About introduction of amendments to some orders

I ORDER:

1. Approve the enclosed list of some orders to which changes are made (further – the List).

2. To provide to committee on regulation of natural monopolies of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its placement on Internet resource of the Ministry of national economy of the Republic of Kazakhstan after day of its first official publication.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days, except for paragraphs of the fourth and fifth Item 1, of paragraphs of the tenth, eleventh, twelfth, thirteenth, fourteenth, fifteenth, sixteenth, seventeenth, eighteenth, nineteenth Item 2, of paragraphs of the third, fourth, fifth, sixth, seventh, eighth, ninth, tenth, eleventh, twelfth, thirteenth, fourteenth, fifteenth, nineteenth, twentieth, twenty first Item 3, 4 and 5 Lists which become effective since July 12, 2026 and are subject to official publication.

The list of some orders to which changes are made

1. Bring in the order of the Minister of national economy of the Republic of Kazakhstan of January 29, 2015 No. 60 "About approval of qualification requirements and the list of the documents confirming compliance to them for activities for purchase of electrical energy for the purpose of power supply, operation of trunk gas pipelines, oil pipelines, oil pipelines" (it is registered in the Register of state registration of regulatory legal acts for No. 10598) the following changes:

in Qualification requirements and the list of the documents confirming compliance to them for activities for purchase of electrical energy for the purpose of power supply, operation of trunk gas pipelines, oil pipelines, the oil pipelines approved by the specified order:

in Section 1. "For activities for purchase of electrical energy for the purpose of power supply":

2. in the Standard agreement on provision of services of water supply and (or) water disposal approved by the specified order:

state Item 11 in the following edition:

"11. Acceptance of production sewage of the Consumer in systems of water disposal of the Supplier is performed according to Regulations of Admission of sewage in centralized systems of water disposal of the settlements approved by the order of the Minister of Industry and construction of the Republic of Kazakhstan of October 15, 2025 No. 436 (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan for No. 37153).";

state Item 18 in the following edition:

"18. Technical and metrological characteristics of the metering device at the Consumer shall correspond to real amounts of water consumption.

The supplier performs the admission of metering devices to operation according to the Rules of the choice, installation and operation of devices and systems of accounting of water in water supply systems and water disposals of settlements approved by the order of the Minister of Industry and construction of the Republic of Kazakhstan of August 8, 2025 No. 295 (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan for No. 36616).";

8) of Item 27 to state the subitem in the following edition:

"8) to provide local sewage treatment in the cases provided by Regulations of Admission of sewage in centralized systems of water disposal of settlements, approved by the order of the Minister of Industry and construction of the Republic of Kazakhstan of October 15, 2025 No. 436 (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan for No. 37153).";

in the Standard agreement on provision of services on oil transportation approved by the specified order:

4) of Item 8 to state the subitem in the following edition:

"4) to provide the copy of the complete customs declaration on oil within 5 (five) calendar days from the date of their registration.

The complete customs declaration on oil in the form of the electronic document on which in digital systems of tax authorities there is notification of customs authorities on the actual export of oil, is also the document confirming oil export. In the presence of the customs declaration on oil in the form of the electronic document submission of the complete customs declaration on oil is not required. At the same time, the Consumer notifies the Supplier in the terms specified in this subitem on availability in digital systems of tax authorities of the notification of customs authorities on the actual export of oil.";

in the Standard agreement on rendering services of the high-level railway system approved by the specified order:

state Item 17 in the following edition:

"17. Final settlement on the rendered services of the high-level railway system is made monthly for the actual amount no later than the 15th following after month of rendering services of the high-level railway system based on bilateral acts for the actual amount of the rendered services of the high-level railway system, and also the electronic invoice shown by the Operator which is written out by the Operator by means of the digital system "Electronic Invoices.";

in the Standard agreement on rendering services in the organization of balancing of production consumption of electrical energy approved by the specified order:

6) of Item 5 to state the subitem in the following edition:

"6) creation of own integration of digital systems of subjects of the markets.";

3. Bring in the order of the Minister of national economy of the Republic of Kazakhstan of June 5, 2020 No. 47 "About approval of Rules of rendering the state service "Licensing for Activities for Purchase of Electrical Energy for the purpose of Power Supply" (it is registered in the Register of state registration of regulatory legal acts for No. 20843) the following changes:

in the Rules of rendering the state service "Licensing for Activities for Purchase of Electrical Energy for the purpose of Power Supply" approved by the specified order:

in Item 3:

2) to state the subitem in the following edition:

"2) Single contact center – the legal entity determined by the Government of the Republic of Kazakhstan, performing functions of directory service on provision to uslugopoluchatel of information on questions of rendering the state and other services and also to state bodies – information on questions of rendering digital services;";

7) to state the subitem in the following edition:

"7) digital monitoring system of rendering the state services – the digital system intended for automation and monitoring of process of rendering the state services including rendered through The Government for Citizens State corporation;";

10) to state the subitem in the following edition:

"10) the web portal of "the digital government" – the digital system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;";

state item 4 in the following edition:

"4. Uslugopoluchatel for obtaining or renewal of the license addresses to the service provider through the web portal of "the digital government" www.egov.kz (further – the portal) and provides the documents stated in Item 8 of the List of the main requirements to rendering the state service "Licensing for Activities for Purchase of Electrical Energy for the purpose of Power Supply" according to appendix 6 to these rules.";

the second Item 8 to state part in the following edition:

