RESOLUTION OF THE CABINET OF MINISTERS OF THE KYRGYZ REPUBLIC

About approval of the Concept of development of Customs Service of the Kyrgyz Republic for 2026-2030

For the purpose of providing conditions for development of foreign trade by simplification and automation of customs processes, upgrade of Customs Service of the Kyrgyz Republic, according to article 141 of the Law of the Kyrgyz Republic "About customs regulation", Section 5.2 of the National development program of the Kyrgyz Republic till 2030 approved by the Presidential decree of the Kyrgyz Republic "About the National development program of the Kyrgyz Republic till 2030" of June 5, 2025 No. 178, Chapter 4.7 of the National strategy of development for the Kyrgyz Republic for 2018-2040 approved by the Presidential decree of the Kyrgyz Republic "About the National strategy of development for the Kyrgyz Republic for 2018-2040" of October 31, 2018 No. 221, articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve:

1) the Concept of development of Customs Service of the Kyrgyz Republic for 2026-2030 (further - the Concept) according to appendix 1;

2) the Actions plan on implementation of the Concept according to appendix 2;

3) matrix of indicators of the Concept according to appendix 3;

4) assessment of resource cost of the Concept according to appendix 4.

2. To the ministries, the State committee of homeland security of the Kyrgyz Republic, administrative departments, local public administrations, local government bodies, other organizations (under approval):

1) to take measures for implementation of the Concept;

2) quarterly to the 5th following the accounting period to represent to the State Customs Service under the Cabinet of Ministers of the Kyrgyz Republic information on course of execution of the Actions plan on implementation of the Concept.

3. Under the Cabinet of Ministers of the Kyrgyz Republic quarterly to the 15th following the accounting period to represent to the State Customs Service to the Ministry of Economy and Trade of the Kyrgyz Republic the generalized report on the course of implementation of the Concept.

4. Determine that the realization of the Concept is enabled within the means provided for the State Customs Service under the Cabinet of Ministers of the Kyrgyz Republic for the corresponding years and other sources which are not prohibited by the legislation of the Kyrgyz Republic.

5. Recognize invalid:

1) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Concept of development of Customs Service of the Kyrgyz Republic for 2022-2025" of April 8, 2022 No. 202;

2) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About introduction of amendments to the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Concept of development of Customs Service of the Kyrgyz Republic for 2022-2024" of April 8, 2022 No. 202" of July 12, 2022 No. 378;

3) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About introduction of amendments to the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Concept of development of Customs Service of the Kyrgyz Republic for 2022-2024" of April 8, 2022 No. 202" of May 29, 2023 No. 285;

4) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About introduction of amendments to the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Concept of development of Customs Service of the Kyrgyz Republic for 2022-2024" of April 8, 2022 No. 202" of October 14, 2024 No. 618.

6. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

7. This resolution becomes effective after fifteen days from the date of official publication.

The concept of development of Customs Service of the Kyrgyz Republic for 2026-2030

Chapter 1. Introduction

The concept of development of Customs Service of the Kyrgyz Republic for 2026-2030 (further - the Concept) is the document determining the main directions of strategic development of Customs Service and enhancement of customs administration for the medium-term period.

Development of new approaches in the customs sphere and terms of planning are caused taking into account strategic reference points of development of the Kyrgyz Republic for the long-term period and the main directions of implementation of the digital agenda determined in the National strategy of development for the Kyrgyz Republic for 2018-2040 approved by the Presidential decree of the Kyrgyz Republic "About the National strategy of development for the Kyrgyz Republic for 2018-2040" of October 31, 2018 No. 221, of the Concept of digital transformation of the Kyrgyz Republic for 2024-2028 approved by the Presidential decree of the Kyrgyz Republic "About approval of the Concept of digital transformation of the Kyrgyz Republic for 2024-2028" of April 5, 2024 No. 90, and also in the international treaties and acts constituting the right of the Eurasian Economic Union (further - EEU), the economic and integration processes determining further development within EEU.

