About procurement procedure of goods (works, services) at the expense of own means

For the purpose of enhancement of regulation of the relations in the field of purchases of goods (works, services) at the expense of own means and based on the paragraph of the seventh of article 11 of the Law of the Republic of Belarus of July 23, 2008 "About Council of Ministers of the Republic of Belarus" the Council of Ministers of the Republic of Belarus DECIDES: No. 424-Z

1. Approve Regulations on procurement procedure of goods (works, services) at the expense of own means it (is applied).

2. Determine that:

2.1. operation of this resolution extends on:

state bodies, national associations, the state unitary enterprises, other legal entities whose property is in state-owned property of members of holdings with participation of the state, economic societies, more than 25 percent of shares (share in authorized funds) of which belong to the Republic of Belarus and (or) its administrative and territorial units or the organizations which property is in state-owned property, except for of operators of cellular mobile telecommunication, the conducting procurements in the territory of the Republic of Belarus if other is not established by legal acts, decisions of the President of the Republic of Belarus, resolutions of Council of Ministers of the Republic of Belarus;

legal entities and the individual entrepreneurs (realizing the types of activity permitted for implementation as the individual entrepreneur (further – individual entrepreneurs), the goods (works, services) conducting procurement fully or partially at the expense of the money arriving on the current (settlement) bank account of public institution "Operator of secondary material resources" with the special mode of functioning (further – the special account of public institution "Operator of secondary material resources");

2.2. has the right to establish features * applications of the Regulations on procurement procedure of goods (works, services) at the expense of own means approved by this resolution:

National Bank – for the procurements conducted through own means;

National academy of Sciences of Belarus – for the procurements conducted through own means, and also for the procurements conducted through own means the organizations subordinated to it, created with its participation;

Administration of the President of the Republic of Belarus – for the procurements conducted through own means, and also for the procurements conducted through own means subordinated to it (entering its system) the state organizations and economic societies, shares (share in authorized funds) of which are in management (operational management, economic maintaining) of Administration of the President of the Republic of Belarus, the specified state organizations;

The state military-industrial committee – for the procurements conducted through own means by the organizations entering its system;

Committee for State Security – for the procurements conducted through own means by the state security agencies and military units and the organizations subordinated to them;

2.3. operation of this resolution, except for Item 19 of the Regulations on procurement procedure of goods (works, services) at the expense of own means approved by this resolution does not extend to purchases of goods (works, services) according to appendix 1;

2.4. electronic trading platforms for holding procedures of purchases on them at the expense of own means are:

electronic trading platform of the republican unitary enterprise "National Center of Support of Export" (the address on the global computer Internet: https://goszakupki.by);

electronic trading platform of "Belarusian Universal Commodity Exchange" open joint stock company (the address on the global computer Internet: https://zakupki.butb.by).

Information system for placement of information on purchases provided by the Regulations on procurement procedure of goods (works, services) at the expense of own means approved by this resolution is the information system "Tenders" on the website of the republican unitary enterprise "National Center of Support of Export" (the address on the global computer Internet: https://icetrade.by).

Services of the operator of electronic trading platform in participation in procurement procedure on electronic trading platform are paid by participants of such procedures.

Services of the operator of the information system "Tenders" in placement in it of information on purchases provided by the Regulations on procurement procedure of goods (works, services) at the expense of own means approved by this resolution are paid by the buying organizations (organizers).

The amount of payment constitutes:

for the services specified in the parts three of this subitem rendered to resident participants – 0,5 of basic size for date of placement of the offer *;

for the services specified in part four of this subitem – 1 basic size for date of placement of information about закупках*.

Concerning nonresident participants the size of service fee is determined by operators of electronic trading platforms and operator of the information system "Tenders" independently;

2.5. for the interaction with electronic trading platform with use of the digital signature the representative of the legal entity which is state body (organization) shall own personal key of the digital signature (further – personal key), the certificate of open key of verification of the digital signature (further – the certificate of open key) which and the attribute certificate confirming its powers are published by republican certification center of the State management system open keys of verification of the digital signature of the Republic of Belarus.

For interaction with electronic trading platform with use of the digital signature the representative of the legal entity who is not specified in part one of this subitem the physical person, including the individual entrepreneur (their representatives), shall own personal key which certificate of open key and if necessary the attribute certificate confirming their powers are published by the service provider accredited in the State management system by open keys of verification of the digital signature of the Republic of Belarus or determined by operators of electronic trading platforms (further – the service provider).

Information on service providers is placed operators of electronic trading platforms on electronic trading platforms.

Operators of electronic trading platforms and the information system "Tenders" provide placement of information provided in part three of this subitem, in the information system "Tenders" in the corresponding register.

