About approval of Rules of legislative work of the Government of the Republic of Kazakhstan

1. Approve the enclosed Rules of legislative work of the Government of the Republic of Kazakhstan.

2. Recognize invalid some decisions of the Government of the Republic of Kazakhstan according to appendix to this resolution.

3. This resolution becomes effective from the date of its signing and is subject to official publication.

Rules of legislative work of the Government of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of legislative work of the Government of the Republic of Kazakhstan (further – Rules) are developed according to the subitem 4) of Item 2 of article 19 of the Law of the Republic of Kazakhstan "About judicial authorities", item 4 of article 17-1 of the Law of the Republic of Kazakhstan "About legal acts" (further – the Law) and determine procedure for development, placement, public discussion, approval of advisory documents of regulatory policy, and also drafts of the laws prepared according to the procedure of the legislative initiative of the Government of the Republic of Kazakhstan (further – the Government), and also projects of the regulatory legal acts developed according to Item 15 of article 17-1 of the Law.

2. In these rules the following concepts are used:

1) the program of information maintenance and explanation - the list of actions for informing citizens on the changes in the legislation of the Republic of Kazakhstan affecting their rights and legitimate interests and to their explanation, and also ensuring effective implementation of the adopted law;

2) the Internet portal of open regulatory legal acts (further - the Internet portal open for the NPA) - the web portal component of "the electronic government" providing placement of projects of regulatory legal acts and other information according to the Law of the Republic of Kazakhstan "About information access" for holding procedure of public discussion;

3) the automated workplace of the Internet portal open for the NPA (further - automated workplace) - the appendix provided by the operator of information and communication infrastructure of "the electronic government" intended for management of settings and content which is placed on the Internet portal open for the NPA;

4) the information system "E-zannama" - the single system of law intended for carrying out the analysis (monitoring) the legislation of the Republic of Kazakhstan, and also automation of separate processes of rule-making;

7) target group - person, group of persons whose rights and interests will be infringed by the offered regulation (the project of regulatory legal act);

8) pilot project - the procedure which is carried out by state body for the purpose of identification of result from the entered regulation;

9) subjects of regulation - persons to whom action of regulatory legal acts extends;

10) regulatory loading - financial burden of subjects of regulation in connection with establishment by the legislation of the Republic of Kazakhstan of the requirements obligatory for execution, including costs of time and human resources;

11) regulatory policy - state regulation of the public relations by means of regulatory legal acts;

12) the advisory document of regulatory policy (further – the advisory document) – the document of the established form which shall contain problems of state regulation in the specific sphere, way of their decision, the reasons for need of project development of the law and other provisions determined by the Government of the Republic of Kazakhstan;

13) the explanatory note to the bill - the obligatory document attached to the bill, containing reasons for need of adoption of the bill with the developed characteristic of the purposes, tasks and basic provisions of the bill, stated in the form allowing to receive general information about the bill and promoting increase in level of public awareness of future regulatory policy;

14) the operator of information and communication infrastructure of "the electronic government" (further - the operator) - the legal entity determined by the Government to which ensuring functioning of the information and communication infrastructure of "the electronic government" assigned to it is assigned.

3. Rules are aimed at providing realization of regulatory policy and forming of single mechanisms of implementation of the legislative initiative of the Government by means of consecutive observance of the provided procedures, including procedures of forecasting of effects from projectible regulation, the procedure of public discussion of drafts of the laws and other procedures of regulatory policy.

4. Legislative work of the Government is carried out by the central executive bodies, and also other state bodies in coordination with them and includes:

1) development of the advisory document, its discussion with the interested bodies, the organizations and target groups;

4) placement of the advisory document on the Internet portal open for the NPA for public discussion, receipt of line items of members of the Interdepartmental commission on questions of bill activities (further – the Commission), including the conclusions of the Ministry of Justice of the Republic of Kazakhstan (further – the Ministry of Justice), the conclusions of public councils, advisory councils concerning entrepreneurship (further – advisory councils), National chamber of entrepreneurs of the Republic of Kazakhstan (further – Scientific Production Enterprise) according to the procedure, determined in these rules;

5) No. 822 is excluded according to the Order of the Government of the Republic of Kazakhstan of 04.10.2024

6) consideration of the advisory document on commission session;

7) in case of approval of the advisory document by the Commission creation of working group on project development of the law;

8) project development of the law, including subordinate regulatory legal acts if the relevant bill provides their acceptance, the materials accompanying to the bill, necessary for introduction on approval;

10) carrying out the analysis of regulatory impact of the bill providing introduction of the regulatory tool or toughening of regulation concerning subjects of entrepreneurship according to the procedure, determined by authorized body by entrepreneurship, in cases when need of its carrying out is provided by the Entrepreneurial code;

11) placement of the bill on the Internet portal open for the NPA for public discussion, receipt of the conclusions of scientific examinations (except for linguistic examination), public councils, advisory councils and Scientific Production Enterprise according to the procedure, determined in these rules;

12) carrying out public hearings under the bill according to the decision of the first head of the state body or person fulfilling its duties;

13) approval of the bill of the interested state bodies and the organizations according to the Law and the Regulations of the Government of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of January 6, 2023 No. 10 (further – Regulations of the Government);
