RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

Some questions of the Ministry of Economics, environment and agricultural industry

The Cabinet of Ministers of Ukraine DECIDES:

1. Rename the Ministry of Economics of Ukraine into the Ministry of Economics, the environment and agricultural industry of Ukraine.

2. Approve Regulations on the Ministry of Economics, the environment and agricultural industry of Ukraine which is applied.

3. Liquidate:

The Ministry of Agricultural Policy and Food, having assigned its functions to the Ministry of Economics, the environment and agricultural industry;

The ministry of environment protection and natural resources, having assigned its functions to the Ministry of Economics, the environment and agricultural industry.

4. Determine that:

legal successor of property, the rights and obligations of the Ministry of Agricultural Policy and Food and Ministry of environment protection and natural resources liquidated according to Item 3 of this resolution is the Ministry of Economics, the environment and agricultural industry;

statement term creditors of the requirements in the Ministry of Agricultural Policy and Food and the Ministry of environment protection and natural resources constitutes two months from the date of entry into force of this resolution;

the term of carrying out liquidation of the Ministry of Agricultural Policy and Food and Ministry of environment protection and natural resources constitutes no more than six months from the date of entry into force of this resolution.

5. Form the commission on liquidation of the Ministry agrarian and food.

Approve as the chairman of said commission of department of agrarian development of the Ministry of Economics, the environment and agricultural industry of Akhidzhanov Bagrat Rafikovich.

6. Form the commission on liquidation of the Ministry of environment protection and natural resources.

Approve as the chairman of said commission of the state secretary of the Ministry of environment protection and natural resources Zadorozhny Alexander Vyacheslavovich.

7. To chairmen of the commissions specified in Items 5 and 6 of this resolution:

approve staff of the commissions;

provide implementation of the measures connected with liquidation of the Ministry of Agricultural Policy and Food and Ministry of environment protection and natural resources;

inform in six-months time the Cabinet of Ministers of Ukraine results of the carried-out work.

8. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

9. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

10. To the Ministry of Economics, environment and agricultural industry:

submit in accordance with the established procedure for consideration of the Cabinet of Ministers of Ukraine offers on entering into acts of the legislation of the changes following from this resolution;

together with the Ministry of Finance by preparation of offers on introduction of amendments to the Law of Ukraine "About the Government budget of Ukraine for 2025" to provide the expenses necessary for ensuring accomplishment of this resolution.

Regulations on the Ministry of Economics, environment and agricultural industry of Ukraine

1. The Ministry of Economics, the environment and agricultural industry (Ministry of Economics) is the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine.

The Ministry of Economics is the principal organ in system of the central executive bodies providing:

forming also realizes state policy of economic and social development, foreign trade, the state industrial policy (except strategic industries), the state price policy, state policy in the field of technical regulation, standardization, metrology and metrological activities, management of objects of state-owned property, realization of property (property rights, other assets) or the rights to it on the competitive beginnings in the form of auctions, in particular electronic, and control of its realization, intellectual property, public purchases, and also the state order on training of specialists, scientific, scientific and pedagogical and personnel, advanced training and retrainings of personnel, state policy in the field of protection of the surrounding environment, ecological and within the powers provided by the law, biological and genetic safety;

forming also realizes the state agrarian policy, state policy in the field of agricultural industry, concerning food security of the state, protection of the rights to plant varieties, seed farmings and pitomnikovodstvo, livestock production, crop production, development of the rural territories, gardening, wine growing, winemaking, hop-growing, food and processing industry (further - the sphere of agro-industrial production), in the field of geographical instructions of agricultural products and foodstuff, alcoholic drinks, and also in the field of the traditional guaranteed features, technical policy in the field of agro-industrial complex and mechanical engineering for agro-industrial complex, rural development, development of farming, agricultural cooperation, agricultural consultative activities, monitoring and fertility of soils on lands of agricultural purpose;

forming also realizes the state investment policy, the state innovative policy in real production sector, the state external economic policy, state policy in the field of development of entrepreneurship, public-private partnership;

forming and realization of state policy in the field of work, employment of the population, labor migration, employment relationships, social dialogue;

forming and realizing state policy in the field of ensuring chemical safety and management of chemical products;

forming also realizes state policy in the field of forest and hunting economy;

forming of state policy in the field of protection of plants;

forming of state policy in the field of quarantine of plants;

forming also realizes state policy in the field of organic production, the address and marking of organic products;

forming and realization of state policy in the field of the state reserves;

forming and realization of state policy in the field of the state export control;

forming and realization of state policy in the field of fishery and fish industry, protection, use and reproduction of water bioresources, regulation of fishery, food supply;

forming and realization of state policy in the field of land relations, land management, the state land cadastre, national infrastructure of geospatial data, land and cartographic activities, use and protection of lands;

forming and realization of state policy in the field of land reclamation and operation of the state water management subjects to complex appointment, intereconomic irrigating and drying systems;

