About introduction of amendments to some orders of the Minister of Justice of the Republic of Kazakhstan

I ORDER:

1. Approve the enclosed list of some orders to which changes are made (further - the list).

2. To provide to committee of registration service and organization of legal services of the Ministry of Justice of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order;

2) placement of this order on official Internet resource of the Ministry of Justice of the Republic of Kazakhstan after day of its first official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Justice of the Republic of Kazakhstan.

4. This order becomes effective since July 12, 2026 and is subject to official publication, except for paragraphs two, the third, fifth and sixth Item 2, of paragraphs two, the third, fifth and sixth Item 3, of paragraphs of the fourth, fifth Item 4, of paragraphs of the third and fourth Item 5, of paragraphs of the third, fourth Item 8, of paragraphs two, the third, fifth and sixth Item 9, of paragraphs of third and fourth Item 11 of the list which become effective since March 13, 2026.

1. The service provider provides entering of data on stage of rendering the state service into digital monitoring system of rendering the state services according to the procedure, established by authorized body in the field of digitalization, according to the subitem 11) of Item 2 of article 5 of the Law on state services.

10. In case of failure of digital system the service provider within one working day notifies the operator digital infrastructures of "the digital government" (further – the operator).

In this case the operator during the term specified in part one of this Item of Rules draws up the statement of technical issue in any form and signs it with the service provider.";

3. Bring in the order of the Minister of Justice of the Republic of Kazakhstan of May 4, 2020 No. 27 "About approval of Rules of rendering the state service "State Registration of the Rights (Encumbrances of the Rights) to Real Estate" (it is registered in the Register of state registration of regulatory legal acts No. 20610) the following changes:

"According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" I ORDER:";

in the Rules of rendering the state service of the Rule of rendering the state service "State Registration of the Rights (Encumbrances) to Real Estate" approved by the above-stated order:

"1. These rules of rendering the state service "State Registration of the Rights (Encumbrances) to Real Estate" (further – Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state and socially responsible services" and determine procedure for rendering the state service "State Registration of the Rights (Encumbrances) to Real Estate".";

4. In case of documents acceptance the worker of the service provider verifies the identity document, or the digital document from service of the digital documents of uslugopoluchatel with data reflected in the state digital systems (for identification).

In case of discrepancy of the address data of real estate object specified in the title document with the address data containing in digital system of the single State Immovable Property Cadastre, the worker of the service provider specifies the real estate object address by registration code of the address.

If the transaction is notarially not certified, then the registering body shall verify authenticity of the signature of persons who made the transaction (their authorized representatives), their capacity to act (legal capacity), and also compliance of their will to declaration of will.

At the same time the uslugopoluchatel submits the petition through office of the service provider, on the location of the real estate unit of uslugopoluchatel.

5. The term of rendering the state service from the moment of receipt of the statement to the service provider constitutes three working days, and in case of state registration according to notarially not certified transaction the state service is rendered within one working day from the moment of receipt of the statement to the service provider.

Digital registration is made no later than one working day following behind day of receipt in digital system of the single State Immovable Property Cadastre of confirmation about payment for state registration of the rights to real estate or release from payment.

Digital registration in the accelerated procedure is made within two hours, from the moment of receipt in digital system of the single State Immovable Property Cadastre of confirmation about payment for state registration of the rights to real estate or release from payment.

Digital registration of the rights (encumbrances of the rights) regarding origin, changes, the terminations of pledge on real estate using digital technologies is made within two hours, from the moment of receipt through external lock of "the digital government" in digital system of the single State Immovable Property Cadastre of the electronic request, with the attached electronic copy of the title document witnessed by the digital signature of uslugopoluchatel, the electronic check confirming payment for state registration.

State registration of the termination of encumbrances, and also legal claims is made within one working day from the moment of receipt of the statement in registering body.

Day of documents acceptance through the service provider does not enter rendering the state service in time.

6. In case of digital registration by the notary information on the unique number of the title document assigned in single notarial digital system (further - ENTsS) and about payment amount for state registration of the rights to real estate is issued to uslugopoluchatel.

After carrying out by uslugopoluchatel of payment for the state service details of the check go to digital system of the single State Immovable Property Cadastre.

The notification report on acceptance of request for rendering the state service goes to "personal account" of uslugopoluchatel on the web portal of "the digital government".

The state service is rendered no later than one working day following behind day of receipt in digital system of the single State Immovable Property Cadastre of confirmation about payment.

The service provider carries out the legal analysis of the documents confirming origin, change or the termination of the rights (encumbrance of the rights) to real estate and other subjects to state registration which shall conform to requirements of the legislation of the Republic of Kazakhstan imposed to them at the time of registration, except for the rights (encumbrance of the rights) to real estate which are not subject to obligatory state registration, and also earlier arisen rights (encumbrance of the rights).

Digital registration of the rights (encumbrances of the rights) for real estate can be made using digital technologies with issue of the notice of registration.

