About the academic honesty

The Verkhovna Rada of Ukraine recognizes the academic respectability as important premises of implementation of high-quality educational and scientific (creative) activities, receipt of quality education, approval in the society of trust to results of training and scientific (creative) achievements, and also forming of respect for honor and advantage of the person.

This Law proclaims basic values and determines the basic principles and rules of the academic respectability, legal and organizational mechanisms of its forming and providing, the main signs and types of violations of the academic respectability and response to such violations.

Section I. General provisions

Article 1. Determination of terms

1. In this Law the stated below terms are used in the following value:

1) the author - physical person which the work created the academic work (its part) or study (its part);

2) the academic respectability - set of values, the principles and the rules based on them by which subjects of the academic activities when implementing such activities shall be guided;

3) the academic work - the work in the field of education or science expressed in the form of the thesis, the creative art project, qualification work, the term paper, the scientific monograph, the scientific article, the textbook, the education guidance or in other form determined by the legislation and/or the internal act;

4) the internal act - the document of organization of education, scientific institution, other subject of the academic activities approved in accordance with the established procedure by its collegiate organ of management concerning questions of the academic respectability;

5) information source - the printing or electronic edition, archive material, Internet resource, personal communication, other source from which information used in the academic work or study is obtained;

6) study - the result of accomplishment by the job seeker of formation of educational task (educational tasks) reflected in text, visual, audiovisual, plastic, digital or other form;

7) subjects of the academic activities - pedagogical, scientific and pedagogical, the scientists, other scientists, job seekers of education arriving participants and organizers of tenders, experts in the field of science and education, subjects of educational activities, subjects of scientific activities;

8) authorized body - the collegiate organ of organization of education, scientific institution authorized according to this Law to consider messages on violation of the academic respectability and/or to apply responses to the violations of the academic respectability determined according to this Law the internal act;

9) the authorized person - pedagogical, scientific and pedagogical, the scientist of educational institution, scientific institution authorized according to this Law to react to violations of the academic respectability, to consider messages on violation of the academic respectability and/or to apply responses to the violations of the academic respectability determined according to this Law the internal act.

Article 2. Law coverage

1. This Law extends to the public relations arising in connection with implementation of the academic activities which cover:

scientific, scientific and pedagogical, pedagogical, teaching activities;

educational activities of job seekers of education;

educational activities of educational institutions, scientific institutions;

creation, accomplishment and estimation of projects in the field of science and education;

creation, reviewing, scientific editing the academic works;

entrance tests in educational institutions (scientific institutions);

holding the Olympic Games, tournaments, tenders, competitions and other actions of competitive nature in the field of science and education and participation in such actions (further - tenders);

award of scientific degrees and extents of education, assignment of academic and pedagogical statuses, qualification categories, election of full members (academicians) and corresponding members of National academy of Sciences of Ukraine and national industry academies of Sciences of Ukraine;

implementation of procedures of internal and external quality assurance of education;

certification of scientists;

the state certification of scientific institutions and institutions of higher education regarding implementation of scientific and scientific and technical activities by them;

implementation of scientific and scientific and technical examination.

2. Operation of this Law does not extend to the relations on acquisition, implementation and protection of the personal non-property and property author's and/or related rights.

Article 3. The legislation regulating questions of ensuring the academic respectability

1. The legislation regulating questions of ensuring the academic respectability is based on the Constitution of Ukraine and consists of this Law, the laws of Ukraine "About education", "About the higher education", "About professional prehigher education", "About professional education", "About complete general secondary education", "About preschool education", "About out-of-school education", "About scientific and scientific and technical activities", other laws of Ukraine and acts of the legislation adopted on their accomplishment, international treaties of Ukraine which consent to be bound is provided in accordance with the established procedure.

2. The organization of education, scientific institution within the autonomy has the right to independently make decisions on any questions of forming, providing and promoting of the academic respectability, not settled by the law.

Article 4. Values and principles of the academic honesty

1. Subjects of the academic activities shall observe the values, the principles and rules of the academic respectability determined by this Law and other laws of Ukraine according to this Law, and also the international documents signed on behalf of Ukraine in the procedure established by the legislation.

Subjects of the academic activities which according to the legislation have the right to adopt internal acts can determine in such acts additional values, the principles and rules of the academic respectability which shall not contradict those which are determined by this Law.

Subjects of the academic activities shall create and approve the culture of the academic honesty in the academic communities based on values, the principles and rules of the academic honesty.

2. The main values of the academic honesty are:

honesty of subjects of the academic activities before and other persons;

trust to results of the academic activities of other persons, in particular to the fact that these results are received fairly and with observance of the corresponding rules and standards;

respect for honor and advantage of the and other members of the academic community to appreciate variety of opinions, respect for intellectual property rights of other persons;

justice concerning subjects of the academic activities to each other, in particular creation fair the politician of educational institutions, scientific institutions, consecutive and impartial response to violations of the academic respectability, virtuous estimation of results of the academic activities;

responsibility of subjects of the academic activities to, before each other and before society for results of the academic activities;

stability in virtuous implementation of the academic activities irrespective of external and internal motives to violation of the academic virtue and from availability or lack of external control;

determination in forming and approval of culture of the academic honesty, courage in protection of the academic honesty in the academic activities.

3. The basic principles of the academic honesty are:

priority of ensuring compliance with the academic respectability by job seekers of education by application of the corresponding training methods, education, stimulation and encouragement;

openness of information on rules of the academic honesty, types of violations of the academic honesty and responsibility for them;

intolerance (zero tolerance) to any manifestations of violation of the academic honesty;

respect for results of the academic activities (authorship) of other person and firmness of intellectual property rights;

avoiding of conflict of interest.

Section II. Basic rules of the academic honesty

Article 5. The academic respectability in pedagogical, scientific and pedagogical, teaching activities

1. Pedagogical, scientific and pedagogical, the scientists, other persons performing teaching activities shall follow the following rules:

be respectful to job seekers of education and other participants of educational process;

base own activities on the reliable and reliable data based on results of researches and reflecting the current state of knowledge of appropriate questions;

check reliability and accuracy of the information, provided to job seekers of education and other participants of educational process;

it is accurate to outline the expected results of training, to establish clear requirements to accomplishment of educational tasks and to have transparent system of assessment of results of training of job seekers of education which is based on accurate promulgated criteria;
