About informatization and the state information resources
The parliament adopts this organic law.
(1) This law establishes the basic rules and conditions of activities in the field of creation and development of national information infrastructure as circles of functioning of information society of the Republic of Moldova, governs the legal relations arising in the course of forming and use of the state automated information resources, creation and use of information technologies, systems and networks.
(2) Operation of this law does not extend to the relations arising during creation and functioning of mass media, forming and use of non-state information resources, and also when processing undocumented information.
(1) the Legislation in the field of informatization includes the Constitution of the Republic of Moldova, the international agreements, one of the parties of which is the Republic of Moldova, this law, and also other regulations governing the relations connected with informatization and the state information resources.
(2) in case of mismatch of provisions of this law to regulations of international treaties, one of the parties of which is the Republic of Moldova, regulations of international treaties are applied.
For the purpose of this law the following basic concepts are used:
the database - data set, organized according to conceptual structure, describing the main characteristics and the relations between entities, intended for one or more scopes;
databank - the information and technical system including one or several databases and management system them;
complex of program technical means - set of the program and technical means providing implementation of information processes;
data - information provided in the certain form allowing to report, interpret and process it;
personal data - the data on physical person allowing to identify directly or indirectly it;
the document - the carrier on which information is fixed and which has the details allowing to identify it;
the electronic document - the electronic document as it is determined in article 2 of the Law on the digital signature and the electronic document No. 91/2014;
the national domain of the highest level ".md" - the code of the Republic of Moldova assigned by Corporation on assignment of names and numbers on the Internet (ICANN) according to the international standard ISO-3166 as name of the domain of the highest level for identification of the country on the wide area network the Internet;
informatization - organizational social and economic and scientific and technical process of creation of optimal conditions for satisfaction of information needs and realization of the rights of citizens, bodies of the public power, public organizations and legal entities on the basis of forming and use of information resources;
information - the information about persons, subjects, the facts, events, the phenomena, processes, objects, situations and the ideas;
documentary information - the information fixed on the information carrier, having the details allowing to identify it;
information protection - set of actions for warning of non-authorized access to the protected documentary information;
information infrastructure - set of data processing centers, databanks and knowledge of the integrated automated system of communication and the organization which provides to users general terms of access to the stored information;
space model of the area - set of the descriptive and space data provided in digital form, intended for reproduction of volume types of the area, topographical objects and additional data according to the established conditions in real time;
the owner of information resources, information systems, technologies and means of their providing - the physical person, the legal entity or the state given rights of possession and uses of information resources, information systems, technologies and means of their providing on the conditions established by the owner of the appropriate rights;
information process - process of collection, processing, accumulating, storage, updating and provision of documentary information;
information product - the result of processing of information by means of automated information systems intended for ensuring needs of users;
the owner of information resources, information systems, technologies and means of their providing - the physical person, the legal entity or the state which are completely exercising rights of possession, uses and orders of information resources, information systems, technologies and means of their providing;
information resource - the set of documentary information in automated information systems organized according to the established requirements and the current legislation;
information service - activities for provision of information products;
information system - the set of the interconnected information resources, technologies, methods and personnel intended for storage, processing and issue of information;
administration of information system - the activities including the following: technical administration of information system; access control to information resource; monitoring of actions of the user, access to data and their updating, procedure for provision of information in information resource, observance of safety requirements concerning access to information resource and service regulations of information system; training of all categories of users of information system and loggers of information resources to use of information system; realization of necessary organizational and technical measures for providing the mode of information protection and safety of personal data;
servicing of information system - the activities including the following: ensuring functionality and safety of complex of program technical means; updating of the version of information system; maintenance of information system and information resource; recovery of functionality of information system in case of failures; ensuring methodical and practical support to users;
development of information system - creation and implementation of new functional modules and/or modification of the existing modules of information system, and also reengineering of information system;
cyber security - the condition of normality of information system and the information resource resulting from application of package of measures, providing authenticity, integrity, confidentiality, availability and immunity of data;
the subject of personal data - the physical person which is the carrier of personal data;
the information medium - the material carrier with the certain physical properties allowing to write, store and process documentary information;
information technology - set of methods, methods and means of processing and information transfer, and also rules of its application;