Operators of electronic trading platforms provide:

use of certificates of open keys, the attribute certificates published by service providers, information on whom is placed in the corresponding register, for work on electronic trading platform;

check of validity of certificates of open keys, attribute certificates, integrity and authenticity of the electronic documents signed by the digital signature;

2.6. purchases of the exchange goods included in the inventory, transactions with which legal entities and individual entrepreneurs shall conclude at the exchange biddings, are performed at the exchange biddings according to the legislation on commodity exchanges.

Purchases of the exchange goods allowed by commodity exchange to exchange trade, which are not entering the inventory, transactions with which legal entities and individual entrepreneurs shall conclude at the exchange biddings, can be performed according to the legislation on commodity exchanges or the Regulations on procurement procedure of goods (works, services) at the expense of own means approved by this resolution.

3. For the purposes of this resolution terms and their determinations according to appendix 2 are used.

4. Grant the right to the Ministry of anti-monopoly regulation and trade to explain questions of application of this resolution.

5. To state bodies (organizations):

provide reduction of acts of the legislation in compliance with this resolution;

take measures for inclusion of the subordinates (who are part, system, being subsidiary companies of holdings) the organizations in the Register of producers of goods (works, services) and their sales organizations (official sales representatives) *;

take other measures for implementation of this resolution.

* The register of producers of goods (works, services) and their sales organizations (official sales representatives) is conducted and placed in open access in the information system "Tenders" by the republican unitary enterprise "National Center of Support of Export".

6. To state bodies (organizations) the organizations of the requirement to implementation of purchases at the expense of own means are not allowed to establish for being under their supervision (the holdings which are their part, system, being subsidiary companies), the Republic of Belarus which is not provided by legal acts, decisions of the President, resolutions of Council of Ministers of the Republic of Belarus, except as specified, specified in subitem 2.2 of Item 2 of this resolution.

7. Heads of the buying organizations bear the personal responsibility for failure to provide of fulfillment of requirements of this resolution taking into account the features established according to subitem 2.2 of Item 2 of this resolution.

8. Make changes to the following resolutions of Council of Ministers of the Republic of Belarus:

8.1. in the resolution of Council of Ministers of the Republic of Belarus of June 26, 2013 No. 542 "About modification and amendments in resolutions of Council of Ministers of the Republic of Belarus of June 16, 2004 No. 714 and of March 15, 2012 No. 229":

to exclude subitem 1.2 of Item 1;

in Item 3:

from word part one", except for subitem 1.2.2 of Item 1, becoming effective since July 1, 2013" to exclude;

the second to exclude part;

8.2. the second Item 3 of the resolution of Council of Ministers of the Republic of Belarus of March 21, 2016 No. 225 "About modification and amendments in resolutions of Council of Ministers of the Republic of Belarus of March 15, 2012 No. 229 and of June 22, 2015 No. 525" to exclude subitem 1.1 of Item 1 and part;

8.3. in the resolution of Council of Ministers of the Republic of Belarus of July 24, 2019 No. 484 "About change of resolutions of Council of Ministers of the Republic of Belarus of March 15, 2012 No. 229 and of July 4, 2017 No. 500":

to exclude subitem 1.1 of Item 1;

exclude Item 2;

"the paragraph of the fifth subitem 1.1 and" to exclude from part two of Item 3 of the word;

8.4. third Item 3 of the resolution of Council of Ministers of the Republic of Belarus of December 28, 2019 No. 936 "About questions of purchases of auditor services" to exclude Item 2 and the paragraph;

8.5. the tenth Item 11 and Item 6 of the resolution of Council of Ministers of the Republic of Belarus of June 30, 2020 No. 388 "About the address with waste of goods and packagings" to exclude the paragraph;

8.6. 1, Item 2 and part the second Item 3 of the resolution of Council of Ministers of the Republic of Belarus of August 13, 2021 No. 462 "About change of resolutions of Council of Ministers of the Republic of Belarus of June 16, 2004 No. 714 and of March 15, 2012 No. 229" to exclude subitem 1.2 of Item;

8.7. 1, subitem 2.1 of Item 2, Item 3 and parts second and third item 4 of the resolution of Council of Ministers of the Republic of Belarus of June 23, 2025 No. 347 "About purchases at the expense of own means" to exclude Item;

8.8. 1, Items 2 and 3 of the resolution of Council of Ministers of the Republic of Belarus of August 25, 2025 460 "About change of resolutions of Council of Ministers of the Republic of Belarus" to exclude subitem 1.1 of Item.