"Actions of subitems 2) and 4) of part one of this Item do not extend to cases when changes of legal address of the individual entrepreneur licensee happened in connection with change of the name of settlements, names of streets according to requirements of the Law of the Republic of Kazakhstan "About the administrative-territorial device of the Republic of Kazakhstan". Such address modifications of licensees and subject of the license are performed by means of integration of the state digital systems.";

the fifth Item 11 to state part in the following edition:

"Information on procedure for rendering the state services, and also the made changes and (or) additions in the subordinate regulatory legal acts determining procedure for rendering the state service, the service provider goes to Single contact center, according to the subitem 13) of article 10 of the Law of the Republic of Kazakhstan "About the state services" and to the operator of information and communication infrastructure of "the digital government", the performing reception of applications and issue of results of rendering the state service.";

state Item 11-2 in the following edition:

"11-2. For receipt of approval of territorial subdivision of department of authorized body in the field of power industry regarding compliance of uslugopoluchatel to requirements about availability at least thirty thousand directly attached consumers of electrical energy, including through all-house networks, except for legal entities, hundred percent of shares (share in the authorized capital) which belong to the state, being in utility property and performing at the same time activities according to subitems 3), 4) and 14) Item 1 of article 5 of the Law of the Republic of Kazakhstan "About natural monopolies" for which availability of twelve thousand directly attached consumers of electrical energy is sufficient, the executive in charge of the service provider within two working days from the date of document registration of uslugopoluchatel on receipt of the license sends to territorial subdivision of department of authorized body in the field of power industry the request and documents provided in subitems 5) and 6) of Item 8 of the List of the main requirements to rendering the state service "Licensing for Activities for Purchase of Electrical Energy for the purpose of Power Supply".

The territorial subdivision of department of authorized body in the field of power industry based on request of allowing body considers the request and the submitted documents of uslugopoluchatel within 5 working days by carrying out allowing control according to the procedure of visit and (or) challenge of uslugopoluchatel, according to Item 2 of article 51 of the Law of the Republic of Kazakhstan "About permissions and notifications" with representation to the service provider of the conclusion about compliance or discrepancy of the applicant to qualification or allowing requirements.";

2) of Item 12 to state the subitem in the following edition:

"2) not provision or inadequate execution of the copy of the documents containing information on changes, which formed the basis for renewal of the license and (or) appendix to the license, except for documents from which information contains in the state digital systems;";

appendices 1, of 2, of 4, 5 and 6 to state editions according to appendices 1, of 2, of 3, 4 and 5 to this List.

4. Bring in the order of the Deputy prime minister – the Minister of national economy of the Republic of Kazakhstan of August 12, 2025 No. 78 "About approval of Rules of subsidizing of rate of remuneration on the loans obtained by subjects of natural monopolies and also on the government securities issued by local executive bodies on the projects realized within the national project on upgrade of energy and utility sectors" (it is registered in the Register of state registration of regulatory legal acts for No. 36613) the following changes:

in Rules of subsidizing of rate of remuneration on the loans obtained by subjects of natural monopolies and also on the government securities issued by local executive bodies on the projects realized within the national project on upgrade of the energy and utility sectors approved by the specified order:

1) of Item 2 to state the subitem in the following edition:

"1) digital system – electronic platform of purchases of the national project on upgrade of energy and utility sectors.";

state Item 16 in the following edition:

"16. The borrower for receipt of subsidizing submits the electronic application – the questionnaire for receipt of subsidy (further – the electronic statement) according to appendix 2 to these rules, through digital system with the subsequent transfer by means of integration into electronic document management system of the financial agent to which the list of documents, according to appendix 3 to these rules is attached.";

state Items 19 and 20 in the following edition:

"19. In case of incompleteness of the documents submitted by the borrower, the financial agent refuses consideration of the electronic statement with the notification by means of digital system.

20. The financial agent following the results of consideration of the electronic statement sends to the borrower by means of digital system the letter notification on the made decision in electronic form, certified by the digital signature (further – the EDS), within 3 (three) working days from decision date. At the same time financial agent directs the letter notification on the made decision of BVU and (or) IFI and (or) JSC BRK. The decision of the financial agent is effective 6 (six) months from the date of its acceptance.";

state Item 45 in the following edition:

"45. The financial agent within 5 (five) working days from the date of receipt of the decision of the financial operator on subsidizing suspension, directs the letter notification THIS, to the financial and technical operator, the Tariff regulator, local executive body and authorized body of the respective sphere by means of Digital system, and also BVU and (or) IFI and (or) JSC BRK with indication of the subsidizing suspension reasons.";

state Item 48 in the following edition:

"48. The financial agent within 3 (three) working days from the date of receipt of the relevant decision of the financial operator directs the letter notification on subsidizing renewal THIS, to financial and technical operators, the Tariff regulator, local executive body and authorized body of the respective sphere by means of digital system, and also BVU and (or) IFI and (or) JSC BRK with indication of the subsidizing renewal reasons.";

state Item 52 in the following edition:

"52. In case of decision making about the termination of subsidizing of loan (credit), the financial agent unilaterally terminates the agreement of subsidizing on loans according to the civil legislation of the Republic of Kazakhstan and terms of the contract with the notification on termination of the borrower and BVU and (or) IFI and (or) JSC BRK, and also THIS, financial and technical operators, the tariff regulator, local executive body and authorized body of the respective sphere by means of Digital system, with indication of the subsidizing termination reasons.";

state Item 68 in the following edition:

"68. The financial agent and the Creditor on monthly basis provide from the Borrower of data on application of funds, the course of construction and other information, and also their reflection in digital system of the technical operator.".

5.
