About modification of the order of the Minister of Energy of the Republic of Kazakhstan of September 17, 2025 No. 355-n/k "About approval of Rules of forming, maintaining and functioning of single state management system fuel and energy"

I ORDER:

1. Bring in the order of the Minister of Energy of the Republic of Kazakhstan of September 17, 2025 No. 355-n/k "About approval of Rules of forming, maintaining and functioning of single state management system fuel and energy complex" (it is registered in the Register of state registration of regulatory legal acts at No. 36862), the following change:

The rules of forming, maintaining and functioning of single state management system fuel and energy complex approved by the specified order to be reworded as follows according to appendix to this order (further – Rules).

2. To provide to department of digitalization of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

3) within ten working days after state registration of this order submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication, except for Chapters 1, of 2, of 3, of 4, of 5, of 13 Rules and Appendix 1 to Rules which become effective since January 1, 2027.

Rules of forming, maintaining and functioning of single state management system fuel and energy complex

Chapter 1. General provisions

1. These rules of forming, maintaining and functioning of single state management system are developed by fuel and energy complex (further – Rules) according to Items 2 and 5 of article 144 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" (further - the Code), subitem 6-1) of article 5 of the Law of the Republic of Kazakhstan "About power industry" (further – the Law) and item 4 of article 21-1 of the Law of the Republic of Kazakhstan "About heat-and-power engineeering".

2. The basic concepts used in these rules:

1) the receiver – person performing acceptance of products in accordance with the terms of the service provision agreement on transportation of products;

2) analytics of data – processing of data with the purpose of receipt of information and conclusions for decision making;

3) the sender – person who is the producer of products or person who acquired it on legal causes, or the person authorized by them providing products for transportation through the bulk distribution line based on the service provision agreement on transportation of products;

4) fuel and energy complex – set of the industries of economy providing exploration and production of primary energy resources, their conversion, production of energy and heat energy, and also transportation, transfer, distribution and supply with energy of consumers;

5) single state management system of fuel and energy complex (further – System) – the digital system of authorized body intended for collection, processing, storage, monitoring and data analysis of fuel and energy complex in spheres of exploration and production of hydrocarbons, heat-and-power engineeering and power industry by means of information exchange of physical persons and legal entities, subjects of heat supply with authorized body and other state bodies;

6) subjects in the field of fuel and energy complex are the individual entrepreneurs and legal entities providing information for inclusion in single state management system fuel and energy complex, including performing activities in the field of turnover of crude oil, gas condensate, sour gas and products of its conversion (commodity gas);

7) technical requirements to subjects of fuel and energy complex – requirements to digital objects of subjects of fuel and energy complex for the purpose of collection, processing and data transmission in System;

8) digital infrastructure in the field of fuel and energy complex – set of technical means, the software, communication channels, measuring instruments, automated control systems and accounting, and also the related digital components providing collection, processing, storage, transfer and information security for the purpose of functioning of System;

9) the user's office – the System component intended for official information exchange of individual entrepreneurs and legal entities electronically;

10) commodity gas – the multi-component mixture of hydrocarbons with the prevailing methane content which is in gaseous state, being product of conversion of sour gas and meeting for qualitative and quantitative content of components the requirements of technical regulations and national standards;

11) the crude oil and gas condensate prepared for delivery to the consumer – commodity oil (oil) prepared for delivery to the consumer according to requirements of ST of RK 1347-2024 "Oil. General specifications" and the condensate gas stable (CGS) prepared for delivery to the consumer according to requirements of ST of RK 2188-2012 "Condensate gas stable. Specifications";

12) authorized body – the central executive body of the Republic of Kazakhstan enabling forming and the realization of state policy, coordination of management process in spheres of the oil and gas, petrochemical industry, transportation of hydrocarbons in the field of subsurface use regarding hydrocarbons, state regulation of production of oil products, gas and gas supply, the bulk distribution line, heat-and-power engineeering and power industry, heat supply regarding the combined heat and power plants and boiler rooms performing production of heat energy in zone of centralized heat supply (except for autonomous boiler rooms), developments of renewable energy resources;

13) the user Sistemy – authorized body, other state bodies of the Republic of Kazakhstan, subjects of fuel and energy complex, the individual entrepreneurs and legal entities participating in information exchange by means of Digital system;

14) sour gas – any hydrocarbons regardless of their specific weight extracted from subsoil in gaseous state at normal atmospheric temperature and pressure, including crude natural, associated, slate gas, methane of coal layers, and also not hydrocarbon gases which are in their structure;

15) turnover of sour gas, products of its conversion (commodity gas) – collection, preparation, transportation, conversion, and also in cases and on the conditions established by the Code and the project document – utilization by downloading in layer, use for own needs and burning in torches;

16) turnover of crude oil and gas condensate – preparation, transportation, storage, shipment, realization, import to the territory of the Republic of Kazakhstan and export out of limits of the territory of the Republic of Kazakhstan;

17) metering devices of crude oil, gas condensate, sour gas and products of its conversion (commodity gas) (further – metering devices) – the technical device determining quantity and quality characteristics of crude oil, gas condensate, sour gas and products of its conversion (commodity gas) and allowed to application according to the legislation of the Republic of Kazakhstan in the field of ensuring unity of measurements and also the software performing information transfer to the operator of single state management system fuel and energy complex in real time.

