About professional education

The Verkhovna Rada of Ukraine recognizes permanent improvement of quality of professional education as necessary condition of growth of entrepreneurial activity and the income of citizens, sustainable development of territorial communities and societies, providing the labor markets and economy of Ukraine with qualified professionals, forming Yana to this basis высококачественног the ochelovechesky capital that will promote growth of welfare of the Ukrainian people.

The sphere of professional education is directed to forming and development of the kompetentnosty personality, necessary for its self-realization during life, education of responsible citizens and specialists who direct the activities to satisfaction of the best interests of people and society, in particular by high-quality and fair performance of works, provision of services or development of goods, implementation of other professional activity.

This Law determines legal, organizational and financial basis of functioning and development of system of professional education, creation of conditions for professional self-realization of the personality and ensuring requirements of society and state for specialists and qualified personnel.

Section I. General provisions

Article 1. Main terms and their determinations

1. In this Law the following terms are used in the following value:

1) autonomy right of organization of professional education on self-government which consists in his independence, independence and responsibility in decision making on the academic (educational), organizational, financial, personnel and other matters of the activities performed according to the procedure and the limits determined by the law;

2) the academic mobility - possibility of participants of educational process to study, to teach, train in other educational institution, at the company, in organization or the organization in the territory of Ukraine or beyond its limits;

3) military organization of professional education - the public institution of professional education performing special professional training of the military personnel for needs of the Armed Forces of Ukraine and other military forming formed according to the laws of Ukraine, law enforcement agencies of special purpose with assignment of professional qualifications by military professions at appropriate level of national frame of qualifications for the purpose of passing of service by them on positions of faces of ordinary and sergeant (foreman) structure;

4) organization of professional education - the legal entity of public or private law which core activity are the educational activities aimed at providing receipt of professional education by persons, professional qualifications;

5) organization of professional education with specific conditions of training - the Public institution of professional education performing special professional training of workers for needs of state bodies in spheres of ensuring public safety and procedure, protection of human rights and freedoms, interests of society and the state, counteraction of crime, civil protection, execution of criminal penalties and probation;

6) the founder of organization of professional education (further - the founder) - public authority on behalf of the state, authorities of the Autonomous Republic of Crimea, the relevant council on behalf of territorial community (communities), physical person and/or legal entity, the decision and at the expense of which property the organization of professional education is founded or which otherwise according to the legislation acquired the rights and the founder's obligations;

7) job seekers of professional education are students and cadets (listeners);

8) cadets (listeners) - persons getting professional education, professional qualifications in organizations of professional education with specific conditions of training, military organizations of professional education;

9) retraining - receipt of other professional qualification by person, than previously received;

10) advanced training - obtaining by person new and/or enhancement of earlier acquired kompetentnost within professional activity;

11) professional education - the systematized set of the results of training and kompetentnost determined by the standard of professional education and the corresponding professional standard certified by the document on professional education received by person;

12) professional training - receipt of professional qualification by person for the first time;

13) system of professional education set of participants of educational process, organizations of professional education and other subjects of educational activities, governing bodies in the field of professional education, scientific institutions, the Center of development of professional education, subjects which according to this Law perform function on estimation of quality of professional education, the subjects performing assignment, recognition and confirmation of professional qualifications, and also the regulatory legal acts governing the relations in the field of professional education, and educational programs of professional education;

14) special professional preparation obtaining by the cadet (listener) of professional education, professional qualification in organization of professional education with specific conditions of training, military organization of professional education;

15) the standard of professional education - the document determining requirements to obligatory kompetentnost, results of training and educational programs for receipt of the educational specialist level;

16) the student - person getting professional education;

17) quality of professional formation compliance of results of training in the requirements established by the legislation, the standard of professional education, the professional and/or international standard (in the presence) and/or the agreement on provision of educational services, and also to requirements of concerned parties and societies that is provided by implementation of procedures of internal and external quality assurance of education.

