1. Approve enclosed:

- Regulations on the Ministry of emergency situations of the Kyrgyz Republic;

- scheme of management of the Ministry of emergency situations of the Kyrgyz Republic.

2. Determine that the Ministry of emergency situations of the Kyrgyz Republic is legal successor of the Ministry of emergency situations of the Kyrgyz Republic, except for functions of the State inspectorate for supervision of industrial safety and to mountain supervision.

3. Transform:

- The state agency on hydrometeorology (Kyrgyzgidromet) under the Ministry of emergency situations of the Kyrgyz Republic in the Agency on hydrometeorology (Kyrgyzgidromet) under the Ministry of emergency situations of the Kyrgyz Republic;

- The State Fire and Rescue Service under the Ministry of emergency situations of the Kyrgyz Republic in the Agency on fire safety under the Ministry of emergency situations of the Kyrgyz Republic.

4. Determine that:

- The agency on hydrometeorology (Kyrgyzgidromet) under the Ministry of emergency situations of the Kyrgyz Republic is legal successor of the State agency on hydrometeorology (Kyrgyzgidromet) under the Ministry of emergency situations of the Kyrgyz Republic.

Regulations on the Ministry of emergency situations of the Kyrgyz Republic

I. General provisions

1. The ministry of emergency situations of the Kyrgyz Republic (further - the Ministry) is state body of the executive authority of the Kyrgyz Republic in the field of Civil protection, fire, atomic and radiation safety and hydrometeorology.

2. The ministry in the activities is guided by the Constitution of the Kyrgyz Republic, the laws and other regulatory legal acts of the Kyrgyz Republic, orders and directives of the Commander-in-chief of Armed Forces of the Kyrgyz Republic, and also this Provision.

3. The ministry performs the activities in interaction with other executive bodies, local self-government, public associations, the international and non-governmental organizations directly and through bodies subordinated to it.

4. The ministry is legal entity, military organization, is completed with military personnel, government employees and junior service personnel, has the signs of distinction, seal with the image of the State Emblem of the Kyrgyz Republic and with the name in the state and official languages, stamp, settlement and other accounts in system of treasury.

II. Purposes and tasks of the Ministry

5. The purpose of activities of the Ministry is realization of single state policy in the field of Civil protection, fire, atomic and radiation safety and hydrometeorology.

6. Tasks of the Ministry are:

- implementation of forecasting of dangerous natural, technogenic processes and phenomena, planning of actions of Civil protection;

- the prevention, holding preventive protective measures from emergency situations peace and wartime;

- organization and carrying out search and rescue, emergency and recovery and other urgent works, mitigation of consequences of emergency situations, assessment of their scales.

III. Functions of the Ministry

7. The main functions of the Ministry are:

- in accordance with the established procedure submits in the Government of the Kyrgyz Republic for the direction for approval to the President of the Kyrgyz Republic the Plan of Civil protection of the Kyrgyz Republic for wartime;

- in accordance with the established procedure submits for approval to the Government of the Kyrgyz Republic the Plan of Civil protection of the Kyrgyz Republic for peace time;

- performs monitoring of natural hazards, predicts their activation;

- in accordance with the established procedure equips rescue units, military units and organizations of the Ministry with the necessary equipment, mechanisms and property;

- participates in conducting state examination of drafts of master plans of settlements and objects regarding observance of requirements in the field of Civil protection;

- maintenance of governing bodies, forces and forming of Civil protection, the public fire service in permanent readiness for holding actions for protection of the population and the territories from emergency situations of natural and technogenic nature;

- creation of hydrometeorological and agrometeorological forecasts;

- state regulation in the field of atomic and radiation safety;

- development of normative requirements and the regulating rules of atomic and radiation safety;

- performs expert activities for underwater and technical and diving works on hydraulic engineering constructions and other water objects;

- will organize implementation of the state supervision of observance of the Kyrgyz Republic by state bodies, local government bodies, legal entities and physical persons, irrespective of patterns of ownership, requirements of fire safety;

- interacts with other state bodies and the organizations regarding determination of the priority directions and carrying out scientific and research works on questions of Civil protection, hydrometeorology and fire safety, and also in the field of training;