18) the digital signature – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

Other terms and determinations used in these rules are applied according to the legislation of the Republic of Kazakhstan in the field of the oil and gas, petrochemical industry, transportation of hydrocarbons, in the field of subsurface use regarding hydrocarbons, state regulation of production of oil products, gas and gas supply, the bulk distribution line, heat-and-power engineeering and power industry.

Chapter 2. Appointment and structure of System

3. These rules determine bases of digital transformation of fuel and energy complex for effective interaction of authorized body and subjects of fuel and energy complex by means of System, ensuring centralized management of fuel and energy complex, forming of the relevant information on condition and the forecast of development of fuel and energy complex, and also determination of the minimum requirements to digital objects of subjects of fuel and energy complex.

4. The system designation is:

1) collection, processing, information from subjects of fuel and energy complex for the purpose of inclusion in System, storage of such information, ensuring access to it, its provision and distribution;

2) ensuring monitoring and forming of analytical information on fuel and energy complex condition;

3) forecasting and modeling of fuel and energy complex on the basis of collected data from subjects of fuel and energy complex;

4) quality assurance of the performed state functions and availability of the state services rendered by authorized body by means of System;

5) ensuring reliability and safety of functioning and interaction of subjects of fuel and energy complex with System on the basis of certain minimum requirements.

5. The structure of System consists of the following elements:

1) digital system "Single State Management System Fuel and Energy Complex of the Republic of Kazakhstan";

2) the subsystems providing functioning of System;

3) users of System.

Chapter 3. Procedure for functioning of System

6. Functioning of System is performed by integration of data and information, centralized management, automation of processes, standardization of procedures, and also regular monitoring and control. The system also includes collection and the analysis of feedback for ensuring permanent improvement of its functionality and efficiency.

7. Operator of digital infrastructure in the field of fuel and energy complex is the legal entity determined according to subitem 6-2) of article 5 of the Law, performing ensuring functioning of information collection and (or) operational information in fuel and energy complex industries, system monitoring and implementation of functions of dispatching service in the field of fuel and energy complex and also data collection with the execution control mechanism, data processing, forecasting, modeling and provision of the analytical reporting under fuel and energy complex industries.

8. Creation, development and operation of System are performed on the basis of the following requirements:

1) completeness, reliability, timeliness of provision of information for inclusion in System;

2) continuity of collection, information processing for inclusion in System;

3) interaction of System and other information systems;

4) ensuring energy security of the Republic of Kazakhstan during creation, development and operation of System.

9. Creation, development and operation of System is performed according to Items 3, 4 articles 85 of the Digital Code of the Republic of Kazakhstan.

10. Cyber security of System is provided according to the Single requirements in the field of information and communication technologies and ensuring information security approved by the order of the Government of the Republic of Kazakhstan of December 20, 2016 No. 832 (further – Single requirements) and the standards in the field of cyber security existing in the territory of the Republic of Kazakhstan.

Chapter 4. Order of interaction and coordination of working processes between users in System

11. Information exchange of users of System is performed according to the Rules of integration of objects of informatization of "the electronic government" approved by the order of the Acting Minister of information and communications of the Republic of Kazakhstan of March 29, 2018 No. 123 (it is registered in the Register of state registration of regulatory legal acts at No. 16777).

12. Information exchange of users of System provides exception (minimization) of paper document flow when implementing by authorized body of collection, processing, storage and monitoring of information, and also rendering the state services in case of which the minimum number of the documents confirming the legally significant facts is provided.

13. The data used in the course of information exchange are equivalent to the data from paper documents.

14. Inclusion of information in System is performed by users of System based on information provided by subjects of fuel and energy complex, including within interaction of System and other digital systems, and also processed by the users of other System performing use of System according to these rules and the List of the information tools approved by the order of the Minister of national economy of the Republic of Kazakhstan of December 28, 2018 No. 107 (it is registered in the Register of state registration of regulatory legal acts at No. 18117).

