About approval of Rules of rendering the state service "Licensing for Works and Services in the field of Hydrocarbons"

According to the subitem 1) article 10 of the Law of the Republic of Kazakhstan "About the state services" PRIKAZYVAYU:

1. Approve Rules of rendering the state service "Licensing for Works and Services in the field of Hydrocarbons" according to appendix 1 to this order.

2. Recognize invalid some orders of the Department of Energy of the Republic of Kazakhstan according to appendix 2 to this order.

3. In spheres of hydrocarbons and subsurface use of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan to provide to department of the state control:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

5. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of rendering the state service "Licensing for Works and Services in the field of Hydrocarbons"

Chapter 1. General provisions

1. These rules of rendering the state service "Licensing for Works and Services in the field of Hydrocarbons" (further – Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law) and the subitem 4) of Item 1 of article 12 of the Law of the Republic of Kazakhstan "About permissions and notifications" and determine procedure for rendering the state service "The License for Works and Services in the field of Hydrocarbons" (further – the state service).

2. In these rules the following basic concepts are used:

1) Single contact center - the legal entity determined by authorized body in the field of rendering the state services, performing functions of directory service on provision to uslugopoluchatel of information on questions of rendering the state and other services and also to state bodies - information on questions of rendering information and communication services;

2) electronic form of the license and (or) appendix to the license – the permission in electronic form which is drawn up and received with use of the state information system of permissions and notifications equivalent to permission on paper;

3) the state service – one of the forms of realization of the separate state functions or their set performed according to the address or without address of uslugopoluchatel and directed to realization of their rights, freedoms and legitimate interests, provision of the corresponding material or non-material benefits by it;

4) the state information system of permissions and notifications – the information system which is component of "the electronic government", intended for implementation in electronic form of licensing, allowing procedures regarding receipt of permission with assignment of identification number, the direction of the notification by the applicant and ensuring these processes;

5) the web portal of "the electronic government" (further – the portal) – the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;

6) payment gateway of "the electronic government" (further – PShEP) – the information system automating processes of information transfer about carrying out payments within rendering the paid services rendered electronically;

7) the digital signature (further – the EDS) – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

Chapter 2. Procedure for rendering the state service

3. The state service appears the Department of Energy of the Republic of Kazakhstan (further – the service provider).

4. The list of the main requirements to rendering the state service including characteristics of process, form, content, and also other data taking into account features of provision of the state service "The License for Works and Services in the field of Hydrocarbons" is provided in the list of the main requirements to rendering the state service (further – the Requirement), according to appendix 1 to the presents of the Rule.

5. For receipt of the state service the physical person and legal entity (further – uslugopoluchatel) sends to the service provider by means of the portal the documents necessary for rendering the state service "The License for Works and Services in the field of Hydrocarbons" specified in Item 8 of the Requirement.
