About approval of standards of the state services of the Department of Energy of the Republic of Kazakhstan in spheres of hydrocarbons and gas and gas supply

According to the subitem 1) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" PRIKAZYVAYU:

1. Approve enclosed:

1) the standard of the state service "Issue of Permission to Burning in Torches of Sour Gas" according to appendix 1 to this order;

2) the standard of the state service "Issue of Permission to Creation and Placement of Sea Objects" according to appendix 2 to this order;

3)  No. 469 is excluded according to the Order of the Minister of Energy of the Republic of Kazakhstan of 30.11.2018;

4)  No. 83 is excluded according to the Order of the Minister of Energy of the Republic of Kazakhstan of 07.03.2017;

5)  No. 469 is excluded according to the Order of the Minister of Energy of the Republic of Kazakhstan of 30.11.2018;

6) the standard of the state service "The License for Designing (Technology) and (or) Operation of Mining Facilities (Hydrocarbons), Petrochemical Productions, Operation of Trunk Gas Pipelines, Oil Pipelines, Oil Pipelines in the field of Hydrocarbons" according to appendix 6 to this order;

7) the standard of the state service "Accreditation of the Gas-network Organizations" according to appendix 7 to this order.

2. To provide to committee of ecological regulation, control and state inspection in oil and gas complex of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) the direction on official publication of the copy of this order within ten calendar days after its state registration in the Ministry of Justice of the Republic of Kazakhstan in periodic printing editions and in information system of law of Ad_let;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Standard of the state service "Issue of Permission to Burning in Torches of Sour Gas"

Chapter 1. General provisions

1. The state service "Issue of Permission to Burning in Torches of Sour Gas" (further - the state service).

2. The standard of the state service is developed by the Department of Energy of the Republic of Kazakhstan (further – the Ministry).

3. The state service appears the Ministry (further – the service provider).

Reception of applications and issue of results of rendering the state service are performed through the web portal of "the electronic government" www.egov.kz, www.elicense.kz (further – the portal).

Chapter 2. Procedure for rendering the state service

4. Term of rendering the state service:

from the moment of the address on the portal - 8 (eight) working days.

The service provider within two working days from the moment of receipt of documents of uslugopoluchatel for issue of permission and (or) appendices to it checks completeness of the submitted documents. In case of factual determination of incompleteness of the submitted documents, the service provider within the specified term gives motivated refusal in further review of the statement.

5. Form of the rendered state service: electronic (completely automated).

6. Result of rendering the state service - permission to burning in torches of sour gas or motivated refusal in rendering the state service.

7. The state service is rendered free of charge to physical persons and legal entities (further – uslugopoluchatel).

8. The working schedule of the portal round the clock, except for technical breaks in connection with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of applications and issue of results of rendering the state service is performed the next working afternoon).

9. List of the documents necessary for rendering the state service:

1) when carrying out testing of objects of well:

the statement for receipt of permission to the burning in torches of sour gas (further - the statement) in form according to appendix 1 to this standard of the state service certified by the digital signature (further - the EDS) uslugopoluchatel;

the electronic copy of the plan of testing of objects of well approved by the applicant;

in case of not work on testing of objects of well within earlier got permission the applicant attaches the electronic copy of the supporting document explaining the reasons their not carrying out.

2) in case of test operation of the field, in case of technology inevitable combustion of gas:

the statement in form according to appendix 1 to this standard of the state service certified by the EDS of uslugopoluchatel;