2. Provisions of this law concerning parents concern also other legal representatives of job seekers of professional education and other persons studying in organization of professional education. Parents, other legal representatives realize relevant provisions of this law concerning persons which did not reach 18-year age and also according to the legislation concerning persons whose capacity to act is limited.

Provisions of this Law concerning the founder of organization of professional education extend also to other founders of the relevant organization of the education (in the presence) authorized by it (them) body (person) and also to founders of other subjects of educational activities or the bodies (persons) authorized by them.

Provisions of this law concerning private institutions of professional education extend also to other legal entities of private law having the license for implementation of educational activities in the field of professional education.

3. Other terms are used in this Law in the following value:

terms "employer", "the organizations of employers", "merging of the organizations of employers" - in the values given in the Law of Ukraine "About the organizations of employers, their associations, the rights and guarantees of their activities";

the terms "European Credit Transfer and Accumulative System (EKTS)", "credit of the European credit transfer and accumulative system (EKTS credit)" - in the values given in the Law of Ukraine "About the higher education".

4. For the purposes of this Law, unless otherwise specified, the term "professional qualification" is understood as complete professional qualification.

Article 2. Legislation of Ukraine on professional education

1. The legislation on professional education is based on the Constitution of Ukraine and consists of the Law of Ukraine "About education", this law, other acts of the legislation of Ukraine and international treaties of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine.

Article 3. The state and regional policy in the field of professional education

1. State policy in the field of professional education is determined by the Verkhovna Rada of Ukraine, is implemented by the Cabinet of Ministers of Ukraine, the central executive body in the field of science and education, other public authorities, local government bodies.

2. The state and regional policy in the field of professional education is created and implemented on the basis of results of scientific research, the Ukrainian and foreign experience, taking into account forecasts and researches of the labor market, statistical data and indicators of development for the purpose of requirements satisfaction of the person, territorial communities and society, providing the labor market with qualified specialists.

3. Tasks of state policy in the field of professional education are:

ensuring constitutional right of the person on vocational training according to its interests and capabilities;

creation of legal, organizational and financial conditions for functioning and development of system of professional education;

ensuring availability of professional education;

creation of conditions of quality assurance of professional education and quality of educational activities;

creation of conditions for realization of organization of professional education of financial, academic, organizational and personnel autonomy;

assistance to development of partnership in the field of professional education;

creation of conditions for vocational training throughout life;

ensuring realization of the right to professional education by persons with special educational needs;

creation of conditions for integration of system of professional education into world education system and European educational space;

provision of recommendations about forming of network of organizations of professional education.

4. Public authorities and local government bodies create and realize the policy, based on the principles determined by the Law of Ukraine "About education" and also on the principles:

the advancing approach;

partnership and cooperation;

harmonization and integration with the European systems of qualifications;

compliance to requirements national and regional labor markets;

availability of professional education;

flexibility of trajectories of vocational training;

inclusivity;

gender equality;

ensuring forming of values of the responsible citizen and participation in public life;

strengthening of the authority of social institute of family.

Article 4. Right to professional education

1. Everyone has the right to the professional education including the right to professional education during life, the right to availability of professional education, the right to free vocational training in the cases and procedure determined by the law.

2. The right to professional education is guaranteed by the Constitution of Ukraine. In case of realization of this right there cannot be privileges or restrictions on signs of race, skin color, political, religious and other convictions, sex, age, disability, ethnic and social origin, nationality, marital and property status, the residence, on language or other signs and circumstances.

Nobody can be limited in the right to professional education, except the cases established by the Constitution of Ukraine.

Establishment of the restrictions and privileges determined by the specific conditions of vocational training caused by features of receipt of professional qualification is not considered discrimination.

3. Public authorities and local government bodies create conditions and opportunities for vocational training, including persons with special educational needs, taking into account individual requirements, opportunities, capabilities and interests, and also provide identification and elimination of the factors interfering realization of the rights and requirements satisfaction of such persons in the field of professional education.

