs applications for award of pension to the body performing provision of pensions in other state, request about confirmation of impracticability of retirement benefits to person living in Ukraine for the periods of labor activity till January 1, 1992 outside Ukraine in the republics of the former USSR, and in case of not the conclusion of the international treaty which consent to be bound is provided by the Verkhovna Rada of Ukraine, - to the MFA request about transfer of the body performing provision of pensions in other state, request about confirmation of impracticability in other state of retirement benefits to person living in Ukraine for the periods of labor activity till January 1, 1992 outside Ukraine in the republics of the former USSR for calculation of the size of pension.

The MFA within five working days from the date of receipt of the specified request transfers through diplomatic channels to other state and body performing provision of pensions in other state, request with information that all personal data which will be specified in the provided documents are confidential. After receipt of documents requirements of the Laws of Ukraine "About information" and "About personal data protection" will be applied to data which are specified in them, and such data will be used only for the needs connected with questions of obligatory national social insurance, determined by the law.
