Chapter 1 General provisions

Article 1. Coverage of this Law

1. This Law determines the principles of rule-making activities, establishes concepts and types of regulatory legal acts, their ratio among themselves, procedure for their preparation, acceptance, publication, and also the rule of their action, interpretation and permission of collisions.

2. The legislation regulations containing in other laws and other regulatory legal acts and concerning field of activity of this Law shall correspond to this Law. In case of collisions between this Law and other laws regulations of this Law are applied.

Article 2. The basic concepts applied in this Law

In this Law the following main terms, concepts and their determinations are applied:

the legislation - set of the regulatory legal acts governing the public relations;

collision of regulatory legal acts - contradiction (discrepancy) between the regulatory legal acts governing the same public relations;

rule-making activities - scientific and organizational activities for preparation, examination, acceptance (edition), change, amendment, interpretation, action suspension, recognition invalid or cancellation of regulatory legal acts;

rule-making body (official) - state body (official), the local government body authorized (authorized) to accept (to publish) regulatory legal acts;

regulatory legal act - the official document of the established form accepted (published) within competence of authorized state body (official), local government body or by referendum, directed to establishment, change or cancellation of rules of law (precepts of law);

the rule-making equipment - system of rules of preparation of projects of regulatory legal acts;

gaps in the legislation - lack of rules of law (precepts of law) which need is caused by essence and content of the operating system of law of the state, the principles and rules of international law;

the rule of law (precept of law) - the obligatory rules of conduct expected the uncertain group of people and numerous application;

legal force of regulatory legal act - the characteristic of regulatory legal act determining obligation of its application to the corresponding public relations and also its hierarchy in relation to other regulatory legal acts.

Article 3. Principles of rule-making activities

Rule-making activities are performed on the following principles:

observance of the rights, freedoms and legitimate interests of citizens and legal entities;

legality;

justification;

feasibility;

justice;

publicity;

availability of language of regulatory legal act.

Article 4. Types of regulatory legal acts

1. Regulatory legal acts are subdivided into the following types:

The constitution - the regulatory legal act having the highest legal force and establishing the fundamental principles and regulations of legal regulation of the major public relations, creating the legal basis for adoption of the laws and other regulatory legal acts;

the constitutional law - the regulatory legal act adopted by Jogorku Kenesh of the Kyrgyz Republic (further - Jogorku Kenesh) in established by the Constitution of the Kyrgyz Republic (further - the Constitution) procedure and on the questions determined by it;

the code - the regulatory legal act providing system regulation of the uniform public relations;

the law - the regulatory legal act adopted by Jogorku Kenesh in accordance with the established procedure and governing the most important public relations in the respective sphere;

the presidential decree of the Kyrgyz Republic - the regulatory legal act published by the President of the Kyrgyz Republic (further - the President) and conforming to the requirements specified in this Law;

the resolution of Jogorku Kenesh - the regulatory legal act adopted by Jogorku Kenesh on the questions carried to its maintaining by the Constitution, and conforming to the requirements specified in this Law;

the order of the Government of the Kyrgyz Republic - the regulatory legal act adopted by the Government of the Kyrgyz Republic (further - the Government), on basis and in pursuance of the regulatory legal acts having higher legal force, conforming to the requirements specified in this Law;

the resolution of National Bank of the Kyrgyz Republic (further - National Bank) - the regulatory legal act adopted by Board of National Bank on basis and in pursuance of the regulatory legal acts having higher legal force, within the competence, and conforming to the requirements specified in this Law;
