1. Approve the enclosed Rules of consideration of requests of subjects of natural monopolies for determination of funding mechanism and (or) subsidizing of part of rate of remuneration on loan on projects of upgrade, construction of energy and municipal infrastructure.

2. To provide to committee on regulation of natural monopolies of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its placement on Internet resource of the Ministry of national economy of the Republic of Kazakhstan after day of its first official publication.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of consideration of requests of subjects of natural monopolies for determination of funding mechanism and (or) subsidizing of part of rate of remuneration on loan on projects of upgrade and construction of energy and municipal infrastructure

Chapter 1. General provisions

1. These rules of consideration of requests of subjects of natural monopolies on loan on projects of upgrade and construction of energy and municipal infrastructure (further - Rules) are developed for determination of funding mechanism and (or) subsidizing of part of rate of remuneration according to subitem 33-1) of article 8 of the Law of the Republic of Kazakhstan "About natural monopolies" and determine procedure for consideration of requests of subjects of natural monopolies for determination of funding mechanism and (or) subsidizing of part of rate of remuneration by loan on projects of upgrade and construction of energy and municipal infrastructure.

2. The basic concepts used in these rules:

1) the financial operator - joint-stock company "National managing holding "Bayterek";

2) the technical operator - the legal entity with absolute participation of the state in the authorized capital determined by the Government of the Republic of Kazakhstan as the technical operator in the sphere of the housing relations and housing and communal services of the national project on upgrade of energy and municipal sectors;

3) the tariff regulator - authorized body in the sphere of regulation of natural monopolies;

4) electronic platform of purchases of the national project on upgrade of energy and municipal sectors (further - electronic platform) - the information system providing carrying out electronic procurement within implementation of the national project on upgrade of energy and municipal sectors, providing electronic services in providing point of access for purchase of goods, works and services, the conclusions of the agreement on "turnkey" construction and also selection and monitoring of projects within implementation of the national project on upgrade of energy and municipal sectors;

5) loan - the money provided to the borrower at the expense of the funds raised from banks of the second level, international financial institution, Development Bank of Kazakhstan joint-stock company or by placement of government securities (bonds) by local executive bodies on the terms of urgency, the paid nature and recoverability;

6) the subject of natural monopoly - the individual entrepreneur or the legal entity providing to consumers regulated services;

7) financial institution - bank of the second level and (or) international financial institution which are potentially interested in participation in financing of projects;

8) the affiliated organizations of financial operator - Development Bank of Kazakhstan joint-stock company, Kazakhstan Housing Company joint-stock company, "Housing Construction Savings Bank Otbasy Bank" joint-stock company, "Export Credit Agency of Kazakhstan" joint-stock company, Qazaqstan Investment Corporation joint-stock company, joint-stock company "Business Development Fund "Lady", Agrarian Credit Corporation joint-stock company;

9) the project - the project of upgrade and construction of energy and municipal infrastructure within implementation of the national project on upgrade of energy and municipal sectors;

10) the request - the preliminary application of the subject natural monopolies and local executive bodies on the projects participating in upgrade and construction of energy and municipal infrastructure within implementation of the national project on upgrade of energy and municipal sectors;

11) authorized state body in the respective sphere - the central executive body performing management in the sphere of the housing relations and housing and communal services and/or the central executive body performing management and cross-industry coordination in the field of power system and the state body performing management in the field of power industry.