4. The person having the status of the foreign Ukrainian or recognized as the refugee or person needing additional or temporary protection according to the Law of Ukraine "About the refugees and persons needing additional or temporary protection" has the rights to professional education, equal with citizens of Ukraine.

5. Foreigners, stateless persons which are in Ukraine on legal causes get professional education in Ukraine according to the legislation and/or international treaties of Ukraine.

6. Job seekers of professional education have the equal rights and obligations taking into account the features determined by the legislation and constituent documents of organization of professional education.

Article 5. Ensuring availability of vocational training, professional qualifications

1. Availability of vocational training, professional qualifications within powers is provided by public authorities, local government bodies, educational institutions and their founders in the way:

1) forming and development of network of organizations of professional education;

2) ensuring gratuitousness of vocational training, professional qualifications in the case and procedure established by the law;

3) transfer in educational institutions for vocational training, professional qualifications without carrying out tender, except the cases determined by this Law irrespective of the address of the declared / registered residence of the entrant;

4) implementation of different forms of vocational training, professional qualifications;

5) creation of conditions for realization of individual educational trajectory;

6) establishment of different duration of vocational training, professional qualifications depending on earlier received results of training or professional qualifications;

7) implementation of the principles of universal design and reasonable adaptation according to requirements and interests of all participants of educational process;

8) realization of educational components by method, the most acceptable for persons of the corresponding age, adaptations/modifications of content of educational components for persons with special educational needs;

9) ensuring free accommodation in hostels or transportation of students in educational institution (the place of training) and in the opposite direction (if necessary), including the school bus.

2. The network of the public, utility institutions of professional education is created taking into account social and economic and demographic situation, requirements of territorial communities and society, recommendations approved by the Cabinet of Ministers of Ukraine.

Section II. Procedure and conditions of vocational training, professional qualifications

Article 6. Procedure and conditions of vocational training, professional qualifications

1. Person has the right to get professional education on the basis of basic secondary education or complete general secondary education.

Vocational training based on basic secondary education is performed, as a rule, with simultaneous receipt of profile secondary education.

Person has the right to get professional education without receipt of profile secondary education which it can receive in other educational institution in any other time throughout life.

Person who does not have basic secondary education has the right according to the procedure, approved by the Cabinet of Ministers of Ukraine, to receive professional qualification in organization of professional education.

2. Each person has the right throughout life gratuitously to get professional education at the expense of means of the government or local budget, irrespective of availability at it the got professional prehigher or higher education, taking into account earlier received results of training.

3. Person has the right during life gratuitously to get professional education on other professional qualification (other professional qualifications), to undergo retraining, to improve professional qualification, but not earlier than in three years after completion of free vocational training in earlier received professional qualification (professional qualifications), passings of retraining, advanced training, on condition of availability of the confirmed insurance years of service at least two years and availability of empty seats after transfer of persons who will get gratuitously professional education for the first time.

Before completion of the three-year term provided by paragraph one of this part and/or in the absence of the confirmed insurance years of service person has the right to gratuitously get professional education on other professional qualification, to undergo retraining, to improve skills if it:

for health reasons lost opportunity to perform work on earlier received professional qualification that is confirmed by the relevant document;

is internally displaced person;

is the veteran of war, the member of his family, the member of the family of the died (died) veteran of war, the member of the family of the died (died) defender or the defender of Ukraine according to the Law of Ukraine "About the status of veterans of war, guarantees of their social protection";

in other cases, stipulated by the legislation.

Article 7. Duration of vocational training

1. Duration of vocational training is determined by educational programs of organizations of professional education and other subjects of educational activities in the field of professional education.

2. Educational programs can provide the different duration of vocational training depending on form of education, simultaneous receipt of profile secondary education, availability of special educational needs and/or individual educational trajectory of the job seeker (job seekers) of professional education.

3. In case of development of the individual curriculum duration of receipt of professional education by person can be reduced based on assessment and/or recognition of results of training, the complete and partial professional qualifications which are earlier received by formal, informal and/or informalny education.

