About introduction of amendments to some orders

(Extraction)

I ORDER:

1. Approve the enclosed list of some orders to which changes are made (further - the List).

2. To provide to department of special social services of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication, except for paragraphs of the fifth, sixth, seventh, eighth, ninth, tenth, eleventh, twelfth, fifteenth, sixteenth Item 1, of Item 2, of paragraphs of the fourth and fifth Item 3, of Item 4, of paragraphs of the fifth, sixth, seventh, eighth, ninth, tenth, eleventh, thirteenth, seventeenth Item 5, of Item 6 of the List which are entered since July 12, 2026.

Determine that since July 12, 2026 appendix 4 to the Rules of rendering the state service "Document Creation on Rendering Special Social Services in the Centers of Rendering Special Social Services" approved by the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of May 28, 2020 No. 197 "About approval of Rules of rendering the state service "Document Creation on Rendering Special Social Services in the Centers of Rendering Special Social Services" (it is registered in the Register of state registration of regulatory legal acts at No. 20756) and appendix 1 to Rules of rendering the state service "Licensing for Provision of Special Social Services", the approved order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 28, 2024 No. 230 "About approval of Rules of rendering the state service "Licensing for Provision of Special Social Services" (it is registered in the Register of state registration of regulatory legal acts at No. 34655), are effective in edition according to appendices 1 and 2 to this order.

The list of some orders to which changes are made

1. Bring in the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of May 28, 2020 No. 197 "About approval of Rules of rendering the state service "Document Creation on Rendering Special Social Services in the Centers of Rendering Special Social Services" (it is registered in the Register of state registration of regulatory legal acts at No. 20756) the following changes:

in the Rules of rendering the state service "Document Creation on Rendering Special Social Services in the Centers of Rendering Special Social Services" approved by the specified order:

state Item 1 in the following edition:

"1. These rules of rendering the state service "Document Creation on Rendering Special Social Services in the Centers of Rendering Special Social Services" (further – Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" and determine procedure for document creation on rendering special social services in the centers of rendering special social services in the conditions of hospital, semi-hospital and at home (further – the state service).";

3) of Item 2 to state the subitem in the following edition:

"3) the web portal of "the digital government" www.egov.kz (further – the portal).";

state Items 8 and 9 in the following edition:

"8. In case of compliance of document package, the main requirements to rendering the state service specified in the list according to appendix 4 to these rules, the specialist of the service provider enters into the automated digital E-social security system (further – ATsS "E-social security") data from the statement of the addressed person (family) needing special social services.

In case of the address of uslugopoluchatel through the State corporation, the portal data from the statement are automatically transferred to ATsS "E-social security".

9. Data on stage of rendering the state service arrive in the automated mode from ATsS "E-social security" in digital monitoring system of rendering the state services.";

"15. In the presence of the bases provided in Item 10 of the List of the main requirements to rendering the state service according to appendix 4 to these rules, the service provider according to Article 73 of the Administrative procedural Procedure Code of the Republic of Kazakhstan notifies uslugopoluchatel on the provisional solution about refusal in rendering the state service, and also time and the place (method) of carrying out hearing for opportunity to express to uslugopoluchatel line item according to the provisional solution.";

the second Item 16 to state part in the following edition:

"The claim of uslugopoluchatel which arrived to the service provider according to the subitem 2) of Item 3 of article 25 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" is subject to consideration within 5 (five) working days from the date of its registration.";

Bring in the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 6, 2023 No. 205 "About approval of Rules of forming in electronic form on the portal of social services of the register of the organizations providing special social services" (it is registered in the Register of state registration of regulatory legal acts at No. 32724) the following change:

in Rules of forming in electronic form on the portal of the social services of the register of the organizations providing special social services, approved by the specified order:

3) of Item 2 to state the subitem in the following edition:

"3) the portal of social services (further – the portal) – the digital object representing single point of access to goods and the services, services in transportation of persons with disability on invataks provided by suppliers for persons with disability on the terms of compensation of their cost by local executive bodies within the guaranteed amount according to the Code.".

3. Bring in the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 14, 2024 No. 194 "About approval of Rules of carrying out rotation of the first heads of the state organizations providing special social services" (it is registered in the Register of state registration of regulatory legal acts at No. 34501) the following changes:

in Rules of carrying out rotation of the first heads of the state organizations providing special social services, approved by the specified order:

change in Kazakh is made to the subitem 1) of Item 5, the text in Russian does not change;

"8. After provision of the created list the authorized body no later than 15 (fifteen) working days creates the materials on each head of the organization according to appendix to these rules received from Single digital system of the social and labor sphere and sends the Commissions for consideration.";

4. Bring in the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 27, 2024 No. 222 "About approval of qualification requirements and the list of documents to provision of special social services in the field of social protection of the population" (it is registered in the Register of state registration of regulatory legal acts at No. 34624) the following change:

These rules of rendering the state service "Licensing for Provision of Special Social Services" (further - Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" (further - the Law) and determine procedure for licensing on provision of special social services.";

in Rules of payment of the special social services of social protection of the population approved by the specified order:

5) to state the subitem in the following edition:

"5) the Portal of social services (further – the portal) – the digital object representing single point of access to goods and the services provided by suppliers for persons with disability on the terms of compensation of their cost by local executive bodies within the guaranteed amount according to the Code;";

"7) the Digital signature (further – the EDS) – the digital record (set of digital data) created with use of the closed key of the digital signature and means of the digital signature, confirmatory reliability of the electronic document, its accessory and invariance of content;";

"2) the Subjects providing special social services write out invoices electronically in digital system of electronic invoices according to the order of the Minister of Finance of the Republic of Kazakhstan of October 28, 2025 No. 629 "About approval of Rules of the statement of the invoice and its form" (it is registered in the Register of state registration of regulatory legal acts at No. 37241).";

11	Other requirements taking into account features of rendering the state service including rendered electronically and through the state corporation	1. Uslugopoluchatel obtains information on procedure and the status of rendering the state service in the mode of remote access by means of portal "personal account", and also single contact center. 2. List of the main requirements to rendering the state service "Document Creation on Rendering Special Social Services in the Centers of Rendering Special Social Services"

Service providers receive digital documents from service of digital documents through the realized integration on condition of the consent of the owner of the document provided by means of the subscriber number of cellular communication of the user registered on the portal by transfer of the one-time password or departure siding of the short text message as the answer to the notification of the portal.