The main ideology of this Concept is based on the principle "from customs control to service-oriented customs administration" (further - the principle "from control to service") based on the national digital platform "Smart of Bazhy" (further - NTsP "Smart of Bazhy").

Transition to the principle "from control to service" is the modern concept directed to transformation traditional, often strict and bureaucratic system of customs clearance, in more flexible, oriented to participants of foreign economic activity (further - participants of foreign trade activities) and creation of positive user experience. Such approach promotes increase in efficiency, acceleration of procedures and cost reduction for business.

This vision represents synthesis of international standards, modern technologies, experience of the successful countries, economic need and requests of business that provides transition from the system oriented mainly to control and check to system which puts in priority service quality, transparency and partnership.

The ideology of transition to the principle "from control to service" is proved by the following key factors:

1) compliance to international standards and recommendations, including implementation of recommendations of World Customs Organization (further - WCO), such as system of safe and effective customs treatment (The framework standards of safety and simplification of procedures of world trade (Security and Facilitation, SAFE) which emphasizes importance of simplification of procedures of electronic exchange of information and active partnership with business;

2) experience of the leading countries and international the practician, the analysis of successful cases of the countries with the developed customs system where transition to service approach led to increase in efficiency and cost reduction;

3) economic need of development of global trade, acceleration of procedures of customs clearance for increase in competitiveness of export-import transactions and stimulation of economic growth;

4) state policy and strategic initiatives, including national programs and strategy for development of digital economy, increase in transparency and efficiency of the state services;

5) simplification of procedures and automation, minimization of bureaucratic procedures through use of the electronic and automated systems for submission of documents, execution of customs declarations and check of goods that promotes reducing time of passing of customs transactions and decrease in probability of mistakes;

6) creation of conditions for transition to the principle "from control to service", including implementation of procedures of preliminary informing and preliminary declaring through electronic communication channels. It will allow to accelerate passing of customs transactions, will simplify procedures for business and will give opportunity of more exact planning of its activities;

7) the principle "partnership and cooperation" - implementation of institute of independent customs experts (customs auditors) within which customs authorities will review interaction format with business community, based on reliance principles, consulting support and joint finding solutions for increase in efficiency;

8) use of innovative technologies, including systems of tracking, artificial intelligence, cloud computing and блокчейн for increase in transparency, predictability and safety of procedures;

9) training and informing participants of the market, permanent increase in level of knowledge and knowledge of participants of foreign trade activities of new opportunities, tools and requirements;

10) ensuring openness and transparency, provision of available information on rules, procedures and the status of loads that promotes timely and transparent data exchange between customs authorities and participants of foreign trade activities;

11) respect for the principle of the "balance between control and service" including providing necessary control measures for protection of interests of the state in case of simultaneous improvement of quality of servicing of business community;

12) the principle of "continuous improvement" assuming regular optimization of customs processes, implementation of new technologies and methods of work for increase in system effectiveness.

Benefits of transition to the principle "from control to service" are:

- reducing time for making of customs transactions;

- increase in predictability and transparency of customs transactions;

- creation of more comfortable conditions for participants of foreign trade activities;

- increase in level of credibility from participants of foreign trade activities;

- increase in competitiveness of the country in the international market;

- decrease in corruption risks and bureaucracy.

The main basic documents on which relied in case of development of this Concept are: The protocol on introduction of amendments to the agreement on organization of the World Trade Organization accepted on November 27, 2014 in the city of Geneva and ratified by the Law of the Kyrgyz Republic of November 22, 2016 No. 183 (further - the Agreement on simplification of procedures of trade), the International convention about harmonization and simplification of customs procedures signed in the city of Kyoto on May 18, 1973, the Framework agreement on simplification of procedures of cross-border paperless trade in the Pacific Rim (ESCAP) and also the modern instruments of customs administration developed by the international customs community on platform of WCO.

The methodological approach used in case of development of the Concept consisted of three stages: analytical stage, planning stage, discussion stage with participants of foreign trade activities, expert community, the international organizations and the interested state bodies.
