About approval of Rules of rendering the state services in questions of documentation and registration of the population of the Republic of Kazakhstan

According to the subitem 1) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services", PRIKAZYVAYU:

1. Approve:

1) Rules of rendering the state service "Issue of Passports, Identity Certificates to Citizens of the Republic of Kazakhstan" according to appendix 1 to this order;

2) Rules of rendering the state service "Registration at the Place of Residence of Citizens of the Republic of Kazakhstan" according to appendix 2 to this order;

3) Rules of rendering the state service "Removal from Registration at the Place of Residence of the Population of the Republic of Kazakhstan" according to appendix 3 to this order;

4) Rules of rendering the state service "Submission of the Data Confirming Registration on the Permanent Residence in the Settlement of the Border Territory" according to appendix 4 to this order;

5) Rules of rendering the state service "Temporary Registration in the Place of Temporary Stay (Accommodation) of Citizens of the Republic of Kazakhstan" according to appendix 5 to this order;

6) Rules of rendering the gosuchdarstvenny service "Permanent Registration at the Place of Residence of the Foreigners and Stateless Persons Who Are Constantly Living in the Republic of Kazakhstan" according to appendix 6 to this order;

7) Rules of rendering the state service "Temporary Registration at the Place of Residence of the Foreigners and Stateless Persons Who Are Constantly Living in the Republic of Kazakhstan" according to appendix 7 to this order;

8) Rules of rendering the state service "Temporary Accounting in the Place of Stay of the Foreigners and Stateless Persons Who Received the Status of Person Who Is Looking for Shelter or the Refugee" according to appendix 8 to this order.

2. Recognize invalid some orders of the Ministry of Internal Affairs of the Republic of Kazakhstan according to appendix 5 to this order.

3. To provide to committee of migratory service of the Ministry of Internal Affairs of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising deputy minister of internal affairs of the Republic of Kazakhstan and the Committee of migratory service of the Ministry of Internal Affairs of the Republic of Kazakhstan (Kabdenov M. T.).

4. This order becomes effective after ten calendar days after day of its first official publication.

to the Order of the Minister of Internal Affairs of the Republic of Kazakhstan of March 30, 2020 No. 267

Rules of rendering the state service "Issue of Passports, Identity Certificates to Citizens of the Republic of Kazakhstan"

Chapter 1. General provisions

1. These rules of rendering the state service "Issue of Passports, Identity Certificates to Citizens of the Republic of Kazakhstan" (further - Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" and determine procedure for rendering the state service in issue of passports, identity certificates to citizens of the Republic of Kazakhstan (further – the State service).

2. In these rules the following concepts are used:

1) individual identification number (further – IIN) - the unique number created for physical person;

2) the form – the typographical form of the strict reporting with number and bar code which is the data carrier which is introduced in the centralized information database of the documentary population of the Republic of Kazakhstan (further – the database) and is used further for the purpose of identification of the personality with the issued documents;

3) the electronic form – the form with number and bar code for production of identity documents (except the certificate of the refugee), is drawn up and filled in by means of information systems "The registration Item "Documentation and Registration of the Population" (further – RP DRN);

4) the digital signature – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content (further - the EDS);

5) Single contact center - the legal entity determined by authorized body in the sphere of rendering the state services, performing functions of directory service on provision to uslugopoluchatel of information on questions of rendering the state and other services and also to state bodies - information on questions of rendering information and communication services;

6) web portal of "the electronic government": www.egov.kz (further – the Portal) – the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;

7) dactyloscopic registration – the activities performed by authorized state bodies in the sphere of dactyloscopic and (or) genomic registration on collection, processing, protection of dactyloscopic information, establishment or confirmation of the identity of the person;

8) The Government for Citizens state corporation (further – the State corporation) – the legal entity created according to the decision of the Government of the Republic of Kazakhstan for rendering the state services according to the legislation of the Republic of Kazakhstan, the organization of work on reception of applications on rendering the state services and issue of their results to uslugopoluchatel by the principle of "one window", ensuring rendering the state services electronically.

