1. Bring in the order of the Minister of Energy of the Republic of Kazakhstan of February 23, 2015 No. 132 "About approval of standards of the state services of the Department of Energy of the Republic of Kazakhstan in the field of oil and gas" (registered in the Register of state registration of regulatory legal acts at No. 11279, published in the Information system of law of Ad_let on July 14, 2015) (further – the order) the following changes:

2. To provide to department of the state inspection in oil and gas complex of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it the copy in printing and electronic type in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

5) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2), 3) and 4) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Standard of the state service "Issue of Permissions to Burning in Torches of Associated and (or) Natural Gas during the Testing of Objects of Wells, Test Operation of the Field, Technologically Inevitable Combustion of Gas in case of Commissioning, Operation, Maintenance and Repair Work of Processing Equipment"

Chapter 1. General provisions

1. The state service "Issue of Permissions to Burning in Torches of Associated and (or) Natural Gas during the Testing of Objects of Wells, Test Operation of the Field, Technologically Inevitable Combustion of Gas in case of Commissioning, Operation, Maintenance and Repair Work of Processing Equipment" (further – the state service).

2. The standard of the state service is developed by the Department of Energy of the Republic of Kazakhstan (further – the Ministry).

3. The state service appears the Ministry (further – the service provider).

Reception of applications and issue of results of rendering the state service are performed through the web portal of "the electronic government" www.egov.kz, www.elicense.kz (further – the portal).

Chapter 2. Procedure for rendering the state service

4. Term of rendering the state service:

from the moment of the address on the portal – 10 (ten) working days.

5. Form of the rendered state service: electronic.

6. Result of rendering the state service – permission to burning in torches of associated and (or) natural gas during the testing of objects of wells, test operation of the field, technologically inevitable combustion of gas in case of commissioning, operation, maintenance and repair work of processing equipment or motivated refusal.

Form of provision of result of rendering the state service: electronic.

7. The state service is rendered free of charge to physical persons and legal entities (further – uslugopoluchatel).

8. The working schedule of the portal round the clock, except for technical breaks in connection with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of applications and issue of results of rendering the state service is performed the next working afternoon).

9. List of the documents necessary for rendering the state service:

1) when carrying out testing of objects of well:

the statement specified in appendix 1 to this standard of the state service, certified by the digital signature (further – the EDS) uslugopoluchatel;

electronic copies of the plans of testing of the separate objects of well constituted by uslugopoluchatel and approved with territorial subdivisions of authorized body on studying and use of subsoil;

2) in case of test operation of the field, in case of technologically inevitable combustion of gas:

the statement specified in appendix 1 to this standard of the state service, certified by the digital signature (further – the EDS) uslugopoluchatel;

the form of data specified in appendix 2 to this standard of the state service.

Data of identity documents of uslugopoluchatel, about state registration (re-registration) of the legal entity, containing in the state information systems, the service provider receives from the corresponding state information systems through lock of "the electronic government".

In case of delivery the uslugopoluchatel of all necessary documents, in "personal account" of uslugopoluchatel displays the status about acceptance of request for rendering the state service with indication of the date of receipt of result of the state service.

10. The refusal in issue of permission is performed on the following bases:

1) establishment of unauthenticity of the documents submitted by the subsoil user (applicant) for receipt of permission, and (or) these (data) containing in them;

2) discrepancy of the subsoil user (applicant) and (or) the provided materials, objects, supplied and the information necessary for issue of permission to the requirements established by regulatory legal acts of the Republic of Kazakhstan;

3) concerning the subsoil user (applicant) there is decision (sentence) of court on prohibition of activities or the separate types of activity requiring receipt of certain permissions of the first (licenses) and (or) the second categories which took legal effect;

4) concerning the subsoil user (applicant) there is judgment which took legal effect based on which the subsoil user is deprived of the special right connected with receipt of certain permissions of the first (licenses) and (or) the second categories.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of the central state bodies, and also the service provider and (or) his officials concerning rendering the state services
