About approval of the Concept of the Information system "State Register of Legal Units"

Based on Item d) article 22 of the Law No. 467/2003 on informatization and the state information resources (The official monitor of the Republic of Moldova, 2004, Art. No. 6-12, 44), with subsequent changes, DECIDES: the Government

1. Approve the Concept of the Information system "State Register of Legal Units" it (is applied).

2. Assign Public institution "Agency of the state services" as the owner and the holder of the Information system "State Register of Legal Units".

3. To provide to public institution "Agency of the state services" with assistance of public organization "Agency of Electronic Control" in 12-month time creation of the Information system "State Register of Legal Units".

4. To provide to public institution "Agency of the state services" functioning and constant development of the Information system "State Register of Legal Units".

5. To perform development of the Information system "State Register of Legal Units", and also its functional servicing within one year from the date of input of system in operation at the expense of means of the Upgrade of the State Services project.

6. In Item 1 of the Order of the Government No. 272/2002 on measures for creation of automated information system "The state register of legal units" (Official monitor of the Republic of Moldova, 2002, Art. No. 40-42, 376), with subsequent changes, to declare paragraph two invalid.

Concept of the Information system "State Register of Legal Units"

The purpose of development of this document is the description of conceptual model of the Information system "State Register of Legal Units" which updating is caused by need of implementation of new model ("model To-Be") of provision of the state service "State Registration of Legal Units" developed as a result of the reengineering of the corresponding service which is carried out within actions of the Upgrade of the State Services project realized according to the Financial agreement between the Republic of Moldova and International Development Association and the Agreement on loan between the Republic of Moldova and the International Bank for Reconstruction and Development ratified by the Law No. 25/2018, and for the action accomplishment 3.3 Action plans on the reform directed to upgrade of public services, for 2017-2021 approved by the Order of the Government No. 966/2016. Besides, the task of development of the information system "State Register of Legal Units" and, respectively, its documentation by approval originally of its concept, and in subsequent and regulations on procedure for maintaining the State register of legal units, is based also on regulations of Item 10 of the Order of the Government No. 354/2020 on some measures for implementation of the Upgrade of Government Services project.

On December 23, 2021 the Parliament adopted the Law No. 234/2021 on public services (which is becoming effective since February 5, 2023) which provides assignment on service providers of obligation to provide creation of completely automated electronic public services allowing to perform electronic self-service of beneficiaries of public services without interaction with representatives of service providers. Changing paradigm of provision of public services, giving to citizens opportunity to receive public service individually, it is completely autonomous also without the aid of personnel of the supplier, bodies of public management and public organizations will be able to carry out better the tasks, increasing at the same time trust and commitment of citizens.

Thus, according to the Law No. 234/2021 on public services and the Law No. 220/2007 on state registration of legal entities and individual entrepreneurs, with the changes made by the Law No. 175/2021 on modification of some regulations ("the I packet of digitalization"), registration of the legal unit, change of constituent documents containing in the register of information, etc. directly the applicant on registration (electronic self-service) online, autonomous without direct contact with the specialist of territorial subdivision of Public institution "Agency of the state services" will be one of functions of the new Information system "State Register of Legal Units".
