About getting of the objects of fauna carried to subjects to hunting
According to article 40 of the Federal law "About Fauna" Government of the Russian Federation decides:
1. Approve enclosed:
Rules of getting of the objects of fauna carried to subjects to hunting;
terms of getting of the objects of fauna carried to subjects to hunting;
the list of tools of getting of the objects of fauna carried to subjects to hunting, allowed for use;
the list of the methods of getting of the objects of fauna carried to subjects to hunting, allowed for use.
2. Declare invalid the resolution of Council Ministrovpravitelstva of the Russian Federation of July 26, 1993 N 728 "About amateur and sports hunting in the Russian Federation" (Collection of acts of the President and the Government of the Russian Federation, 1993, N 31, the Art. 2991).

1. These rules establish procedure for getting of the objects of fauna carried to subjects to hunting (further - fauna objects).
2. These rules do not extend to the relations connected with getting of objects of fauna which are in especially protected natural territories, and also getting of which is performed for the purpose of regulation of their number, the scientific, cultural and educational, educational, recreational and esthetic purposes.
Getting of objects of fauna for the purpose of amateur and sports hunting is conducted with observance of these rules in hunting grounds according to the permit (permission) (further - the permit) issued:
the public hunting organizations, other legal entities and physical persons - for hunting in grounds in which the hunting economy is conducted by these public hunting organizations, other legal entities and physical persons;
the executive bodies of subjects of the Russian Federation performing powers on protection, control and regulation of use of objects of fauna and the circle of their dwelling - for hunting in other hunting grounds.
The form of the permit affirms the Ministry of Agriculture of the Russian Federation.
3. The concepts used in these rules mean the following:
a) "getting of objects of fauna" - hunting, including tracing for the purpose of production, prosecution and production of the objects of fauna which are in condition of natural freedom and also stay in the native habitat of objects of fauna with the loaded uncovered hunting weapon;
b) "tools of getting of objects of fauna" - the tools determined according to the list of tools of getting of objects of fauna approved by the order of the Government of the Russian Federation of January 10, 2009 N 18;
c) "the hunting ticket" - the certificate on the hunting right confirming availability at the citizens performing getting of objects of fauna, certain knowledge of hunting, safe engineering on hunting and the handling of tools of getting of objects of fauna and skills in these areas;
d) "hunting weapon" - the hunting weapon determined by the Federal Law "About Weapon";
e) "products of getting of objects of fauna" - the got fauna objects and also received from them meat, skins (skin), horn, egg of birds, down, feather, internals and other parts of their bodies;
e) "method of getting of objects of fauna" - set of the actions directed to getting of objects of fauna;
g) "the term of getting of objects of fauna" - the established period of time during which getting of certain types of objects of fauna can be made.
4. Have rights to getting of objects of fauna:
a) the citizens of the Russian Federation who received the hunting ticket in the procedure established by the Ministry of Agriculture of the Russian Federation. Getting of objects of fauna is performed for the purpose of amateur and sports hunting till July 1, 2011 also by the citizens of the Russian Federation having the membership hunting cards issued by the public hunting organizations in accordance with the established procedure including the membership hunting cards issued earlier according to the order of the Government of the Russian Federation of July 26, 1993 to N728 "About Amateur and Sports Hunting in the Russian Federation";
b) the foreign citizens who got permission to getting of objects of fauna in the procedure established by the Ministry of Agriculture of the Russian Federation.
5. The procedure for issue, replacement and cancellation of hunting tickets, and also permissions to foreign citizens to getting of objects of fauna is established by the Ministry of Agriculture of the Russian Federation.
6. Getting of objects of fauna which withdrawal from the circle of their dwelling without license is forbidden is made under the personalized one-time license on use of objects of fauna granted by the executive body of the subject of the Russian Federation performing powers on protection, control and regulation of use of objects of fauna and the circle of their dwelling (further - the license). The procedure for issue, registration and form of the license are established by the Ministry of Agriculture of the Russian Federation.
Getting of objects of fauna which withdrawal from the circle of their dwelling does not require the license is made based on the hunting ticket with observance of regulations, quotas and limits of getting of the objects of fauna set in accordance with the legislation of the Russian Federation in terms of getting of the objects of fauna approved by the order of the Government of the Russian Federation of January 10, 2009 N 18.