9. Recognize invalid resolutions of Council of Ministers of the Republic of Belarus according to appendix 3.

10. Recommend to local councils of deputies to recognize invalid the decisions determining procurement procedure of goods (works, services) at the expense of own means municipal unitary enterprises, national associations, other legal entities whose property is in utility property or economic societies, more than 25 percent of shares (share in authorized funds) of which belong to administrative and territorial units and (or) the organizations which property is in utility property.

11. Operation of this resolution does not extend to purchases if procedures of purchases are begun before entry into force of this resolution. The specified purchases come to the end according to the legislation existing before entry into force of this resolution.

12. This resolution becomes effective in three months after its official publication.

 

Appendix 1

to the Resolution of Council of Ministers of the Republic of Belarus of April 7, 2026 No. 168

The inventory (works, services) to which purchases at the expense of own means operation of this resolution does not extend

1. Purchases of goods (works, services) for own production by the commercial organizations of the Republic of Belarus and the individual entrepreneurs registered in the Republic of Belarus, specified in the Decree of the President of the Republic of Belarus of May 7, 2012 to No. 6 "About stimulation of business activity in the territory of averages, small residential locations, the rural zone", except for the commercial organizations and individual entrepreneurs of the Republic of Belarus called in subitem 1.8 of Item 1 of the Decree of the President of the Republic of Belarus of May 7, 2012 No. 6.

2. Purchases of exchange goods at the exchange biddings.

3. Purchases of the goods realized at the biddings (the electronic biddings), the public biddings by legal executives according to the legislation on enforcement proceeding, the auction held according to the legislation on insolvency settlement, the legislation on protection and use of lands and also in case of privatization of state-owned property, acceptance of goods by the claimant on account of debt repayment according to the legislation on enforcement proceeding.

4. Purchases of goods (works, services), data on which belong to the state secrets.

5. Purchases of currency values, securities in Belarusian rubles at residents of the Republic of Belarus.

6. Purchases of works (services) connected with issue, placement, the address, repayment of securities of the organizations – the residents of the Republic of Belarus placed outside the Republic of Belarus (including with involvement of the specialized nonresident company), taking into account the rights to such securities.

7. Purchases of utilities or purchase and sale of electrical energy at regulated prices (rates), services in connection (accession) to networks of engineering facilities, and also other services relating to spheres of natural monopolies, services in maintenance of apartment houses, sanitary content of auxiliary rooms of apartment houses, maintenance of elevators, and also additional housing and communal services, works on subjects to external improvement of settlements.

8. Purchases of services of telecommunication between the operators of telecommunication having the right to the omission of the international traffic and accession to networks of telecommunication of foreign states and also purchases by such operators at residents of foreign states of services of telecommunication in transmission of messages of telecommunication between networks of telecommunication of the Republic of Belarus and networks of telecommunication of foreign states, between networks of telecommunication of foreign states if transmission of messages of telecommunication from one foreign state in another is performed through the networks of telecommunication located in the territory of the Republic of Belarus.

9. Purchases of objects of museum value, museum objects and museum collections, and also rare and valuable editions, manuscripts, archive documents, including the copies having historical, art or other cultural value, the state museum, library, archive funds intended for replenishment, film fund and other similar funds.

10. Purchases of real estate, and also purchase of real estate lease.

11. Purchases of the material values realized from the state and mobilization material reserves.

12. Purchases of the property withdrawn, arrested, confiscated or turned into the income of the state otherwise, including property on which collection on account of the unexecuted tax liability, unpaid penalty fee, the property exempted from arrest by the body conducting criminal procedure, the property detained by customs authorities and which was not demanded in the terms established by the Customs code of the Eurasian Economic Union, and the property placed under customs procedure of refusal for benefit of the state, works, services connected with its storage, check on quality and safety, assessment, and also carrying out other work types (examinations) by the organizations, included in lists of the organizations competent to carry out such works (examinations), services is turned.

13. Purchases of research, developmental and experienced and technological works, and also the scientific, scientific and technical and innovative products (prototypes) developed according to the specification which is integral part of contracts for accomplishment of research, developmental and experienced and technological works, except for purchases at the expense of the money arriving into the special account of public institution "Operator of secondary material resources".

14. Purchases of goods for wholesale and (or) retail trade, public catering, except for purchases of goods for the organization of public catering in healthcare institutions and the educations which are not connected with purchase of goods for their subsequent realization in buffets and cafeterias in healthcare institutions and educations.

15. Purchases of goods (works, services) according to the international treaty of the Republic of Belarus, and also the agreement signed by state body with the foreign legal entity, the international organization, the organization, not being the legal entity if such agreement provides other procedure for determination of suppliers (contractors, contractors).

16. Purchases of goods (works, services) at the expense of the credits (loans), money of the free sponsor's aid if in the conditions of their provision special requirements to purchases and (or) the choice of suppliers are provided (contractors, contractors).