15. The subjects of fuel and energy complex performing activities in the field of turnover of crude oil and gas condensate of sour gas and products of its conversion (commodity gas) provide to authorized body in the field of hydrocarbons access to the systems of accounting of the data on quantity which are in circulation of crude oil and the gas condensate, prepared for delivery to the consumer according to the legislation of the Republic of Kazakhstan, about quantity being in circulation of the sour gas prepared for conversion and delivery to the consumer according to the legislation of the Republic of Kazakhstan, and also used for own needs, which is subject to utilization by downloading in layer for the purpose of storage and (or) maintenance of the reservoir pressure burned in cases and on conditions, stipulated in Clause 146 Codes available for them.

16. When forming System the data from the metering devices established at the subjects performing activities in the field of turnover of crude oil and gas condensate, sour gas and products of its conversion (commodity gas) received within information exchange with subjects of fuel and energy complex with differentiation of these devices of commercial accounting, and also with assumption of application of calculation method in the cases established by the legislation of the Republic of Kazakhstan are used.

17. Integration of digital systems of subjects of fuel and energy complex in the field of turnover of crude oil and gas condensate, sour gas and products of its conversion (commodity gas) with System, is performed according to Requirements to information exchange of Single state system of fuel and energy complex with digital system of the subject of fuel and energy complex, according to appendix 1 to these rules.

18. Subjects of fuel and energy complex provide completeness and accuracy of the information, provided without fail for inclusion in System.

19. Information for inclusion in System is provided by users of System by means of digital technologies in the form of the electronic documents signed by means of the electronic and digital signature which go to authorized body with use of System.

20. The information access, containing in System, is provided with authorized body in the field of information access according to the procedure, stipulated in Item 1 article 6-2 of the Law of the Republic of Kazakhstan "About information access", the legislation of the Republic of Kazakhstan in the field of the state, trade secret and other secret protected by the law, taking into account provisions of these rules and other legal acts of the Republic of Kazakhstan.

21. The data containing in System are information of limited access, except for information, inadmissibility of restriction of access to which is established by the subitem 8) of article 1 of the Law of the Republic of Kazakhstan "About information access".

22. Right of access to information, including information of limited access, containing in System, with possibility of its processing the authorized body in the field of information access providing use of System according to its appointment including actions for carrying out adjustment, modification and elimination of defects of the software has. Other users of System get information access, containing in System, without possibility of its processing taking into account restrictions of information access in compliance with Item 1 of article 6-2 of the Law of the Republic of Kazakhstan "About information access" and these rules.

23. Access for users of System to the public information containing in System is provided with authorized body by placement of the specified information on the Internet portal of open data.

24. The authorized body provides information access, containing in System, with use of technical (program and technical) means of System:

1) to subjects of fuel and energy complex, concerning information provided by them and public information;

2) to users of System concerning information which contains in System;

3) to other users of System.

25. In need of obtaining to state bodies of information on the activities of subjects of entrepreneurship which are subject according to these rules, provided in System, the specified bodies within the competence request this information from authorized body according to article 11 of the Law of the Republic of Kazakhstan "About information access".

26. The information access, containing in System, is provided by means of the organizational and technical and other conditions necessary for ensuring access to information.

27. Integration with digital objects of "the digital government", the state or other databases and (or) digital systems is performed according to the Rules of integration of objects of informatization of "the electronic government" approved by the order of the Acting Minister of information and communications of the Republic of Kazakhstan of March 29, 2018 No. 123 (it is registered in the Register of state registration of regulatory legal acts at No. 16777).

Chapter 5. Procedure for collection, processing, monitoring and data analysis

28. The system provides collection and data transmission about accounting of turnover of crude oil and gas condensate, sour gas and products of its conversion (commodity gas), productions, transfers and distributions, consumption of electrical energy, and also monitoring of condition of heat supply facilities and power industry in real time.

29. Process of data collection is organized with use of the automated systems, devices of measurement and other technologies, according to requirements of Chapter 6 of these rules.

30. All collected data are subject to obligatory processing, including the analysis for determination of efficiency of use of energy resources and risks assessment.

31. Data processing is performed according to Articles 6, of 7, of the 9th Chapter 2 of the Law of the Republic of Kazakhstan "About personal data and their protection".

Paragraph 1. Data collection

32. Data for System are provided by individual entrepreneurs and legal entities in the field of fuel and energy complex.

33. Data collection is performed by means of automatic monitoring systems and accounting which provide regular data transmission in System in the following intervals of time:

on gas each 2 hours;

on electrical and heat energy each 15 minutes.

34. In the course of information exchange data on quantity being in circulation of crude oil and gas condensate, prepared for delivery to the consumer according to the legislation of the Republic of Kazakhstan, about amount of the sour gas which is in circulation prepared for conversion and delivery to the consumer according to the legislation of the Republic of Kazakhstan and also used for own needs subject to utilization by downloading in layer for the purpose of storage and (or) maintenance of the reservoir pressure burned in cases and on conditions, stipulated in Clause 146 Codes about subsoil and subsurface use are subject to transfer to System.