7. When getting objects of fauna of person shall have in case of themselves the hunting ticket, the permit, and also the license in the case established by paragraph one of Item 6 of these rules.
When getting objects of fauna using weapon of person shall have in case of themselves also the weapons permit according to requirements of the legislation of the Russian Federation about weapon.
When transporting products of getting of objects of fauna it is necessary to have in case of itself the license in the case established by paragraph one of Item 6 of these rules which is the document confirming legality of getting of the specified products.
8. Getting of objects of fauna can be made both by one person (individually), and group of persons (group getting of objects of fauna - 2 and more people).
9. In case of group getting of wild hoofed animals and bears the license shall be at person responsible for group getting, and in case of individual getting of objects of fauna - at person which is directly performing their getting.
10. Person responsible for group getting of wild hoofed animals and bears:
a) in case of receipt of the license checks correctness of its registration;
b) before getting of objects of fauna checks availability and validity of hunting tickets and permissions of law-enforcement bodies to storage and carrying hunting weapon at all persons participating in their group getting and does not allow to participation in their getting of persons which do not have the specified documents;
c) constitutes the list of persons participating in group getting of objects of fauna (further - the list of persons), with indication of:
dates and places of getting of objects of fauna;
license numbers based on which getting of objects of fauna will be performed;
type of object of the fauna which is subject to getting;
surnames, name and middle name of the citizen participating in getting of objects of fauna;
numbers of the hunting ticket of the citizen participating in getting of objects of fauna;
numbers of permission of law-enforcement bodies to storage and carrying the hunting weapon issued to the citizen participating in getting of objects of fauna;
d) instructs with persons participating in group getting of objects of fauna on technology of safe handling of hunting firearms when carrying out group getting, and also to procedure for getting of objects of fauna after which person who is taking part in group getting of objects of fauna undersigns for the list of persons;
e) during group getting of objects of fauna has in case of itself the list of persons;
e) after getting of object of fauna prior to its cutting and (or) export (carrying out) does mark about getting and fills in the license;
g) in case of fauna object wound prior to further prosecution does in the license mark about wound and organizes further getting of wounded object of fauna on which one days are allotted, apart from day of wound, otherwise fills in the license, specifying that object of fauna was not got.
11. Person participating in implementation of group getting of wild hoofed animals and bears shall have documents, stipulated in Item 7 these rules.
12. In case of group getting of the objects of fauna which are not specified in Item 9 of these rules, the list of persons is not constituted.
13. When getting the objects of fauna which are not specified in Item 9 of these rules which withdrawal from the circle of their dwelling without license is forbidden the license it is filled prior to transportation of products of getting.
14. In case of individual getting of objects of fauna which withdrawal from the circle of their dwelling without license is forbidden the license is filled in according to the subitem "e" of Item 10 and Item 13 of these rules.
15. Getting of bear cubs of the current year of birth and she-bears with bear cubs of the current year of birth to bedding in den is not made.
When getting bears in time and in the place of their hibernation (in den) in case of bedding of several bears in one den getting of all bears is made.
16. For getting of objects of fauna dogs of hunting breeds and hunting birds can be used.
Getting of objects of fauna with dogs is performed in terms of getting of the objects of fauna carried to subjects to hunting.
Training (nataska and nagonka) of dogs of hunting breeds is made according to terms of getting of the objects of fauna carried to subjects to hunting.
All the year round training (nataska, nagonka) of dogs of hunting breeds is made in the places which are specially equipped for this purpose in borders of the territories provided to legal entities or individual entrepreneurs according to the long-term license to use fauna objects.
17. The executive body of the subject of the Russian Federation performing powers on protection, control and regulation of use of objects of fauna and the circle of their dwelling in coordination with the Ministry of Agriculture of the Russian Federation has the right to perform adjustment of terms of getting of objects of fauna within 2 weeks earlier or 2 weeks after fixed terms taking into account change of terms of migration and reproduction cycles of animals in connection with change of climatic conditions in specific year.
18. The citizens belonging to indigenous ethnic groups of the North, Siberia and the Far East to ethnic communities which original culture and conduct of life include traditional methods of protection and use of objects of fauna and their associations have the right to perform getting of objects of fauna in the territories of traditional resettlement and economic activity within calendar year.
19. Persons guilty of violation of these rules bear responsibility in accordance with the legislation of the Russian Federation.
