About change of the resolution of Council of Ministers of the Republic of Belarus of January 25, 2019 No. 54
Based on part one of Item 8 of Article 45 and the paragraph of third subitem 1.2 of Item 1 of article 78 of the Law of the Republic of Belarus of July 17, 2018 "About regulatory legal acts" the Council of Ministers of the Republic of Belarus DECIDES: No. 130-Z
1. Bring in the resolution of Council of Ministers of the Republic of Belarus of January 25, 2019 No. 54 "About forecasting of effects of acceptance (edition) of regulatory legal acts" the following changes:
to state preamble and Item 1 in the following edition:
"Based on part one of Item 8 of Article 45 and the paragraph of third subitem 1.2 of Item 1 of article 78 of the Law of the Republic of Belarus of July 17, 2018 "About regulatory legal acts" the Council of Ministers of the Republic of Belarus DECIDES: No. 130-Z
1. Approve the Instruction for forecasting of effects of acceptance (edition) of regulatory legal acts it (is applied).";
To be reworded as follows the instruction for forecasting of effects of acceptance (edition) of regulatory legal acts approved by this resolution it (is applied).
2. Results of forecasting of effects of acceptance (edition) of regulatory legal acts which projects are prepared and sent for approval of the interested state bodies (organizations) before entry into force of this resolution are drawn up according to the requirements of the legislation existing before entry into force of this resolution. Modification of reasons for need of acceptance (edition) for such regulatory legal acts and financial and economic reasons to projects of these regulatory legal acts in connection with adoption of this resolution is not required.
3. Recognize invalid:
subitem 1.4 of Item 1 of the resolution of Council of Ministers of the Republic of Belarus of December 16, 2020 No. 728 "About change of resolutions of Council of Ministers of the Republic of Belarus";
item 4 of appendix to the resolution of Council of Ministers of the Republic of Belarus of June 27, 2025 No. 360 "About the automated information system on ensuring rule-making process (AIS "Rule-making")";
Item 28 of appendix 2 to the resolution of Council of Ministers of the Republic of Belarus of November 21, 2025 No. 658 "Questions of the Ministry of Sport of the Republic of Belarus".
4. This resolution becomes effective after its official publication.

1. This Instruction determines procedure of forecasting of effects of acceptance (edition) of regulatory legal acts (further if other is not established, – forecasting) for assessment:
possibilities of goal achievement of acceptance (edition) of regulatory legal act;
options of development of the public relations caused by acceptance (edition) of regulatory legal act and also if the regulatory legal act will not be adopted it (is published).
2. In this Instruction terms in the values established by the Law of the Republic of Belarus "About regulatory legal acts" are used.
3. Forecasting includes:
forecasting of financial and economic effects of acceptance (edition) of regulatory legal act;
assessment of the regulating impact of the project of regulatory legal act on conditions of implementation of business activity (further if other is not established, – assessment of the regulating impact);
forecasting of social effects of acceptance (edition) of regulatory legal act;
forecasting of ecological effects of acceptance (edition) of regulatory legal act;
forecasting of other effects which can result from acceptance (edition) of regulatory legal act.
4. Forecasting is carried out at stage:
planning of rule-making activities before entering of offers on preparation of the project of regulatory legal act into rule-making body (official) – the state body (organization) initiating preparation of the project of regulatory legal act;
preparation of the project of regulatory legal act before the direction of such project on approval – state bodies (organizations) responsible for preparation of the project of regulatory legal act.
5. In the presence in the project of regulatory legal act of the provisions which are not relating to the sphere of powers of the state body (organization) responsible for preparation of the project of regulatory legal act, forecasting (except for estimates of the regulating impact) such provisions it is carried out with participation of the state bodies authorized on regulation of the corresponding relations.
In the presence in the project of regulatory legal act of the provisions which are not relating to the sphere of powers of the state body (organization) responsible for preparation of the project of regulatory legal act, assessment of the regulating impact of such provisions on conditions of implementation of business activity is carried out with participation of the Ministry of Economics and other state bodies authorized on regulation of the corresponding relations.
The Ministry of Economics participates in implementation of assessment of the regulating impact of the provisions of regulatory legal act specified in part two of this Item within the main directions of the activities.
6. Forecasting is performed by the state body (organization) initiating or responsible for preparation of the project of regulatory legal act (further if other is not established, – the body responsible for forecasting), with inclusion of results of forecasting in reasons for need of acceptance (edition) for regulatory legal act in form according to appendix 1 and financial and economic reasons to the project of regulatory legal act in form according to appendix 2 taking into account the requirements established by this Instruction.
7. For realization of tasks of forecasting public discussions can be carried out, be created working groups, including interdepartmental, be studied offers of state bodies and other organizations, including scientific organizations, public associations, and also citizens on enhancement of the legislation and practice of law enforcement, to be analyzed information containing in mass media, reviews of practice of application of the legislation, to be performed exchange of information between the interested state bodies and other organizations or different ways of receipt of objective comprehensive information for carrying out forecasting can be used.
8. Information for carrying out forecasting can be obtained from the following sources:
the replies to the requests directed to the relevant state bodies (organizations) taking into account their competence;
legislation of the Republic of Belarus and foreign states;
international legal acts;
materials of court practice;
scientific research, publications, materials of scientific and practical seminars, conferences and meetings;