Chapter 2. Procedure for rendering the state service

3. For receipt of the state service physical persons (further – uslugopoluchatel) address to territorial authorities of police (further – the service provider) in the State corporation and represent document package according to the list provided by the List of the main requirements to rendering the state service according to appendix 1 to these rules (further – the Requirement to rendering the state service).

Samples of the photos and signatures in case of document creation proving the identity of the population of the Republic of Kazakhstan are stated in annex 2 to these rules.

4. The service provider receives the written consent of uslugopoluchatel to use of the data which are the secret protected by the law, containing in information systems in form according to appendix 3 to these rules if other is not provided by the laws of the Republic of Kazakhstan.

Documents acceptance and issue of passports, identity certificates to uslugopoluchatel is performed in the place of permanent registration of uslugopoluchatel, and also in the place of its actual stay (by the exterritorial principle) in case of loss of the passport and (or) the identity certificate, their replacement in connection with expiration, change of surname according to the conclusion (termination) of scrap, unfitness to further use, modification of documents, receipt of the passport of the citizen of the Republic of Kazakhstan for the first time based on the identity certificate of the citizen of the Republic of Kazakhstan, receipt of the passport and (or) identity certificate of the citizen of the Republic of Kazakhstan for the first time by minor children based on the certificate of birth.

The data confirming registration at the place of residence of the documented face irrespective of the reason of document creation, proving the identity, the service provider receives from information system RP DRN.

Execution of electronic forms on production of identity documents, is performed by the service provider in the State corporation on workplaces by means of RP DRN on which the surname, name, middle name (is entered in case of its availability) and position of the service provider.

Identity documents, can be provided by uslugopoluchatel in case of receipt of subspecies of services in the original or electronic type, received by means of service of digital documents (further – digital form), according to Requirements to rendering the state service to these rules.

In case of absence at uslugopoluchatel of the original certificate about the birth or its digital form confirmation of data on the birth, and also the made changes, amendments and corrections in the birth record, the service provider receives in RP DRN according to the birth record received from information system "The registration Item "ZAGS" within the integration interaction (realized on September 20, 2020).

5. In case of reception of an application the coupon of registration of the request of services is issued to the receiver in form according to appendix 4 to these rules, or the receipt on receipt of the identity document separated the form of the form after its filling.

In case of representation of incomplete document package the refusal in reception of an application, in form according to appendix 5 to these rules is issued to uslugopoluchatel.

In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays reception of applications and issue of results of rendering the state service is performed the next working afternoon, according to Item 7 of the Requirement to rendering the state service.

6. By provision uslugopoluchately complete document package to the service provider in the State corporation - the staff of department (department, group) migratory service city, district, district (in the city), settlement management (department) of law-enforcement bodies (further – compulsory health insurance), it is performed:

check according to the database (identification of the personality, registration availability at the place of residence), pronouncement of the resolution on the case of administrative offense on part one of article 492 of the Code of the Republic of Kazakhstan "About administrative offenses" (further – the Code), creation of the administrative report on part two, third, fourth and fifth article 492 of the Code;

dactyloscopic registration with the consent of uslugopoluchatel according to the procedure established by the Rules of carrying out dactyloscopic and genomic registration approved by the order of the Minister of Internal Affairs of the Republic of Kazakhstan of September 30, 2024 No. 730 "About some questions of carrying out dactyloscopic and genomic registration in the Republic of Kazakhstan" (registered in the Register of state registration of regulatory legal acts for No. 35161 (in case of refusal from passing of dactyloscopic registration, the employee passes to registration of the electronic form into RP DRN).

registration of the electronic form in RP DRN and the direction on the stage of collection of graphical information (the photo and the signature) performed by employees of the State corporation;

filling of the electronic form and assurance of the EDS;

putting down of personal code, date and the signature when filling the form (it is drawn up with departure in the place of stay by the investigative arrested and persons serving sentence in places of detention to persons having complete or partial loss of capability to perform self-service, and also in case of the address of citizens of RK, in connection with exchange of passports of the former USSR of sample of 1974, based on certificates of birth of persons 18 years of age or over, in the absence of RP DRN, in case of failures of communication channels with RP DRN or breakdown of their equipment).

