About regulatory guillotine in the field of allowing documents
In the Kyrgyz Republic throughout long time the excessive number of the allowing documents regulating different types of activities of citizens and subjects of entrepreneurship remains. The set of the procedures connected with receipt of licenses, permissions and other documents of allowing nature differs in complexity, duration and duplication of functions of state bodies.
Such situation leads to excessive administrative barriers, creates conditions for corruption risks, increases costs of business and citizens by interaction with the state, constrains development of entrepreneurship and investment activity, and also interferes with realization of the principles of openness, transparency and efficiency of public administration.
For elimination of the revealed problems systems analysis of all allowing documents and procedures within the mechanism of regulatory guillotine directed to review, abolition and optimization of the allowing documents and procedures which are not conforming to modern requirements is carried out.
For the purpose of realization of state policy on debureaucratization, reducings administrative barriers and simplification of interaction of the state with citizens and business, based on results of the inventory count of allowing documents which is carried out by the commission on inventory count and assessment of the documents issued by state bodies having allowing nature, the Kyrgyz Republic formed by the order of the Cabinet of Ministers of June 30, 2025 No. 552-t according to article 31-1 of the Law of the Kyrgyz Republic "About regulatory legal acts of the Kyrgyz Republic" Articles 66, 71 Constitutions of the Kyrgyz Republic I decide:
1. Enter from April 1, 2026 to March 31, 2027 temporary legal regulation of questions of issue of the documents having allowing nature and approve the exhaustive list of the documents having allowing nature according to appendix 1.
2. Determine that:
1) the documents having allowing nature are licenses, permissions, certificates, patents, references, certificates, accreditations, registration, the conclusions of examinations and other documents which issue is required for implementation of separate types of activity or making of certain actions, except for the documents of allowing nature issued by National Bank of the Kyrgyz Republic;
2) from the effective date this Decree and till March 31, 2027 citizens and subjects of entrepreneurship of the Kyrgyz Republic have the right to perform activities without receipt of the documents having allowing nature, except for documents, specified in Item 1 of this Decree, and also the documents issued by National Bank of the Kyrgyz Republic.
3. To state bodies, local government bodies, except for National Bank of the Kyrgyz Republic:
1) to stop issue and reclamation at citizens and subjects of entrepreneurship of the documents having allowing nature, which are not provided by appendix 1;
2) to take exhaustive measures for implementation of the offers directed to optimization and simplification of procedures of issue of the documents having allowing nature according to appendix 2, and also in a month to initiate development and promotion of the corresponding projects of regulatory legal acts;
3) till September 1, 2026 and till February 20, 2027 to provide information on the course of implementation of this Decree in the Ministry of Economy and Trade of the Kyrgyz Republic.
4. To provide to the Ministry of Economy and Trade of the Kyrgyz Republic coordination and monitoring of the carried-out work on optimization and simplification of procedures of issue of the documents having allowing nature.
5. To the Cabinet of Ministers of the Kyrgyz Republic within 6 months to bring regulatory legal acts into accord with this Decree.
6. To impose control of execution of this Decree on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.
7. This Decree becomes effective from the date of official publication.
