About approval of Rules of payment of special social services of social protection of the population

According to the paragraph third Item 2 of article 142 of the Social code of the Republic of Kazakhstan PRIKAZYVAYU:

1. Approve the enclosed Rules of payment of special social services of social protection of the population.

2. To provide to department of special social services of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

4. This order becomes effective since January 1, 2025 and is subject to official publication.

Rules of payment of special social services of social protection of the population

Chapter 1. General provisions

1. These rules of payment of special social services in the field of social protection of the population (further - Rules) are developed according to the paragraph third Item 2 of article 142 of the Social code of the Republic of Kazakhstan (further - the Code) and determine payment procedure of special social services in the field of social protection of the population.

2. In these rules the following concepts are used:

1) special social services - range of services, the bases providing to person (family) of condition for overcoming objectively breaking activity of the person and directed to creation of opportunities of participation in life of society, equal with other citizens;

2) the receiver of special social services (further - the receiver of services) - person (family) recognized as the person in need in special social services;

3) the subjects providing special social services - the physical and (or) legal entities occupied in the state and non-state sectors on provision of special social services based on the license for provision of special social services;

4) price limits on special social services - the maximum and minimum levels of rates for ensuring the guaranteed state cost of special social services;

5) the portal of social services (further - the portal) - the object of informatization representing single point of access to goods and the services provided by suppliers for persons with disability on the terms of compensation of their cost by local executive bodies within the guaranteed amount according to the Code.

6) local executive body concerning social protection and employment of the population (further - authorized body) - the local executive body of area, the cities of republican value, the capital, areas, cities of regional value determining the directions in the sphere of social protection and employment of the population;

7) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

3. Payment of the subjects providing special social services is performed by authorized body.

Chapter 2. Rules of payment of cost of special social services of social protection of the population

4. Payment of cost of special social services to the subject providing special social services is performed within rates for provision of the special social services approved by local executive bodies.

5. The subjects providing special social services provide the following supporting documents on the portal:

1) the act of the performed works (the rendered services) with appendix of sheets, in the form approved by the order of the Minister of Finance of the Republic of Kazakhstan of December 20, 2012 No. 562 "About approval of forms of source accounting documents" (it is registered in the Register of state registration of regulatory legal acts for No. 8265) (further - the order No. 562);

2) the Subjects providing special social services write out invoices electronically in information system of electronic invoices according to the order of the First deputy Premier-Ministra of the Republic of Kazakhstan - the Minister of Finance of the Republic of Kazakhstan of April 22, 2019 No. 370 "About approval of Rules of the statement of the invoice electronically in information system of electronic invoices and its forms" (it is registered in the Register of state registration of regulatory legal acts for No. 18583).

6. The subject providing special social services before acceptance by authorized body for consideration of documents on payment of special social services is allowed to withdraw documents with indication of the reason and to finish them.

7. The authorized body within 7 (seven) working days from the date of receipt in information system "E-social security" of the documents specified in Item 5 of these rules payment of special social services considers and accepts them or returns to the subject providing special social services on completion with indication of the reason.

In the "Private Office of the Subject Providing Special Social Services" module on the portal and on subscriber number of cellular communication of the subject, information on return of documents for completion goes.

8. The authorized body returns on completion to the subject providing special social services and (or) the subject providing special social services withdraws on completion for the following reasons:

1) representation of incomplete document package, specified in Item 5;

2) unauthenticity of the provided data in the documents specified in Item 5;

3) death of the receiver of services;

4) removal of disability of the receiver of services;

5) establishment of the third group of disability of the receiver of services in the conditions of hospital, semi-hospital or at home;
