1. Approve the enclosed rules of forming and maintaining the qualifier of digital objects.

2. Declare invalid the order of the acting minister on investments and development of the Republic of Kazakhstan of January 28, 2016 No. 135 "About approval of Rules of classification of objects of informatization and the qualifier of objects of informatization" (it is registered in the Register of state registration of regulatory legal acts for No. 13349).

3. To provide to department of policy of digital transformation of the Ministry of artificial intelligence and digital development of the Republic of Kazakhstan in the established legislative procedure:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of artificial intelligence and digital development of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submissions to Legal department of the Ministry of artificial intelligence and digital development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of artificial intelligence and digital development of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of forming and maintaining qualifier of digital objects

Chapter 1. General provisions

1. These rules of forming and maintaining the qualifier of digital objects (further - Rules) are developed according to the subitem 172) of Item 15 of the Regulations on the Ministry of artificial intelligence and digital development of the Republic of Kazakhstan and determine procedure for forming and maintaining the qualifier of digital objects.

2. In these rules the following concepts are used:

1) the Architectural and coordination center - the legal entity determined by the Government of the Republic of Kazakhstan;

2) technical means of processing and data storage - computer aids, including the server hardware, personal workstations, personal portable devices and storage systems of data;

3) the system-wide software - the software product intended for ensuring effective management of components of technical means, development and functioning of application software, service software products, digital systems and Internet resources;

4) system of artificial intelligence - the digital object functioning on the basis of one or several models of artificial intelligence;

5) means of seal and copying of documents - set scanning, copying and printers;

6) category - the generalized group of digital objects of the qualifier of digital objects intended for identification of digital object according to scope and its functional purpose;

7) the indicator of parameter of the characteristic of category - measure of assessment and measurement of parameter value of the characteristic of category;

8) the compound parameter of the characteristic of category - set of the homogeneous criteria combining several private parameters which characterize certain properties of digital object in one general parameter;

9) the characteristic of category - set of distinctive parameters of the qualifier of the digital objects characterizing digital object which total value determines class of digital object;

10) the parameter of the characteristic of category - the criterion of the qualifier of digital objects which is unambiguously determining functional, technical, quality or operational characteristics of digital object;

11) the server room and its engineering infrastructure - complex of the rooms intended for placement and functioning of the server, network hardware and equipment of the structured cable systems, and also means of communication, including devices of transfer of digital data, local area networks, means of ensuring of Internet access and the single transport circle of state bodies;

12) identification of digital object (further - identification) - determination of belonging of digital object to one of categories of the qualifier of digital objects for the purposes of further classification of digital object;

13) class of digital object - the graduated significance value of digital object appropriated by results of assessment of conformity to the scheme of classification of digital objects;

14) classification of digital object (further - classification) - set of actions for assignment of class to digital object;

15) the scheme of classification of digital objects - method of assessment of conformity of digital objects to requirements of class of digital object within certain category;

16) the qualifier of digital objects (further - the qualifier) - the systematized list of categories directed to identification, categorization, the description and accounting of digital objects.

Before carrying out classification of digital object his owner or the owner performs identification of this object by determination of its belonging to the corresponding category of the qualifier according to appendix 1 to Rules, with the subsequent assignment to object of the certain class reflecting the graduated level of its importance according to the scheme of classification according to appendix 2 to Rules. Chapter 2. Procedure for forming and maintaining qualifier of digital objects

3. Forming and maintaining the qualifier of digital objects are performed by authorized body in the field of digitalization (further - authorized body).

4. For forming of the qualifier of digital objects the authorized body sends to the Architectural and coordination center and the interested state bodies request in any form of submission of offers.

The architectural and coordination center and the interested state bodies represent offers to authorized body within ten working days from the date of receipt of the corresponding request.

The authorized body within five working days from the date of receipt of offers performs their consideration and generalization by results of which creates the project of the qualifier of digital objects.

5. Change of structure of categories, characteristics, parameters, indicators, evaluation criteria and schemes of classification is performed within maintaining the qualifier of digital objects.

6. Maintaining the qualifier of digital objects includes:

1) collection, consideration and generalization of offers on modification and (or) amendments in the qualifier of digital objects;

2) monitoring of practice of its application;

3) modification and (or) amendments in the qualifier of digital objects.

7. Offers of the Architectural and coordination center and the interested state bodies on modification and (or) amendments in the qualifier of digital objects go to authorized body and contain:

1) name of the initiator;

2) the description of the offered change;

3) reasons for need of its introduction;

4) data on digital objects to which the offer belongs;

5) assessment of possible legal, organizational, financial and technological effects;

6) the offered formulations.

8. Authorized body within fifteen working days from the date of registration of the offer:

1) considers the provided materials;

2) makes the decision on modification and (or) amendments or on offer variation.

9. In case of offer variation the authorized body sends to the initiator the motivated answer with indication of reasons for rejection.

10. The bases for updating of the qualifier of digital objects are:

1) change of the legislation of the Republic of Kazakhstan;

2) emergence of new types of digital objects or digital technologies;

3) change of architectural, technological or organizational approaches;

4) identification of gaps, duplication or ambiguity of categories and criteria;

5) impossibility of uniform determination of class of digital object;

6) results of monitoring and practice of use of the qualifier;

7) need of reduction of the qualifier in compliance with the international and national standards.