After registration of the electronic form the uslugopoluchatel goes to bank of the second level for implementation of payment of the state service and penalty for administrative offense.

Also in case of desire the uslugopoluchatel can pay service of the accelerated production.

Information on the accepted payments for the accelerated production of identity documents arrives in the Republican state company on the right of economic maintaining "The information and production center" of the Ministry of Internal Affairs of the Republic of Kazakhstan (further – RGP "IPTs") from banks of the second level in real time ("online").

In case of receipt of the state service on the form the uslogodatel attaches the document on payment for the accelerated issue of the document to the form;

forming of the register on sending the forms which are drawn up in district (city) law-enforcement bodies in triplicate first of which joins nomenclature case, second and third - are transferred together with forms to the control of migratory service of Department of police of area, the cities of Astana, Almaty and Shymkent (further – UMS). The drawn-up electronic form is transferred for check to UMS by means of RP DRN without creation of the register.

Staff of UMS performs verification of the electronic forms which are drawn up by means of RP DRN, and also forms on paper on correctness and justification of filling to the requirements established by the order of the Minister of Internal Affairs of the Republic of Kazakhstan of May 31, 2016 No. 583 "About approval of form and Rules of registration, filling, accounting, storage, transfer, expenditure, destruction of the form for production of identity documents (except the certificate of the refugee)" (it is registered in the Register of state registration of regulatory legal acts for No. 13911).

In case of detection of discrepancy of the data containing in the electronic form, available in the database, discrepancies of codes of registration, low-quality graphical information, electronic forms return to RP DRN without execution to dooformleniye with indication of return reason.

In the presence of the bases provided in Item 9 of the Requirement to rendering the state service the service provider notifies uslugopoluchatel on the provisional solution about refusal in rendering the state service, and also time and the place (method) of carrying out hearing for opportunity to express to uslugopoluchatel line item according to the provisional solution, except as specified registrations on 1 category of urgency for the cities of Astana, Almaty, Shymkent and Aktobe.

Uslugopoluchatel is notified by the service provider on hearing at least in 3 (three) working days prior to completion of term of rendering the state service. Hearing is carried out no later than 2 (two) working days from the date of the notification.

By results of hearing the service provider makes the decision on the direction of the electronic form after completion on production of identity documents or refusal in rendering the state service if hearing with uslugopoluchatel did not take place.

In case of correctness and justification of filling electronic forms pass to the following stage RP DRN, and on forms the summary register in triplicate is created, first of which second and third joins nomenclature case together with district registers and forms (on paper) go to Committee of migratory service (further – KMS).

The staff of KMS the summary registers received from UMS in the book of accounting of the entering summary registers of forms are registered, check of correctness and justification of filling of forms, check according to the database regarding stay in search is performed.

In case of correctness and justification of filling, and also absence on search accounting electronic forms go to fabrication stage of identity documents to RGP "IPTs".

The first copy of the summary register with district registers of forms joins nomenclature case, is registered, the second copy of the summary register is certified by the signature of KMS and goes together with district registers of forms within 1 working day to RGP "IPTs".

RGP "IPTs" performs verification of the arrived electronic forms and in case of detection of discrepancy of the data entered in electronic forms, including the identity documents processed to the accelerated production, with data in the database, low-quality graphical information (the photo and signatures) return to stage to RP for error correction.

In case of lack of violations, documents are made and go together with the register of the made documents through the service provider:

1) on the accelerated production – in the State corporation;

2) made in general procedure - in UMS.