forming also realizes state policy in the field of safety and separate indicators of quality of foodstuff;

forming also realizes state policy in the field of placement in the market of genetically modified organisms and genetically modified products;

forming and realization of state policy in the field of veterinary medicine;

forming and realization of state policy in the field of wellbeing of animals;

forming of state policy in the field of consumer protection, state policy on control of the prices, the State regulatory policy and state policy concerning licensing, authorization system, supervision (control) in the field of economic activity, development of water economy, management, use and reproduction of superficial water resources, geological studying and rational use of subsoil, supervision (control) in system of engineering facilities and innovative development of agro-industrial complex;

realization of state policy in the field of the organization and control of production of securities, documents of the strict reporting;

forming and realization of state policy in the field of industrial safety, labor protection, occupational health, the treatment of explosive materials, implementation of the state mountain supervision, implementation of the state supervision and control of observance of requirements of the legislation on work and employment of the population.

The Ministry of Economics is national coordinator who acts as single contact Item between state bodies and the European commission for ensuring general process of coordination of actions for assistance according to the Ukraine Facility tool (within components I, II and III) and ensuring protection of financial interests of the EU.

2. The Ministry of Economics in the activities is guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation.

3. The main objectives of Ministry of Economics is:

1) ensuring forming and realization:

state policy of economic and social development;

state price policy;

state policy in the field of development of entrepreneurship;

state policy in the field of technical regulation, standardization, metrology and metrological activities;

state policy in the field of public purchases;

the state order on training of specialists, scientific, scientific and pedagogical and personnel; advanced training and retraining of personnel;

state policy in the field of management of objects of state-owned property, in particular corporate laws of the state;

state policy in the field of public-private partnership;

the state investment policy, including on management of the state investments;

state policy on creation and functioning of industrial (industrial) parks (further - industrial parks);

state policy in the field of the state market supervision;

state policy on cooperation of Ukraine with the EU in the field of economy;

single external economic policy; politicians of integration of national economy into world economy; protection of the national producer in the domestic and foreign market;

state policy in the field of intellectual property;

to the state innovative policy in real production sector;

state policy in the field of work, employment of the population, labor migration, employment relationships, social dialogue;

state policy in the field of realization of property (property rights, other assets) or the rights to it on competitive basis in the form of auctions, in particular electronic, and control of its realization;

state policy in the field of protection of critical infrastructure in the sector of critical infrastructure for which the Ministry of Economics as sectoral body in the field of protection of critical infrastructure is responsible;

state policy in the field of geographical instructions of agricultural products and foodstuff, alcoholic drinks, and also in the field of the traditional guaranteed features;

state policy in the field of the state reserves;

state policy in the field of industrial safety, labor protection, occupational health, the treatment of explosive materials, implementation of the state mountain supervision, implementation of the state supervision and control of observance of requirements of the legislation on work and employment of the population;

state policy in the field of work, employment and labor migration, social dialogue;

state policy in the field of fishery and fish industry, protection, use and reproduction of water bioresources, regulation of fishery, food supply;

state policy in the field of land and cartographic activities, land relations, land management;

state policy in the field of the state land cadastre, the state supervision (control) in agro-industrial complex regarding observance of the land legislation, use and protection of lands of all categories and patterns of ownership, fertility of soils;

3) ensuring forming:

the state regulatory policy, state policy concerning licensing, authorization system, supervision (control) in the field of economic activity;

state policy on control of the prices;

state policy in the field of quarantine of plants;

state policy in the field of protection of plants;

state policy in the field of the state supervision (control) of observance of requirements of the legislation on rational use, reproduction and protection of natural resources, use and protection of lands, ecological safety, environmental impact assessment, protection and use of the territories and objects of natural and reserved fund, preserving, reproduction and unconvincing use of biological and landscape diversity, forming, preserving and use of ecological network, protection of atmospheric air, monitoring, the reporting and verification of emissions of greenhouse gases from installations, in the territory of Ukraine, regulation of ozone-depleting substances and the fluorinated greenhouse gases, and also concerning waste management (except the treatment of radioactive waste), ensuring chemical safety and management of chemical products, pesticides and agrochemicals, observance of requirements of biological and genetic safety for biological objects of the environment during creation, research and practical use of genetically modified organisms in open system;

state policy in the field of implementation of the state geological control;

state policy in the field of supervision (control) in system of engineering facilities of agro-industrial complex;

state policy in the field of development of national infrastructure of geospatial data;

4) participation in forming and realization of state policy in the field of provision of administrative services;

5) realization of state policy in the field of the organization and control of production of securities, documents of the strict reporting;

6) implementation of management of objects of state-owned property, in particular, in the field of technical regulation, standardization, metrology and metrological activities, intellectual property, agricultural industry.

