About measures for implementation of the Presidential decree of the Republic of Kazakhstan of September 18, 2025 No. 997 "About measures for further enhancement of system of public administration"

According to the Presidential decree of the Republic of Kazakhstan of September 18, 2025 "About measures for further enhancement of system of public administration" the Government of the Republic of Kazakhstan DECIDES: No. 997

1. Approve enclosed:

1) Regulations on the Ministry of artificial intelligence and digital development of the Republic of Kazakhstan (further - the Provision);

2) changes and additions which are made to some decisions of the Government of the Republic of Kazakhstan.

2. Determine:

1) the Ministry of artificial intelligence and digital development of the Republic of Kazakhstan by authorized body in management of the corresponding industry (sphere) of public administration concerning the republican legal entities specified in Items 1, 2 and 3 appendices 1 to this resolution;

2) Space committee of the Ministry of artificial intelligence and digital development of the Republic of Kazakhstan by authorized body in management of the corresponding industry (sphere) of public administration concerning the republican legal entities specified in items 4 and the 5th appendices 1 to this resolution.

3. Recognize invalid some decisions of the Government of the Republic of Kazakhstan according to appendix 2 to this resolution.

4. To committee of state-owned property and privatization of the Ministry of Finance of the Republic of Kazakhstan to transfer in the procedure established by the legislation to the Ministry of science and the higher education of the Republic of Kazakhstan rights of possession and uses of the state block of shares of joint-stock company "National agency on development of innovations of "QazInnovations".

5. To the ministry of artificial intelligence and digital development of the Republic of Kazakhstan to take the necessary measures following from this resolution.

6. This resolution becomes effective after day of its first official publication, except for subitems 281), 282), 283), 284), 285) and 286) of Provision Item 15 which become effective since January 1, 2026.

Regulations on the Ministry of artificial intelligence and digital development of the Republic of Kazakhstan

Chapter 1. General provisions

1. The ministry of artificial intelligence and digital development of the Republic of Kazakhstan (further - the Ministry) is the state body of the Republic of Kazakhstan performing management and cross-industry coordination in spheres of the aerospace and electronic industry, scientific and technical development of the country, geodesy, cartography and spatial data, ensuring information security in spheres of informatization, "the electronic government", personal data and their protection, digital assets, project management and also in the field of communication, development of state policy in the sphere of rendering the state services and in data management (further - regulated spheres).

2. The ministry has departments:

1) republican public institution "Space committee";

2) republican public institution "Committee on information security";

3) republican public institution "Committee of telecommunications";

4) republican public institution "Committee of the state services";

5) republican public institution "Committee of artificial intelligence and data management".

3. The ministry performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

4. The ministry is legal entity in form of business of public institution, has seals with the image of the State Emblem of the Republic of Kazakhstan and stamps with the name in Kazakh, forms of the established sample, accounts in bodies of treasury according to the legislation of the Republic of Kazakhstan.

5. The ministry enters the civil relations from own name.

6. The ministry has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation of the Republic of Kazakhstan.

7. The ministry of questions of the competence of the procedure established by the legislation makes the decisions which are drawn up by orders of the head of the Ministry.

8. The structure and limit of the number of staff of the Ministry affirm according to the current legislation of the Republic of Kazakhstan.

9. Ministry location: Republic of Kazakhstan, 010000, city of Astana, area Esil, Prospekt Mang_l_k El, building No. 55/5.

10. This Provision is the constituent document of the Ministry.

11. Financing of activities of the Ministry is performed from the republican budget.

12. The ministry is forbidden to enter contractual relations with subjects of entrepreneurship regarding accomplishment of the obligations which are functions of the Ministry.

If the Ministry by legal acts is granted the right to perform the activities which are bringing in incomes, then the gained income goes to the government budget if other is not established by the legislation of the Republic of Kazakhstan.

Chapter 2. Tasks and powers of state body

13. Tasks:

1) forming and carrying out effective state policy in regulated spheres, and also development of the competitive aerospace industry and ensuring information security in the sphere of informatization, realization of state policy in the field of space activities, in the sphere of personal data and their protection, in the field of communication, including distribution and use of national resource in the field of communication, and also participation in limits of the competence in technical regulation, ensuring unity of measurements and the sphere of standardization in the field of communication and ensuring its realization, forming and ensuring development of information and communication infrastructure, geodesy, cartography and spatial data, the sphere of scientific and technical development of the country, effective development and functioning of the market of communication services;

2) implementation of management and cross-industry coordination of state bodies in the field of activity carried to competence of the Ministry;

