About public services

The parliament adopts this organic law.

Chapter I General provisions

Article 1. Purpose and subject of the law

(1) the Purpose of this law consists in creation of the legal base for provision of public services providing availability, service quality and efficiency of their provision with respect for balance between satisfaction of interests of beneficiaries of public services and public interest.

(2) This law establishes the basic principles of provision of public services, establishes competence and responsibility in the field of public services, requirements to provision of public services, procedure and forms of their provision, the right and obligation of beneficiaries and suppliers of public services, regulates the aspects connected with monitoring of provision and quality evaluation of public services, and also with responsibility for violation of the legislation in the field of provision of public services.

Article 2. Basic concepts

For the purpose of this law the following concepts are determined:

public services - the non-commercial administrative activities of individual nature performed in the mode of the public power by the supplier of public services in the presence of request from beneficiaries or without that which concern implementation of their legitimate rights, freedoms, obligations and interests, with providing with it in need of the corresponding material or non-material benefits;

electronic public services - the public services provided electronically, fully or partially automated, with use of electronic communications and information technologies and free for access by means of web applications, mobile applications or special devices for provision of public services;

electronic self-service - independent receipt of the electronic public services provided completely automated, by means of web application of mobile application or the special device for provision of public services;

pro-active public services - the public services provided owing to approach of certain events and confluence of certain circumstances which grant to beneficiaries of public services the right to use the corresponding public services without filing of applications for this purpose and without accomplishment of certain actions in relation to suppliers of public services;

vital event - the general name of group of the public services connected with the fact having special value for physical person or legal entity;

the beneficiary of public services - the identified physical person or legal entity, on request and/or for the benefit of which public services, including through representation or by means of the supplier are provided;

the supplier of public services - any of the following subjects:

a) central administrative authority subordinated to the Government; organizational structure of the sphere of its competence (subordinated administrative authority, deconcentrated or subordinated public service, public organization which founder is the central administrative authority);

b) the administrative authority, autonomous in relation to the Government, providing public services according to competence and according to the special regulatory base regulating it fields of activity;

c) organizational structure of the sphere of competence of the ministry or State office (subordinated administrative authority, deconcentrated or subordinated public service, public organization which founder is the ministry or the State office);

d) the body of local public authority providing the public services transferred to its competence of the field of activity; public organization of local value or the municipal company which founder is the body of local public authority;

e) the legal entity of private law which, within the competences delegated to it according to regulations, provides public services;

single window - the mechanism allowing the supplier of public services to provide public services including electronic, in the single place, including on behalf of several suppliers of public services, providing the minimum participation of the beneficiary of public services assembled, preparation and submission of documents for provision of public services and reducing number of visits of suppliers of public services;

the multipurpose center of provision of public services (the multipurpose center) - method of provision of public services by means of single window by which function of the first line (front-office) of provision of public services is transferred to territorial subdivision of body of the public power / the public organization authorized by the Government to implement the single window providing reception of applications on provision of public services and issue of results of provision of public services;

the universal center of provision of public services (the universal center) - method of provision of public services by means of single window by which function of the first line (front-office) of provision of public services is transferred to the third subject (to body of local public authority or diplomatic representation / to consular establishment) for ensuring filling, transfer by the beneficiary of public services of statements on provision of public services and/or receipts of results of their provision, at the same time is allocated for the supplier of public services task of consideration of the applications and development of result of provision of public services (back-office);

the government portal of public services - the single platform of access to public services and reliable information founded by the Government about them;

government customer support - the single platform of contact with beneficiaries of public services founded by the Government by means of which they can request and receive the help with the questions connected with provision of public services and also can make recommendations about improvement of quality of public services;

information system public - the information system founded by the Government with repeatedly used functions and providing general functions for other information systems, including those that are provided for provision of public services.