4. Ministry of Economics according to the assigned its tasks:

1) generalizes practice of application of the legislation on the questions which are within the competence of Ministry of Economics develops suggestions for improvement of legal acts, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine and in accordance with the established procedure submits them for consideration of the Cabinet of Ministers of Ukraine;

2) develops drafts of the laws and other regulatory legal acts on the questions which are within the competence of Ministry of Economics;

3) performs preparation and representation to the Cabinet of Ministers of Ukraine of offers on application, cancellation and modification of special economic and other rationing measures (sanctions) submitted by the Cabinet of Ministers of Ukraine for consideration of the National Security and Defense Council of Ukraine according to the Law of Ukraine "About sanctions" and participates in forming, realization and carrying out monitoring of efficiency of the state sanctions policy on issues, being within the competence of Ministry of Economics;

4) participates in realization of the state sanctions policy as regards the questions connected with management of the assets of persons collected in the income of the state to which sanctions are applied;

5) is provided by interaction of the central executive bodies concerning preparation of offers on application, cancellation and modification of special economic and other rationing measures (sanctions) and monitoring of efficiency of implementation of sanctions;

6) is performed by normative legal regulation on the questions which are within the competence of Ministry of Economics;

7) approves drafts of the laws, other acts of the legislation arriving on approval from other ministries central and local executive bodies, prepares within the powers provided by the law, conclusions, notes and offers to drafts of the laws, other acts of the legislation which move for consideration of the Cabinet of Ministers of Ukraine, and drafts of the laws submitted for consideration of the Verkhovna Rada of Ukraine by other persons of law of the legislative initiative;

8) prepares within the powers provided by the law, notes and offers to the laws adopted by the Verkhovna Rada of Ukraine which arrived for the signature to the President of Ukraine;

9) determines the priority directions of development in the spheres which are within the competence of Ministry of Economics;

10) is provided by informing the public on forming and realization of state policy on the questions which are within the competence of Ministry of Economics provides explanations on realization of state policy on the questions which are within the competence of Ministry of Economics performs cooperation with institutes of civil society, provides participation of the public in forming and realization of state policy on the questions which are within the competence of Ministry of Economics promotes development of economic, agrarian and ecological education, ecological education of the population;

11) plans resources and measures, necessary for realization of state policy on questions, the Ministry of Economics which are within the competence;

12) is carried out by monitoring and estimation of results of realization of state policy on the questions which are within the competence of Ministry of Economics and develops on the basis of such assessment of the offer on its prolongation, adjustment or the termination;

13) performs issue of allowing documents, certificates, licenses, stipulated by the legislation;

Provides 14) within the powers provided by the law, implementation of the state supervision (control) in the spheres determined by the law;

15) is coordinated by activities of the central and local law enforcement agencies of the executive authority for questions which are within the competence of Ministry of Economics;

Provides 16) within the powers provided by the law, observance and the organization of accomplishment of the obligations undertaken by Ukraine according to international treaties signs the international agreements of Ukraine, provides implementation of international cooperation, studying, generalization and distribution of the international experience;

Accepts 17) within the powers provided by the law, participation in activities of the international organizations;

18) participates in implementation of measures for adaptation of the legislation of Ukraine to the legislation of the EU;

19) will organize work on attraction of the international financial and technical assistance, grants in certain spheres;

20) is coordinated by implementation of actions for project development (programs) of the international technical assistance, in particular tools and the mechanism of the external help, carries out monitoring of accomplishment and observance of sales terms of such projects (programs);

Performs 21) within the powers provided by the law, and according to the procedure, determined by the legislation, cooperation with the donor states and the international organizations for attraction of the international technical assistance in agro-industrial complex of Ukraine;

Provides 22) within the powers provided by the law, the organization of internal control and internal audit and their implementation in Ministry of Economics at the companies (in particular subjects of managing, the state share in which authorized capital exceeds 50 percent or constitutes the size which provides the right of decisive influence of the state to economic activity of such subjects of managing), in the organizations and the organizations relating to the sphere of management of Ministry of Economics;

25) determines economic bases of demographic and social development, develops forecasts of population of Ukraine for gender and age structure, the salary and the labor market;

26) performs organizational and methodical management and coordination of work on preparation of forecasts and programs of economic and social development of the Autonomous Republic of Crimea, areas, areas and the cities for the average and short-term periods;

27) is carried out by the analysis of condition of competitiveness of national economy, determines activities and develops actions for increase in its level;

28) is carried out by the analysis of influence of tools currency and course, monetary policy on development of economy, develops offers on increase in efficiency of their use for achievement of economic growth;

Develops 29) in the powers provided by the law, suggestions for improvement of the budget and tax legislation;

30) participates in forming and realization in the powers provided by the law, the state financial, budget and tax policy, creation of the Budget declaration;

30) carries out economic evaluation of the draft of the Government budget of Ukraine for the corresponding year and the analysis of the economic factors influencing its accomplishment;

31) is carried out by the analysis of influence on the market of banking services, currency, share, insurance and other markets of financial services on economic development of the state;
