I ORDER:

1. Bring in the order of the Minister of Internal Affairs of the Republic of Kazakhstan of March 30, 2020 No. 266 "About approval of Rules of rendering the state service "Certification to Stateless Persons and Residence Permits to the Foreigners Who Are Constantly Living in the Republic of Kazakhstan" and introduction of amendments to some orders of the Minister of Internal Affairs of the Republic of Kazakhstan" (registered in the Register of state registration of regulatory legal acts for No. 20195) the following changes and amendment:

add with the subitem 3) of the following content:

2. To provide to committee of migratory service of the Ministry of Internal Affairs of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan after its official publication;

3) within five working days after state registration of this order submission to Department of legal and rule-making coordination of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising deputy minister of internal affairs of the Republic of Kazakhstan and the Committee of migratory service of the Ministry of Internal Affairs of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of rendering the state service "Issue of Residence Permits to the Foreigners Who Are Constantly Living in the Republic of Kazakhstan"

Chapter 1. General provisions

1. These rules of rendering the state service "Issue of Residence Permits to the Foreigners Who Are Constantly Living in the Republic of Kazakhstan" (further – Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" (further – the Law) and determine procedure for rendering the state service in issue of residence permits to the foreigners who are constantly living in the Republic of Kazakhstan (further – the State service).

2. In these rules the following concepts are used:

1) permission to permanent residence – the document issued by law-enforcement bodies to immigrants in case of observance of the requirements established by the legislation of the Republic of Kazakhstan, and granting them the right to permanent residence in the territory of the Republic of Kazakhstan;

2) the residence permit of the foreigner in the Republic of Kazakhstan – the identity document of the foreigner in the territory of the Republic of Kazakhstan and confirming receipt by it of permission to permanent residence in the Republic of Kazakhstan (further – the residence permit);

3) the foreigner – person who is not the citizen of the Republic of Kazakhstan and having the evidence of the belonging to nationality of other state.

4) the form – the typographical form of the strict reporting with number and bar code which is the data carrier which is introduced in the centralized information database of the documentary population of the Republic of Kazakhstan (further – the database) and is used further for the purpose of identification of the personality with the issued documents;

5) the electronic form – the form with number and bar code for production of identity documents (except the certificate of the refugee), is drawn up and filled in by means of digital system "The registration Item "Documentation and Registration of Foreigners" (further – RP DRI).

Chapter 2. Procedure for rendering the state service

3. For receipt of the state service the physical persons (further – uslugopoluchatel) who got permission to permanent residence in the Republic of Kazakhstan address to territorial authorities of police (further – the service provider) in non-commercial joint-stock company "The Government for Citizens state corporation (further – the State corporation) at the place of residence.

The main requirements to rendering the state service are stated in the List of the main requirements to rendering the state service according to appendix 1 to these rules (further – the List).

Samples of the photos and signatures in case of document creation proving the identity of the population of the Republic of Kazakhstan are stated in annex 2 to Rules of rendering the state service "Issue of Passports, Identity Certificates to Citizens of the Republic of Kazakhstan", approved by the order of the Minister of Internal Affairs of the Republic of Kazakhstan of March 30, 2020 No. 267 (it is registered in the Register of state registration of regulatory legal acts for No. 20192).

4. According to the Law of the Republic of Kazakhstan "About personal data and their protection" the service provider receives the written consent of uslugopoluchatel to use of the data which are the secret protected by the law, containing in digital systems in form according to appendix 2 to these rules if other is not provided by the laws of the Republic of Kazakhstan.

The data confirming registration at the place of residence of the documented face irrespective of the reason of document creation, proving the identity, the service provider receives from the RP DRI digital system.

Execution of electronic forms on production of identity documents, is performed by the service provider in the State corporation on workplaces by means of RP DRI on which the surname, name, middle name (is entered in case of its availability) and position of the service provider.

Identity documents, can be provided by uslugopoluchatel in case of receipt of subspecies of services in the original or electronic type, received by means of service of digital documents (further – digital form), according to the List.