Digital registration in the legal inventory based on the request of bank of the second level, the microfinancial organization performing activities for provision of the microcredits to physical and (or) legal entities with providing or without providing in the amount of which is not exceeding twenty thousandfold sizes of the monthly settlement indicator established for the corresponding financial year by the law on the republican budget, and credit partnership (further - the financial organizations) on origin, change, the termination of pledge, arrived by means of digital objects (the digital systems of the financial organizations using digital technologies for submission of the electronic request for registration of origin, change, the termination of pledge with receipt of result of rendering the state service in the automated form) through external lock of "the digital government" is performed in the following procedure:

1) the financial organization initiates in the legal inventory the electronic request for registration of origin, change, termination of pledge with attachment of the electronic copy of the title document certified by the EDS of uslugopoluchatel;

2) the uslugopoluchatel (the authorized representative of the applicant) makes payment for state registration of origin, change, the termination of pledge through payment gateway of "the digital government" according to the digital legislation of the Republic of Kazakhstan, with obligatory specifying of data of the payer of payment for state registration of origin, change, the pledge termination.

After effected payment for state registration of origin, change, the pledge termination details of the electronic check confirming payment for state registration (unique code of the request, unique payment code, payment name of a consignee, the bank name of the second level or the organization performing separate types of banking activities, data of the payer of payment, including its identification number, payment amount, dates and time of payment, code of purpose of payment) remain on "payment gateway" of the digital government" in the form of the electronic check and go to the legal inventory.

In the presence of discrepancies in the digital documents submitted by the financial organization with data of the legal inventory the analysis is carried out by the worker of the service provider in the following procedure:

1) performs check of accomplishment of conditions (check on request fact availability with the completed information, payments, in the presence of registration of scrap of consent of the spouse(s) with confirmation of the electronic statement for the receipt of the state service certified by the EDS, the consent of the owner(s) of the real estate object to collection, processing of personal data received by means of the state service of access control to personal data, the individual identification number / business of identification number of participants, lack of encumbrances which exclude state registration, absence in the list of faces tied with financing of terrorism and extremism).

The data necessary for implementation of state registration of origin, change, the pledge termination, receives from the corresponding state digital system having integration interactions with digital system of the single State Immovable Property Cadastre;

2) makes record in registration leaf about the made registration or about refusal or suspension in state registration and directs to signing to management.

In the absence of the bases for suspensions and refusals in state registration by the worker of the service provider state registration of the rights to real estate is performed.

In the presence of the bases for suspensions and refusals in state registration by the worker of the service provider stops or refuses in state registration of the rights to real estate.

6-1. Procedure for maintaining and accounting of acceptance acts of object in operation.

The service provider within one day from the moment of obtaining from uslugopoluchatel of the approved acceptance act of object in operation with appendix to it of technical characteristics of object and executive geodetic shooting of actual position of engineering networks and (or) buildings (constructions), the declaration of conformity, the conclusions about quality of installation and construction works and compliance of the performed works to the approved project directs at the same time:

1) in the structural division of the relevant local executive body performing functions in the field of architecture and town planning in the location of object, the approved acceptance act of object in operation with appendix to it of technical characteristics of object and executive geodetic shooting of actual position of engineering networks and (or) buildings (constructions);

2) in bodies of the state architectural construction supervision in the location of object the approved acceptance act of object in operation with appendix to it of technical characteristics of object, the declaration of conformity and the conclusions about quality of installation and construction works and compliance of the performed works to the approved project.

The local executive bodies performing functions in the field of architecture and town planning before the expiration of one working day from the moment of receipt of documents from the service provider carry out reconciliation on observance by the customer of the procedures determined by rules of the organization of building and passing of allowing procedures and make accounting of the acceptance act in operation by means of digital system of the state town-planning inventory.

Following the results of reconciliation in case of establishment of discrepancy of construction object to requirements of rules of the organization of building and passing of allowing procedures within one working day from the moment of receipt of documents from the service provider in writing inform on it bodies of the state architectural construction supervision and registering body.

In case of lack of discrepancy within one working day from the moment of receipt of documents from the service provider in writing inform registering body.

Bodies of the state architectural construction supervision before the expiration of one working day from the moment of receipt of documents from the service provider carry out reconciliation regarding observance by the customer of the regulations and requirements established by the legislation of the Republic of Kazakhstan on architectural, town-planning and construction activities.

In case of identification of violations within one working day from the moment of receipt of documents from the service provider in writing inform on it registering body and apply responsibility measures according to the legislation of the Republic of Kazakhstan.

In case of lack of violations within one working day from the moment of receipt of documents from the service provider in writing inform on it registering body.";

8) of Item 7 to state the subitem in the following edition:

"8) if within three working days from the moment of receipt of the electronic copy of the title document in digital system of the single State Immovable Property Cadastre confirmation about payment for state registration of the rights to real estate or about release of person from payment did not arrive.

In case of suspension of rendering the state service the service provider sends to uslugopoluchatel, the notification with indication of the reasons and terms of suspension, date and registration document number.