3) public administration and the state control in regulated spheres;

4) providing within the competence of control of compliance with law of the Republic of Kazakhstan;

5) forming and development of space industry of the Republic of Kazakhstan;

6) creation of conditions for market grouping of space technologies and services;

7) creation legislative and the contractual legal base of space activities in the Republic of Kazakhstan;

8) coordination of works within the competence on lease of the Baikonur complex by the Russian Federation;

9) coordination in the field of mail and communication, and also regulation of activities in the field of mail in the territory of the Republic of Kazakhstan and the activities of persons providing services in the field of communication or using them;

10) implementation of management and cross-industry coordination in the sphere of informatization and "the electronic government";

11) implementation of cross-industry coordination on data management;

12) ensuring realization of state policy of data management;

13) implementation of cross-industry coordination of digital transformation of public administration;

14) forming and realization of state policy in the sphere of rendering the state services;

15) forming implementation, development and providing communications infrastructure of the Republic of Kazakhstan;

16) forming and realization of state policy in the field of distribution of radio-frequency range, and also effective use of radio frequencies and orbital line items of communication satellites;

17) international cooperation in regulated spheres within the competence according to the legislation of the Republic of Kazakhstan;

18) forming of state policy in spheres of information and communication technologies, communication and rendering the state services;

19) implementation of management of the corresponding industry (sphere) of public administration;

20) realization of state policy in the sphere of geodesy, cartography and spatial data;

21) participation in planning, monitoring, stimulation and development of innovative system;

22) participation in realization of state policy in the sphere of personal data and their protection;

23) implementation of state policy in the field of communication for effective functioning of the market of communication services;

24) implementation within the competence of state regulation and control of activities in communication;

25) forming and implementation of state policy in the sphere of project management;

26) forming and implementation of state policy in the sphere of artificial intelligence;

27) implementation within the competence of strategic, regulating, realizable and control functions in mail;

28) forming of state policy in the field of mail service on basis and in pursuance of the main directions of domestic and foreign policy of the state determined by the President of the Republic of Kazakhstan, and the main directions of social and economic policy of the state, its defense capability, safety, ensuring public order developed by the Government of the Republic of Kazakhstan according to the legislation of the Republic of Kazakhstan.

14. Powers:

1) rights:

adopts regulatory legal acts, obligatory for execution, within the competence;

requests and receives in the procedure established by the legislation from state bodies, the organizations, their officials necessary information and materials;

brings to the President and the Government of the Republic of Kazakhstan suggestions for improvement of activities in the spheres regulated by the Ministry;

makes offers on the conclusion of international treaties (agreements), holds negotiations with the relevant departments of foreign countries, the international organizations and foreign legal entities, signs contracts (agreements);

makes suggestions for improvement of system of homeland security;

brings officials, government employees, actions to the corresponding responsibility (or failure to act) who are led to violation of national interests, threat of homeland security of the Republic of Kazakhstan;

2) obligations:

use budgetary funds according to single budget classification, the concluded civil bargains, regulatory legal acts according to which budgetary funds are allocated;

provide timely decision making about distribution of the net income received by joint-stock company (limited liability partnership) and transfer of dividends by joint-stock company (limited liability partnership) (part of net income of limited liability partnership) on the stocks of joint-stock company owned by the state (shares in the authorized capital of limited liability partnership) within ten days from decision date the single shareholder (participant);

render the state services according to the subordinate regulatory legal acts determining procedure for rendering the state services.

15. Functions:

1) ensuring forming and realization of state policy in regulated spheres;

2) implementation of strategic, regulating, realizable and control functions;

3) development, coordination with authorized body in the sphere of permissions and notifications and acceptance of regulatory legal acts about approval of qualification requirements and the list of the documents confirming compliance to them in regulated spheres;

4) implementation of international cooperation in regulated spheres;

5) development and approval together with authorized body on entrepreneurship of checking sheets, criteria for evaluation of risk degree according to the Entrepreneurial code of the Republic of Kazakhstan;

6) implementation of counteraction to terrorism within the competence established by the legislation of the Republic of Kazakhstan;

7) development, coordination and approval within the competence of regulatory legal acts of regulated spheres;

8) implementation of cross-industry coordination in regulated spheres;

9) development of key indicators of activities in the sphere of digitalization of the first heads of the state bodies and their digital deputies approved by the Government of the Republic of Kazakhstan;

10) implementation of assessment of achievement of state bodies by the first heads and their digital deputies of key indicators of activities in the sphere of digitalization according to the technique approved by the Government of the Republic of Kazakhstan;