- the organization and participation in development of regulatory legal acts and the organization of promotion and dissemination of knowledge in the field of Civil protection, hydrometeorology and fire safety;

- issues the instruction and instructions in the field of Civil protection which are the ministries and departments, local public administrations, local government bodies and other organizations, obligatory for execution, irrespective of patterns of ownership;

- will organize holding actions of Civil protection;

- creates emergency rations of material resources of Civil protection for use in emergency situations;

- develops together with other executive bodies and local self-government the nomenclature and regulations of accumulating of material values of mobilization reserve and submits for approval in the Government of the Kyrgyz Republic;

- coordinates the events held by executive bodies and local self-government in the field of Civil protection;

- provides combat and mobilization readiness of military forming and territorial authorities of the Ministry;

- coordinates organization activity, dealing with issues of atomic and radiation safety;

- development and implementation of state programs on accident prevention on radioactive and toxic tailings dams and dumps for ensuring protection of the population and the territory;

- performs training, preparation and retraining of specialists in diving case;

- carries out expert works on dikes of hydraulic engineering constructions and water areas of places of mass improving rest of citizens at reservoirs;

- creates and supports control centers, systems and means of communication and notifications in permanent readiness;

- performs the actions providing protection against mudflows, floods and other waters of settlements and objects, construction of selezashchitny constructions and provides operation of these engineering constructions;

- performs operation of the existing selvodzashchitny constructions and devices in beds of the rivers which are under authority of the Ministry;

- control of observance of technical requirements in the field of the prevention of emergency situations on waters and water objects;

- interacts with state bodies and the organizations regarding determination of the priority directions in carrying out research and design and exploration work on radiation and chemical monitoring and the address with tailings dams and mountain dumps;

- implementation of diving underwater and technical, rescue, search and rescue and research works on water objects and hydraulic engineering constructions of the Kyrgyz Republic;

- together with local public administrations, local government bodies will organize first-priority life support of affected population around emergency situations;

- will organize and carries out search and rescue and other urgent emergency works on liquidation of emergency situations, in the territory of the Kyrgyz Republic, and also in the territory of other states with which the Kyrgyz Republic has agreements, and also accreditation and certification of rescue services and rescue forming;

- performs organizational and methodical management of all diving descents and works, establishes requirements of qualification characteristics and certification for all specialists of "diving case" in the Kyrgyz Republic;

- establishes together with state bodies, local government bodies and business entities procedure for attraction of their forces and means for participation in suppression of major fire, controls readiness of these forces and means;

- performs the analysis, assessment, monitoring and audit of adequacy and system effectiveness of internal control, reliability and reliability of financial and management information, effectiveness, profitability and efficiency of activities and management, safety of assets and compliance with law of the Kyrgyz Republic in the Ministry.

IV. Rights of the Ministry

- use in priority procedure for communication and information transfer republican systems and departmental communication networks, including communication networks of bodies of military command;

- in interaction with local public administrations to perform management of works on mitigation of consequences of large-scale accidents, catastrophic crashes and natural disasters;

- have up to 200 (two hundred) thousand som of reserve in central office and in each subordinated division of the Ministry for departures of employees on places of emergence of emergency situations;

- according to the procedure, established by the legislation of the Kyrgyz Republic to render paid services in requests of legal entities and physical persons;

- involve the equipment of the companies adapted for these purposes in suppression of the fires;

- manages the property and means of the Ministry which are on its balance, will organize financial and economic activities according to the legislation of the Kyrgyz Republic;

- in accordance with the established procedure appoints and dismisses the staff of central office of the Ministry;

- approves regulations on structural divisions of central office and territorial subdivisions;

- in accordance with the established procedure submits projects of regulations on subordinated divisions of the Ministry for approval of the Government of the Kyrgyz Republic.

14. Procedure for appointment, dismissal, function and power of the secretary of state are determined by the legislation on public service. Deputy ministers are appointed to position and dismissed by the Prime Minister of the Kyrgyz Republic on representation of the minister, submit directly to the minister and will organize activities of the ministry within the obligations assigned to them.
