1. Approve Rules of rendering the state service "Updating (Adjustment) of Data of Real Estate Objects in Information System of the Single State Immovable Property Cadastre" according to appendix to this order.

2. To provide to department of registration service and organization of legal services of the Ministry of Justice of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order;

2) placement of this order on official Internet resource of the Ministry of Justice of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Justice of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of rendering the state service "Updating (Adjustment) of Data of Real Estate Objects in Information System of the Single State Immovable Property Cadastre"

Chapter 1. General provisions

1. Rules of rendering the state service "Updating (Adjustment) of Data of Real Estate Objects in Information System of the Single State Immovable Property Cadastre" (further - Rules) are developed according to the Law "About the State Services" of the Republic of Kazakhstan (further – the Law) and determine procedure for rendering the state service "Updating (Adjustment) of Data of Real Estate Objects in Information System of the Single State Immovable Property Cadastre" (further - the state service).

2. Updating (adjustment) of data of real estate objects in information system of the single State Immovable Property Cadastre (further - IS EGKN) means entering of the changed data of real estate objects into the Single State Immovable Property Cadastre based on the statement.

3. Updating (adjustment) of data of real estate objects in information system of the single State Immovable Property Cadastre is performed in case of assumption of wrong data in IS EGKN based on title and identification documents.

4. The state service is performed by Branches of The Government for Citizens State corporation (further – the service provider).

5. Uslugopoluchatel – physical and (or) legal entities (further – uslugopoluchatel).

6. The service provider sends information on adoption of these rules, to the organizations performing reception of applications and issue of results of rendering the state service including to Single contact center within three working days.

Chapter 2. Procedure for rendering the state service

7. For receipt of the state service the uslugopoluchatel submits the application in form according to appendix 1 to these rules (further - the statement) and the documents provided in the List of the main requirements to rendering the state service "Updating (Adjustment) of Data of Real Estate Objects in Information System of the Single State Immovable Property Cadastre" (dalee-Perechen) of the main requirements to rendering the state service according to appendix 2 to these rules through the service provider in the location of the real estate unit of uslugopoluchatel or the web portal of "the electronic government" www.egov.kz (further – the portal).

8. In case of the appeal to the State corporation, in case of provision by uslugopoluchatel of incomplete document package according to the list, stipulated in Item 8 Lists of the main requirements to rendering the state services, according to type and (or) documents with the expired effective period, the employee of the State corporation refuses reception of an application, and issues the receipt on refusal in documents acceptance in form, according to appendix 5 to these rules.

When giving the uslugopoluchatel of documents in "private office" of the portal of uslugopoluchatel displays the status about adoption of the statement for rendering the state service, with indication of date and time of receipt of result of rendering the state service.

9. In case of receipt of the statement according to appendix 1 to these rules the chief of the department (department) of registration of the rights to real estate within 20 minutes adopts the statement on the state service, determines the contractor of the service provider and directs to execution.

The contractor of the service provider checks completeness of packet of the submitted documents for compliance to the current legislation of the Republic of Kazakhstan and makes correction of data of real estate objects to the legal inventory within 1 working day from the moment of receipt of the statement.

After introduction of the corresponding adjustments the contractor of the service provider sends for approval and signing to management of the service provider result of rendering the state service.

The notification on updating (adjustment) of data of real estate objects signed by management of the service provider in information system of the single State Immovable Property Cadastre in form according to appendix 3 to these rules goes the contractor of the service provider to "private office" of the portal of uslugopoluchatel by means of the portal, certified by the electronic and digital signature (dalee-ETsP) of the service provider, or through the service provider in the location of the real estate unit of uslugopoluchatel within 1 working day from the moment of receipt of the statement.

10. In the presence of the bases for refusal specified in the list in "private office" of the portal or through the service provider on the location of the real estate unit of uslugopoluchatel within 1 working day from the moment of receipt of the statement of the service provider the notification on motivated refusal in the state service in form according to appendix 4 to these rules certified by the EDS goes.