4. In the cases established by the legislation, duration of vocational training by persons with special educational needs can be changed.

Article 8. Individual educational trajectory

1. Person has the right to create own individual educational trajectory in the way:

1) determination of the educational purposes;

2) the choice of the subject (subjects) of educational activities and offered them (them):

form (forms) of vocational training, professional qualifications;

educational program (educational programs);

modules, other educational components for the free choice by job seekers of professional education, professional qualifications;

3) choice of the sequence of receipt of qualifications;

4) academic mobility;

5) recognition of earlier received results of training.

2. The job seeker of professional education has the right to recognition of the results of training provided by the standard of professional education, the professional standard and/or the educational program which were earlier received by it by formal, informal and/or informalny education.

The procedure for recognition of results of training affirms the central executive body in the fields of education and sciences.

3. The individual educational trajectory in institution of professional education can be realized through the individual curriculum.

4. Job seekers of professional education exercise the right to the academic mobility according to the procedure, approved by the Cabinet of Ministers of Ukraine.

Article 9. Regulations of Admission to training in organizations of professional education

1. Acceptance on training in organizations of professional education is performed according to Regulations of Admission which are developed according to the legislation and affirm the head of organization of professional education.

2. Acceptance on training in organization of professional education is performed by selection committee, members and provisions on which the head of professional education claims.

3. Acceptance on training in the public, utility institutions of professional education is performed without carrying out tender, except case if the number of the submitted applications for receipt in organization of professional education exceeds planned amounts of acceptance in such organization of professional education.

Reception of applications about revenues in organization of professional education to training at the expense of the government or local budget begins not earlier than day of promulgation on the official website of organization of professional education of information on placement of the corresponding amounts of acceptance in organization of professional education and at least one month from the date of promulgation of the relevant information lasts. In the presence of empty seats for training after certain term the organization of professional education has the right to announce selection on empty seats which is made within no more than one month from the date of the beginning of academic year for the corresponding educational group.

4. Regulations of Admission can determine uniform or separate conditions and procedure for transfer of persons for:

vocational training, professional qualifications at the expense of means of the government budget;

vocational training, professional qualifications at the expense of means of the local budget;

vocational training, professional qualifications at the expense of means of physical persons and/or legal entities.

5. In Regulations of Admission are determined:

the exhaustive list of documents submitted for acceptance of person for training in institution of professional education;

the list of categories of persons having the privilege to transfer for vocational training at the expense of the government or local budget;

terms and terms of representation and consideration of documents, transfer on training;

conditions and procedure for carrying out tender for acceptance on training (in case of its carrying out);

procedure for appeal of solutions of selection committee.

Regulations of Admission may contain also other requirements, conditions and procedure which are not contradicting the legislation.

6. The institution of professional education has no right to refuse to person adoption of documents and acceptance on training based on lack of the declared/registered residence in the corresponding territory.

7. Preferential (out of the competition, first of all or out of turn) for vocational training for means of the government or local budget the entrants belonging to the categories determined by the laws of Ukraine "About the status of veterans of war, guarantees of their social protection" "About bases of social security of persons with disability in Ukraine" "About providing organization-legal conditions of social protection of the orphan children and children deprived of parent guardianship" "About the status and social protection of citizens which suffered as a result of the Chernobyl catastrophic crash" and other laws of Ukraine have the right to transfer if such right is granted to them by the specified laws.

8. Organizations of professional education and their founders create conditions for arriving with special educational needs by providing reasonable adaptation and/or universal design.

9. Organizations of professional education can organize documents acceptance by means of digital technologies with ensuring compliance with the legislation in spheres of personal data protection, electronic identification and electronic confidential services.

10. Acceptance on training in institution of professional education is performed within year if other is not provided by Regulations of Admission.

11. In case of transfer on training for means of physical person or legal entity the contract on provision of educational services between organization of professional education and physical person or legal entity which orders paid educational service for itself or for other person is in addition signed, assuming financial liabilities on its payment.
